employees with direct knowledge of the situation to advise them to not discuss the incident further with anyone. We also began arrangements for us to conduct a joint assessment of the situation by conducting interviews with the individuals named above, with the exception Ofiudge Lundell. I explained to her the process by which complaints are filed with the Judicial Commission, and that the purpose of our interviews would be to determine the appropriateness of a complaint being filed With the Commission to conduct an investigation. it was not determined who would file a complaint. in addition, we agreed that no more than a 24 hour notice prior to meeting with each individual and witness would be appropriate, to reduce internal discussions among staffers. We also discussed the fact that Judge Lundell would be absent on vacation beginning Wednesday; November 7 ?continuing through Friday, November 16. On Tuesday, November 6 Terra provided me with several dates that were available for conducting interviews and later it was determined that Thursday, November 15 would be suitable. She would be charge of arranging times to meet with the individuals. On Wednesday, November 7 Don contacted me by email to request that the other judges in St. Croix be briefed and have the opportunity to ask questions. I agreed with this approach and he indicated he would arrange for a lunch meeting with these individuals on that day. On Thursday, November 8 Tarra emailed to indicate that she was informed thatJudge Lundell will not be away on vacation, and that we should move the dates of the investigation up to earlier in the week. We rescheduled the dates for Monday, November 12 and Tuesday, November 13. At 8:30 AM on Friday, November 9, in a conference call with Tarra and Don Harper, we discussedthe investigation strategy for next week, including the rescheduling of the meetings. i also forwarded her information on the court?s Employee Manual and the Judicial Commission procedures. Later on Friday at approximately?9115 AM through 10 AM in a series of direct conversations, and phone calls with Don Harper, I spoke with Director of State Courts, Judge Randy Koschnick; Deputy Director for Court Operations, Diane Fremgen; District Court Administrator Don Harper on several occasions regarding the investigation process. As part of the discussion, Don Harper expressed concern about Judge Lundell?s state of mind based on information he had heard from an attorney friend ofJudge Lundell?s, who indicated he was Don was to contact the Sheriff?s Department to alert them to be mindfui ofJudge Lundell's behaviOrland demeanor when entering the building, in the event he could be a threat to himself or others. Separately, on the morning ofNovember 9, at approximately 10 AM Judge Koschnick, Diane and I had a conversation with ChiefJudge Maureen Boyle (District 10) to provide her an update on the situation. Judge Koschnick agreed that he would travel to District 10 to meet with Judge Lundell to discuss Judge Boyle?s concerns with his state of mind and potential concerns about being absent. As part ofthe discussion there would not be the intent to discuss the investigation unless it was raised .by Judge Lundell; however they are prepared to discuss the basic framework of the allegations.
