In their Motion for Summary Judgment, Plaintiffs argued that the City of Seattle’s First-inTime rule (“FIT rule”) was not a valid basis for regulating the use of rent-bidding technology because

the King County Superior Court had struck down the FIT rule on constitutional grounds. Dkt. 22 at
17
pp. 17-18 (citing Dkt. 22-2). The City informs the Court that the Washington State Supreme Court has
18
accepted direct review of Yim v. City of Seattle, the case challenging the First-in-Time rule. See
