The American Civil Liberties Union of Arizona (“the ACLU of Arizona”) 25 seeks injunctive and other appropriate relief, pursuant to 5 U.S.C. § 552, including the 26 immediate processing and release of agency records improperly withheld by Defendants 27 United States Department of Homeland Security (“DHS”) and its sub-agency U.S. 28 Immigration and Customs Enforcement (“ICE”). On September 24, 2018, the ACLU of Arizona submitted a Freedom of 2 Information Act (“FOIA”) request seeking records related to the day-to-day operations of 3 the Law Enforcement Support Center (“LESC”), a component entity housed within ICE. 4 A copy of the request is attached as Exhibit A. 5 3. The LESC provides immigration status, identity information, and real-time 6 assistance to local, state, and federal law-enforcement agencies regarding people who 7 come into contact with local and state law enforcement officers. 8 4. In particular, the LESC serves as the single national point of contact to 9 provide timely immigration status information to local law enforcement officers when a 10 local officer stops a driver for a traffic offense and subsequently develops suspicion that 11 the driver may be in violation of federal immigration laws. The ACLU of Arizona seeks 12 the requested records in order to shed light on the nature of these routine interactions 13 between local police and the federal agency that is primarily responsible for enforcing 14 federal immigration laws. 15 5. To date, Defendants have not produced any records responsive to the 16 ACLU of Arizona’s September 24, 2018 FOIA request. 17 18 Jurisdiction and Venue 6. The subject matter and parties fall under this Court’s jurisdiction under 19 5 U.S.C. § 552(a)(4)(B), 5 U.S.C. § 701–706, and 28 U.S.C. § 1331. 20 7. The ACLU of Arizona’s principal place of business is in the District of 21 Arizona; venue is proper under 5 U.S.C. § 552(a)(4)(B) and 28 U.S.C. § 1391(e). 22 23 Parties 8. The ACLU of Arizona is a nonprofit, 501(c)(4) organization and is the state 24 affiliate organization of the national American Civil Liberties Union (“National ACLU”), 25 with approximately 18,000 supporters in Arizona. The National ACLU is a nationwide, 26 nonprofit, nonpartisan organization dedicated to protecting civil liberties and human 27 rights in the United States. Both the ACLU of Arizona and the National ACLU work daily 28 in courts, legislatures, and local communities to defend and preserve the individual rights 2 Case 2:18-cv-04821-DWL Document 1 Filed 12/19/18 Page 3 of 6 1 and liberties that the Constitution and laws of the United States guarantee everyone in 2 this country. The ACLU of Arizona has a particular commitment to ensuring that 3 fundamental constitutional protections of due process, equal protection, and freedom 4 from unreasonable searches and seizures are extended to every person, regardless of 5 citizenship or immigration status. Additionally, the ACLU of Arizona educates the public 6 about civil liberties issues that are frequently revealed through government records made 7 public through FOIA and similar state statutes. 8 9. Defendant Department of Homeland Security is a department of the 9 Executive Branch of the U.S. Government and is an agency within the meaning of 10 5 U.S.C. § 552(f)(1). 11 10. Defendant U.S. Immigration and Customs Enforcement is a component of 12 DHS and is a federal agency within the meaning of 5 U.S.C. § 552(f)(1). 13 11. Defendants have possession, custody, or control of the requested records. 14 15 Facts 12. On September 24, 2018, the ACLU of Arizona sent its request for records 16 by email and by certified mail, with a United States Postal Service tracking number of 17 70172620000113534301. 18 13. The ACLU of Arizona emphasized that the documents responsive to the 19 request would “allow the public to better understand what transpires when a local law 20 enforcement officer contacts LESC to assist in determining an individual’s federal 21 immigration status” and that the ACLU of Arizona “intends to share responsive 22 documents with the general public and to analyze specific documents to raise public 23 awareness of this unique form of interaction between local and federal law enforcement.” 24 The ACLU of Arizona’s request also includes a request for a fee waiver or limitation 25 under 5 U.S.C. § 552(a)(4)(A)(iii) because the disclosure of the requested records is in 26 the public interest and not in the ACLU of Arizona’s commercial interest, and because 27 the ACLU of Arizona qualifies as a “representative of the news media.” 28 3 Case 2:18-cv-04821-DWL Document 1 Filed 12/19/18 Page 4 of 6 1 14. On September 26, 2018, ICE acknowledged, via email, receipt of the ACLU 2 of Arizona’s request, issued tracking number 2018-IFCO-66639, and requested a ten-day 3 extension pursuant to 5 U.S.C. § 552(a)(6)(B). A copy of that correspondence is attached 4 as Exhibit B. 5 15. As of the filing of this complaint, Defendants have not produced any 6 responsive records, have not communicated to the ACLU of Arizona about whether any 7 responsive records have been located within the agency, and have not communicated to 8 the ACLU of Arizona about whether Defendants intend to produce any responsive 9 records, or on what timeline they intend to do so. 10 16. Because Defendants failed to comply with the 20-business-day time limit 11 provision of FOIA, 5 U.S.C. § 552(a)(6)(A)(i), the ACLU of Arizona is deemed to have 12 exhausted its administrative remedies with respect to the request under 5 U.S.C. 13 § 552(a)(6)(C)(i). 14 15 Defendants Have Violated FOIA 17. Under FOIA, Defendants have a legal duty to determine, within 20 days 16 (excepting Saturdays, Sundays and legal public holidays) after receiving a request, 17 whether they will comply with a FOIA request. 