Ladies and Gentlemen,

This serves as the initial notice of a critical condition pursuit to the provisions of the

Consent Decree referenced above.

Survey data obtained and reviewed by our engineer on 1/9/19 has been continued to
show some lateral movement of the north slope of gypsum stack No. 4.

As immediate actions additional instrumentation is being deployed. and increased
frequency of inspections and monitoring have been implemented. Additional evaluation

of this condition is underway.

Although we are responding there is no immediate risk to the environment.
