CITY OF SEATTLE et al. 15 Defendants. 16 17 Plaintiffs and Defendants (“Seattle”) submit this Joint Status Report in accordance with 18 the Stipulated Motion Regarding Motions and Briefing Schedule entered on December 11, 2018. 19 1. On October 26, 2018, the parties submitted a Joint Status Report and Discovery 20 Plan that (i) agreed to defer any discovery in this action until the Court’s resolution of a motion 21 for discovery under Rule 56(d) to be filed by Seattle after Plaintiffs file a motion for summary 22 judgment and (ii) set forth a schedule for the filing and briefing of such motions. 23 2. The Stipulated Motion temporarily suspended the filing and briefing of the 24 parties’ respective motions while the Seattle City Council considered an amendment to the 25 collective-bargaining ordinance under review in this action. 26 27 3. On January 7, 2019, the City Council passed, and on January 11, the Mayor of Seattle signed, an amendment to the ordinance. The parties have now agreed to the following schedule for the filing and briefing of motions: 3 Plaintiffs’ Motion for Summary Judgment: February 15, 2019 4 Seattle’s Rule 56(d) Motion: March 8, 2019 5 Plaintiffs’ Opposition to Rule 56(d) Motion: March 29, 2019 6 Seattle’s Reply in Support of Rule 56(d) Motion: April 12, 2019 7 5. In the event the Court issues an order denying Seattle’s Rule 56(d) motion, Seattle 8 will file its opposition to Plaintiffs’ motion for summary judgment no later than three weeks after 9 such order, and Plaintiffs will file their reply in support of their motion for summary judgment 10 11 no later than two weeks after the filing of Seattle’s opposition. If Seattle elects not to file a Rule 56(d) motion, then Seattle will file its opposition to 12 Plaintiffs’ motion for summary judgment by March 15, 2019, and Plaintiffs will file their reply 13 in support of the motion for summary judgment by March 29, 2019. 14 DATED this 15th day of January, 2019.