18 18. Defendants also have a legal duty to immediately notify a requester of their 19 determination and the reasons therefor. 20 19. To date, other than Defendants’ September 26, 2018 email, the ACLU of 21 Arizona has received no communications from Defendants regarding its request. 22 Specifically, ACLU of Arizona has not received a determination regarding its request 23 from Defendants or from any component agency of DHS or ICE. 24 20. Defendants’ failure to determine whether they will comply with the ACLU 25 of Arizona’s request, within 20 business days after receiving it, violates FOIA, 5 U.S.C. 26 § 552(a)(6)(A)(i), and applicable regulations promulgated thereunder. 27 28 4 Case 2:18-cv-04821-DWL Document 1 Filed 12/19/18 Page 5 of 6 1 21. Under FOIA, the ACLU of Arizona also has a legal right to promptly obtain 2 the specific agency records specified in its September 24, 2018 request, which Defendants 3 currently maintain, posses, or control in their custody. 4 22. There exists no legal basis for Defendants’ failure to make the requested 5 records promptly available to the ACLU of Arizona, its members, and the public. 6 23. Defendants’ failure to promptly make available the records requested 7 violates FOIA, 5 U.S.C. § 552(a)(3)(A), and applicable regulations promulgated 8 thereunder. 9 10 REQUESTED RELIEF WHEREFORE, the ACLU of Arizona requests that the Court award it the 11 following relief: 12 24. Declare that Defendants violated FOIA by failing to determine whether to 13 comply with the ACLU of Arizona’s request within 20 business days and by failing to 14 immediately thereafter notify the ACLU of Arizona of such determination and the reasons 15 therefor; 16 25. Declare that Defendants violated FOIA by unlawfully withholding the 17 requested records; 18 26. Order Defendants to immediately disclose the requested records to the 19 public and make copies immediately available to the ACLU of Arizona without charge 20 for any search or duplication fees; 21 27. Award the ACLU of Arizona its costs and attorneys’ fees; and 22 28. For example, in October 2015 the ACLU of Arizona released a report drawn from first-hand accounts and public records obtained through FOIA, detailing a pattern of constitutional violations by the U.S. Border Patrol at interior immigration checkpoints.2 Earlier this year, the ACLU of Arizona and partner organizations released a report, drawn from 30,000 pages of government documents obtained through FOIA, bringing to light the systemic abuse and neglect of immigrant children detained by U.S. Customs and Border Protection.3 The ACLU of Arizona qualifies as a “representative of the news media” because it regularly “gathers information of potential interest to a segment of the public, uses its editorial skills to turn the raw materials into a distinct work, and distributes that work to an audience.” 5 U.S.C. § 522(a)(4)(A)(ii); 6 C.F.R. § 5.11(b)(6); see also Nat’l Security Archive v. RECORDS REQUESTED The ACLU of Arizona seeks disclosure of the following categories of Records held by ICE, relating to the functions and operations of ICE’s LESC: 1. Any and all training materials developed by, administered by, promulgated by, revised by, reviewed by, and/or distributed by LESC’s Training Section from January 1, 2010, to the present. This request includes, but is not limited to, the following categories of documents: a. Any and all materials designed for ICE’s “Virtual University”; b. Any and all materials comprising the Basic Law Enforcement Specialist Training (“BLEST”); c. Any and all materials that comprise mandatory training for Law Enforcement Specialists employed within LESC’s offices in Williston, Vermont; d. From January 1, 2010, to the present, manipulable and sortable data in Excel, .csv, or similar format derived from the Alien Criminal Response Information Management System (“ACRIMe”), and showing information related to every Immigration Alien Response (“IAR”) generated by Law Enforcement Specialists employed by the LESC in Williston, Vermont, and transmitted via the NLETS system to any state or local law enforcement agency in response to the state or local law enforcement agency’s biographic query (IAQ). To clarify, this request seeks data derived from all IARs generated by LESC within the relevant time period in response to a biographic – as opposed to biometric – query submitted to LESC by a state or local law enforcement agency. This request includes, but is not limited to, the following “fields” – or categories – of information found within the ACRIMe system for each IAR generated within the system during the relevant time period: a. Name of the requesting law enforcement agency; b. City/state of the requesting law enforcement agency; c. Date and time that the IAQ was received by LESC; d. This request does not seek populated fields of data, but rather seeks the architecture of the ACRIMe system, sufficient to allow the ACLU of Arizona to understand the total universe of fields and/or categories of information that a Law Enforcement Specialist employed within the LESC may choose to record in the system when preparing and transmitting an IAR. This request seeks information pertaining to all categories of fields in ACRIMe, regardless of whether the actual data points were requested elsewhere in this FOIA request. If any records responsive or potentially responsive to the Request have been destroyed, this Request includes, but is not limited to, any and all records relating to or referring to the destruction of those records. This includes, but is not limited to, any and all records relating or referring to the events leading to the destruction of those records. REQUEST FOR A WAIVER OR LIMITATION OF SEARCH AND REVIEW FEES The ACLU of Arizona seeks a waiver of processing (search and review) fees because disclosure of these records is in the public interest and not in the ACLU of Arizona’s commercial interest, and because the ACLU of Arizona qualifies as a “representative of the news media.” See 5 U.S.C. § 552(a)(4)(A)(iii) (“Documents shall be furnished without any charge or at a charge reduced below the fees established under clause (ii) if disclosure of the information is in the public interest because it is likely to contribute significantly to public understanding of the operations or activities of the government and is not primarily in the commercial interest of the requester.”). 