We are DEA Task Force Of?cers and were completing duties related to an assignment involving a Drug Interdiction Initiative. We were stationary in the area of Interstate 70 west near the 205 mile marker During this t1me I observed a white Ford F450 traveling west on I 70 1n the slow lane. The Ford was behind a small white passenger car. The Ford maintained less than one car distance between the front bumper of the Ford and the rear of the passenger car while traveling at about 65 miles per hour. The Ford had window tint applied to all of the passenger windows including the windshield. The front windows and the windshield appeared to be in violation of the restrictions regarding vision redticing material. The Ford was later identi?ed as: SUSPECT VEHICLE COLOR: WHITE YEAR: 2014 MAKE: FORD F450 1 TN LIC: 24900H2 2017 VIN: 1FT8W4DT7EEB56155 I activated the emergency equipment in the patrol vehicle and conducted a traf?c stop with that vehicle on I-70 west near the Highway exit. CLEAR FORFEITURE- TN OLN 085158201 2015 ISIS CT MURFREESBORO TN 37128 I advised Johnny of the reasons for the stop and asked him about the window tint. Johnny replied guess it isn?t legal?. I requested his Driver?s License and vehicle paperwork. Johnny provided me with a Tennessee Driver?s License and stated that he lives in Tennessee. He provided me with an expired insurance card and said he could not locate his vehicle registration. Johnny advised that he was driving from Murfreesboro, Tennessee to Kansas City, Missouri. He said he was working in paintless dent removal. During my contact with Johnny I noted that he avoided contact with me and his hand trembled uncontrollably as he provided his documents. I con?rmed that the entire windshield was tinted with dark window tint. (A later check of the driver?s side window tint using a window tint meter showed the window was tinted at 6% VLT.) I asked Johnny to accompany me to my patrol vehicle while I conducted the records checks related to the . traf?c stop. Johnny agreed and sat in the front passenger seat. I began conducting the records checks and- spoke with Johnny at the same time. TFO Thomas deployed canine Tyson on the Ford during this time. While I conducted records checks I spoke with Johnny and he said he was headed to Kansas City to work on vehicles with hail damage because he owned a paintless dent removal (PDR) business. I mentioned his very large truck and asked him if he ever towed anything with it. He said he towed his work trailer with all of his PDR tools to his job sites and that he travels from place to place for work. I asked him how he planned to work in Kanias City when he did not have his tools. He said that he was just driving to Kansas City to check into the work availability in the area. He said he did not have anyone else working in Kansas City at that time and that He would just ask around at other PDR places to see if there was any ?good cars?. Then if there was ?good cars? he would stay and work and maybe call up some other people to bring the tools. I asked him why he drove such a large vehicle and he said that he only has the one vehicle. Then he said ?my brother is working in - Colorado and I worked there a few months ago too?. I, I asked Johnny if he traveled with any ?rearms and he said he had a handgun in his vehicle near the drivelr?s seat. I asked him if he traveled with any large amounts of currency and he said yes. He said that he had $20,000.00 or $25,000.00 in his vehicle. I asked him why he traveled with such a large amount of money. He said that he hires mostly illegal workers and has to pay them in cash for their work. I asked why he was bringing the money to Kansas City when he did not have any work lined up and he said he did not have ahy workers there. He paused and stuttered don?t know, I just have it?. At that time I asked Johnny for consent to search the vehicle and all of the contents. He gave consent and I exited the patrol vehicle to speak with TFO Thomas. CLEAR FORFEITURE- sniff as I conducted the records checks. 