The District is in receipt of your California Public Records Act request, dated and
received in our Of?ce January 22, 2019 for records available as the result of the
implementation of Senate Bill 1421. 

Please ?nd the attached documents responsive to your request from the Of?ce of
the Independent Police Auditor.

The District is endeavoring to comply as swiftly'as possible with the changes
enacted by SB 1421 to Penal Code Section 832.7 while preserving the safety and
privacy of those protected by the statute. The intent and letter of the amended
Penal Code Section 832.7 requires that BART protect the safety and privacy
rights of witnesses and complainants (through maintaining their anonymity) as
well as personal data of of?cers, such as a heme address, telephone number, and
identities of family members. Additionally, the amended code section prohibits
the District from providing con?dential medical, ?nancial, or other information
protected by federal law. Because the District has received a large number of
Public Records Act requests and is in the process of reviewing extensive records
for prohibited disclosures, BART now expects that the remaining documents will
be available by February 15, 2019. The District will update you as soon as more
records are available.

We will notify you of the availability of the records and the cost associated with
providing copies to you.