6 Case 2:18-cv-04821-DWL Document 1-2 Filed 12/19/18 Page 8 of 9 6 C.F.R. § 5.11(d)(1) (search fees shall not be charged “for requests by educational institutions . . . or representatives of the news media”). As discussed below, federal agencies routinely grant such fee waivers for FOIA requests made by the ACLU and its state affiliates, like the ACLU of Arizona, for these reasons. At a minimum, should a total fee waiver be denied, “fees should be limited to reasonable standard charges for document duplication” because the ACLU of Arizona is a “representative of the news media” and the records are not sought for commercial use. 5 U.S.C. § 552(a)(4)(A)(ii)(II). AMERICAN CIVIL LIBERTIES UNION FOUNDATION OF ARIZONA The records requested will contribute significantly to public understanding of the government’s operations or activities. Under 6 C.F.R. § 5.11(k)(2), the following factors are to be considered in determining whether a disclosure is in the public interest: (i) whether the subject of the requested records concerns “the operations or activities of the government”; (ii) whether the disclosure is “likely to contribute” to an understanding of government operations or activities; (iii) whether disclosure of the requested information will contribute to “the understanding of a reasonably broad audience of persons interested in the subject”; and (iv) whether disclosure is likely to contribute “significantly” to public understanding of government operations or activities. See 6 C.F.R. § 5.11(k)(2)(i)-(iv). Each of these considerations is satisfied here. First, the records requested pertain directly to the operations and activities of the federal government (specifically, ICE and one of its subcomponents, LESC). Second, this request is “likely to contribute” to an understanding of government operations or activities, specifically by helping the public to better understand the relationship between its local law enforcement agencies and the federal agency tasked with enforcing immigration laws within the interior portions of the United States. In particular, this request is tailored to allow the public to better understand what transpires when a local law enforcement officer contacts LESC to assist in determining an individual’s federal immigration status. Third, disclosure of the requested information will contribute to “the understanding of a reasonably broad audience of persons interested in the subject” of how local law enforcement officers interact with LESC when detaining, stopping, or arresting an individual suspected of being unlawfully present in the United States. Among other things, the ACLU of Arizona intends to share responsive documents with the general public and to analyze specific documents to raise public awareness of this unique form of interaction between local and federal law enforcement. Finally, disclosure will contribute “significantly” to the public understanding of both ICE and its subcomponent LESC. The question of how local law enforcement interacts with federal immigration enforcement agencies 7 Case 2:18-cv-04821-DWL Document 1-2 Filed 12/19/18 Page 9 of 9 has garnered significant public and media attention in recent years, yet much remains unknown about this topic. Disclosure of the information requested is not in the ACLU of Arizona’s commercial interest and the ACLU of Arizona is not acting on behalf of any party. The ACLU of Arizona is a nonprofit organization and any information obtained as a result of this Request will be made available to the public at no cost. Additionally, as described in detail above, the ACLU of Arizona meets the statutory and regulatory definitions of a “representative of the news media” because it is an “entity that gathers information of potential interest to a segment of the public, uses its editorial skills to turn the raw materials into a distinct work, and distributes that work to an audience.” 5 U.S.C. § 552(a)(4)(A)(ii)(II). AMERICAN CIVIL LIBERTIES UNION FOUNDATION OF ARIZONA For the foregoing reasons, a fee waiver or limitation should be granted. A fee waiver would also fulfill Congress’s legislative intent in amending FOIA, namely to ensure that the Act is liberally construed in favor of granting waivers for noncommercial requesters and to effectuate disclosure of documents of public importance. See Judicial Watch Inc. v. Rossotti, 326 F.3d 1309, 1312 (D.C. Cir. 2003) (“Congress amended FOIA to ensure that it be liberally construed in favor of waivers for noncommercial requesters.”) (internal quotation marks and citation omitted); OPEN Government Act of 2007, Pub. L. No. 110-175; 121 Stat. 2524 (finding that “disclosure, not secrecy, is the dominant objective of the Act,” quoting Department of Air Force v. Rose, 425 U.S. 352, 361 (1992)). Should a total waiver be denied, fees should be “limited to reasonable standard charges for document duplication.” 5 U.S.C. § 552(a)(4)(A)(ii)(II).