1 I began a search of the Ford and located a ?rearm on the driver?s ?oorboard. I located US Currency in a black back pack on the back seat of the Ford. The currency was rubber banded in increments and appeared to be much more than the $25,000.00 that was declared by Johnny. I opened the tailgate of the Ford and noted it was full of large suitcases. I Opened the nearest one and found that it smelled heavily of marijuana and contained loose dryer sheets. TFO Thomas and I decided to move the Ford to a secure location in order to conduct further investigation. I returned to the patrol vehicle and advised Johnny that he was being detained and I advised him of his Miranda Rights via DEA form He said he understood those rights. I transported Johnny to Superior Towing (11 Elaine Drive, O?Fallon MO 63366) in the patrol vehicle and TFO Thomas drove the Ford. I followed directly behind the Ford until our arrival at Superior Towing. While enroute to Superior I spoke to Johnny regarding the currency and empty cases. I advised him that should be honest about the situation and if he is being paid to transport drugs then he should tell us. I asked him if the money was his or if he was being paid to drive it. He said ?it?s mine?. I advised him that the 0 es smelled like marijuana and I asked him if he is hauling heroin or cocaine, he said no. I said so you?re only hauling marijuana? And he said softly ?yeah?. I asked him how much money was in the vehicle and he said 100. . . 120, maybe 130,000. I asked him if he was sure and he looked up and began counting in his head. lie said maybe 140,000. Upon our arrival at Superior Towing TFO Thomas advised me that Johnny?s GPS was active in the vehicle and showed a destination of Colorado, not Kansas City. We conducted a thorough search of the Ford. During the search I removed the backpack from the Ford and noted that it contained a plastic bag ?lled with currency and two large clipboards. Each clipboard had currency concealed inside of them. The currency and the concealment were photographed. The currency was packaged in a manner consistent with drug distribution and smelled of marijuana. The truck bed was covered with a hard bed cover which folded open. I opened?the cover and located four identical Samsonite golf club cases. All of the cases were empty except that two contained loose dryer sheets and marijuana remnants. A zippered bank pouch was located within a small uf?e bag on the back seat. The duf?e bag contained several changes of clothes and the zipper pouch containe three vials of liquid which appeared to be illegal steroids. Numerous syringes were also located throughout the Ford. Sitting on the back seat of the ford was a re?ective vest which Johnny stated belonged to his friend that was a cop. 1 I know from training and experience that Colorado is a common source for large scale marijuana distribuiion. Bulk quantities of Marijuana are often transported inside of large suitcases and dryer sheets are often use to mask the odor. CLEAR ORFEITURE- Currency associated with drug transactions is commonly rubber banded 1n increments and mostly comprised of twenty dollar bills. At that time DEA TFO E. Begley and DEA TFO P. Welch arrived to assist with the investigation of the incident. We gathered, photographed, and/or seized any items we believed were relevant to the incident. Johnny completed a written Miranda waiver and provided a written statement. He stated that he was paid to transport the US Currency to Colorado and he completed a disclaimer form stating that the currency did not belong to him. Due to the felony drug possession charges (suspected steroids) the ?rearm which was located in the vehicle was seized pending further investigation. That ?rearm was identi?ed as SEIZED FIREARM SIG SAUER 1 1911 .45 AUTO GS76673 1 2 MAGAZINES 16 ROUNDS AMMUNITION - A discretionary sniff of the currency was set up for TFO Thomas and K9 Tyson using DEA Once those were cleared by the K9 the currency was removed from the original packaging and secured inside of DEA SSEE M000101948 and DEA SSEE 8000061128 (which had been cleared by K9 Tyson during the discretionary sniff) in the immediate presence of TFO Thomas. I returned the containing the 1 currency to the discretionary sniff area with the other previously cleared for TFO Thomas. TFO Thomas conducted a discretionary sniff and advised that canine Tyson did give an af?rrnative reSponse to] the which had the placed currency during the discretionary sniff (see TFO Thomas? supplement report for further). I Upon review of the case and the totality of the circumstances it was determined that the bulk currency which was located in the vehicle would be seized for forfeiture. I provided Johnny with DEA form 12 for the seized currency and he was released from the scene with the Ford. TFO Thomas and I transported the seized currency to UMB Bank Fallon/W 1nghaven location) where it was opened, sorted, and counted. The seized currency was determined to be $139,580. 