Dear Ms. Thompson

On February 7, 2017, the Riverside County Sheriff?s Department received your written
correspondence which was not dated and contains requests based on the California Pubic
Records Act Government Code 6250 et seq). Outlined below are your reque t5
and our responses to the same:

Request "Please release the video recording at the old Riverside Court House on Januc ry
20, 2017 between 8:10 AM and 8:40 AM in the main entrance and courtyard area. In addition.
release all documents/videos pertaining to Melody Thompson, including and not limited to the
video before, during and after the arrest (the tape recording of the arrest/detainment and i re
police report created on January 20, 2017). In addition, 1 am asking that all these docutnei ts
and videos be preserved for court hearings. Under the California Public Records Act, 1 have a
right to the immediate release ofa copy ofthese doctunents 

Response: We regret to inform you that it has been determined that there are no disclosat 1e
records that can be made available for inspection and/or copying in response to your requet.
The records you seek are part of an ongoing investigation being conducted by the Riversi le
County Sheriff?s Department. Any records sought are exempt from disclosure under the CPR A
and thus will be withheld on the basis of the various grounds stated below:

This determination is made pursuant to Government Code 6254(f), which provides that 12 
enforcement investigation, security and intelligence information file records of a local polie
agency are exempt from disclosure. Furthermore, as set forth in Rivero v. Superior Court, :14
Cal. App. 4th 1048 (1997) and Williams v. Superior Court, 5 Cal. 4th 337 (1993), t] 
investigatory ?le exemption to the public records act request is not lost even where t] 
investigation is deemed concluded or terminated.

 

This determination is also made pursuant to Government Code 6254(k) read in conjunction
with Evidence Code 1040 which provides that of?cial information acquired in confidence by a
public employee is exempt from disclosure.
