Since that e-mail was transmitted, Hemisphere has come on line at the Atlanta HIDTA, and the HTDTAs have generally established that DEA Hemisphere requests should be passed to the local HIDTA which will then forward the request to the appropriate Hemisphere HJDTA (Atlanta, Houston, or LA). Also, DARTS/National Subpoena Generator (NSG) now has a separate tab, labeled "A TI-H", for the Operation Hemisphere subpoena (which has language approved by Chief Counsel). Ho,,..·ever, this tab is only made visible to those designated by their field division to have the authority to initiate Hemisphere subpoenas. In order to facilitate access to the NSG Hemisphere subpoena for your office, please forward me a list of those individuals that your field division would like to have the ability to generate Hemisphere subpoenas, and we will provide them access to the "ATI-H'' tab. Specific topics of interest on our end include: 1) Disclosure of tips by DEA from the Special Operations Division, and the subsequent re-creation of information/evidence by law enforcement to aid prosecutors. 2) The secrecy of both The Hemisphere Project as well as the Special Operations Division. Law enforcement interests aside, if these programs are legal and so widely used, why the need for such secrecy? Why, according to the articles, does law enforcement go through such lengths to prevent disclosure of the programs? 3) Any legal analysis/ opinions regarding the legality ofThe Hemisphere Project and the use of administrative subpoenas, and any checks or balances or oversight over the program. AT&T is requesting that a justification he put on a second fonn that they want along with the subpoena. In the training the I/As receiYcd in Houston they have been instructed to include what type of drug investigation it is. I do not think AT& T has a right to that information and should not ask for it. I have instructed the l/As not to include it.