00 by staff. DEA can conduct follow up and gather further evidence for the case in TN and CO 1 11. The left lane was clear so the Ford could have safely passed or . slowed down to maintain a safe distance. As the vehicle drove past I noticed that the windows including the windshield were heavily tinted and appeared in violation of the law on vision reducing material. TFO Boaz then explained the violations to Johnny. After a brief conversation TFO Boaz requested that Johnny return to the patrol vehicle with him so that he could conduct records checks. Johnny was cooperative during this time and was seated in the front of the patrol vehicle. I While TFO Boaz conducted records checks I elected to utilize my PSD Tyson #6215 to conduct a free air I sniff of the vehicle. It should be noted that Tyson is trained and certi?ed in the detection of narcotics. Tyso has also been found to be reliable by TFO Boaz and I in past deployments. I then retrieved Tyson and led him to the front of the Ford. I then began the free air sniff. During the sniff I observed Tyson display alert behavior near the rear wheels wells of the Ford. I noticed that Tysons behavior changed and he became ?xated in this area, breathing deeply and ?aring his nostrils as he forced his nose near the undercarriage. Tyson then went into a down position near the rear wheel well. I then returned Tyson to the patrol vehicle where I observed that TFO Boaz was still conducting the records checks. A short time later TFO Boaz exited the patrol vehicle. I then noti?ed TFO Boaz and Johnny of the results of the free air sniff. TFO Boaz stated that Johnny had given consent to search the vehicle. Johnny con?rmed this and stated that we could go ahead and search the vehicle. TFO Boaz began the search and a short time later located bulk US Currency inside the cab. He also located suitcases in the bed of the truck which contained dryer Sheets and small pieces of marijuana. At that time we elected to move the traf?c stop away from the hazards of the interstate. I drove the Ford and TFO Boaz followed behind me with Johnny. We relocated to Superior Towing at 11 Elaine Dr. in O?Fallon, MO. Once we arrived Johnny was secured and we began a thorough search of the Ford. During the search TFO Boaz located additional bulk US Currency inside a black back pack on the rear seat. A total of 4 suitcases were located in the bed of the truck which were identical and smelled heavily of marijuana. A handgun was; located on the driver?s side ?oorboard. A loaded magazine was also in the ?rearm making it readily capable of lethal force. A small bag containing vials of a suspected controlled substance was located in a duf?e bag on the rear seat. All relevant evidence was photographed and/or seized and secured as evidence. TFO Ed Begley and TFO Patrick Welch arrived a short time later and assisted in the investigation. Johnny later disclaimed ownership of the currency and stated that he was being paid to transport it to Colorado. i TFO Boaz then setup a discretionary sniff inside the warehouse. It should be noted that Tyson is a trained, i certi?ed, and reliable narcotic detector dog. Tyson is proofed off the smell of U.S. currency and is certi?ed annually by the National Narcotic Detector Dog Association (NNDDA) and the North American Police Work Dog Association (NAPWDA). Having been proofed off of U.S. currency means that during training courses, Tyson is introduced to circulated United States currency. Tyson does not alert/indicate to the currency itself but rather any drug odor associated with it. TFO Boaz used 7 new/clean bags and placed them out on the or. I then led Tyson to this area and directed him to sniff the area including each bag and found that he did not. display any alert behavior. TFO Boaz then retrieved two of the bags and ?lled them with the US Currency. TFO Boaz had to utilize two bags due to the volume of US Currency present. I then brought Tyson back tolthe area and directed him to sniff each bag. During the sniff Tyson alerted/indicated to bag #3 and bag These bags did in fact contain the US Currency. I At that time the US Currency was seized based upon the discretionary sniff and the totality of the circumstances. Johnny was provided with a receipt for the US Currency and subsequently released from the scene with his vehicle. TFO Boaz and I transported the seized currency to UMB Bank for an of?cial bank - count. The currency was converted into a Cashier?s Check for $139,580.
