Maze Zachary T. Burden REFERENCE: On Monday, July 24, 2017 at approximately 12:41 am. Mississippi Bureau of Investigation/Crime Scene Unit received a crime scene request from MBI Captain Kenneth Bailey to respond to a police of?cer involved shooting in Southaven, MS. MBI Captain Bailey reported MBI Master Sgt. Jeris Davis was in charge of the investigation. Upon arrival Master Sgt. Davis and Southaven Police Department Investigator Mark Little reported that on Sunday, July 23, 2017 at approximately 11:50 pm. Of?cer Maze and Of?cer Durden arrived at the residence to locate a suspect in a domestic violence incident that occurred in Tate County. After the victim, Rodriguez, reportedly opened the front door, a dog exited the residence and Rodriguez brandished his ri?e. Of?cer Durden and of?cer Maze were reportedly standing in the ?ont yard on opposite sides of the front porch. One of?cer ?red one shot at the dog and the other of?cer ?red four shots towards the front porch. The victim sustained an apparent gunshot wound to the base of his skull. EMT performed medical care to no avail. NARRATIVE SUMMARY: On Monday July 24, 2017 at approximately 1:15 am. the undersigned and Analyst Kristopher Wingert arrived at the aforementioned address to begin the examination of the crime scene. The crime scene Was at a single wide mobile home facing east and was located in a residential neighborhood. Upon arrival numerous law enforcement vehicles, an ambulance, and unmarked investigator vehicles were on scene. The area surrounding the property was dark and poorly lit with little or no ambient light. A utility pole with an orange light was in the back yard behind the mobile home. Yellow crime scene tape secured the crime scene and was tied across the front and sides of the property. Three mail boxes were near the 817-90000322 edge of the road in front of the residence. The south (left) black mailbox with a wooden pole attached was labeled ?588 l? on the side, the black middle mailbox with a blue pole attached with the word in red above it had the letter on the side, and the north (right) black mailbox with a wooden pole attached was labeled on the side. The front yard was mostly dirt with little or no grass. A gravel driveway was on the south side of the property. Two large trees were on the north and south sides of the front yard. The large tree on the south side had two signs attached to it and were facing the street/drive way. The sign on top was black with red letters and was labeled OF the sign underneath was white with black letters and was labeled MIND THE DOG BEWARD OF OWNE A picture of a hand holding a handgun was also depicted on the sign. Numerous vehicles (Ford Sport Trac, Honda, and Dodge Truck), various tools, numerous buckets, trash items etc. were in front of the residence scattered along the south side of the front yard. A cartridge case stamped 9mm and a projectile were on the ground southeast of the small wooden front porch. The projectile created an impact mark in the dirt next to a black tire iron tool beside a ladder leaning against the awning. The distance from the front of the vehicle near the cartridge case to the left edge of the front entry/exit door on the front porch was approximately 23 Three (3) cartridge cases stamped 9mm Luger+P?, one (1) cartridge case stamped ?Speer 9mm Luger+PlZ?, and a magazine containing ?fteen (15) live rounds stamped 9mm were on the ground northeast of the ?ont porch. The distance from the center mass of the four cartridge cases and the magazine to the le? edge of the front entry/exit door on the front porch was approximately 19? The dimensions of the mobile home was approximately 55 l? Blue under pinning (trailer skirt) was attached to the lower front portion of the home. Numerous windows, some partially covered with cardboard boxes, and curtains hanging from others were across the front of the mobile home. A concrete slab/patio approximately 9? 10 9? l? was across the center front of the mobile home. The concrete slab/patio was approximately 7? high. Various tools, a lawn mower, a large metal tool box, etc. were stored along the south area of the concrete slab/patio. An awning attached to the mobile home was above the concrete slab/patio which measured approximately 7?10? high. Along the north edge of the concrete slab/patio were three wooden steps on the east and south sides of a small wooden porch at the north edge of the concrete slab/patio. The east bottom step was approximately 5 high, the second step was approximately 7? high, and the top step was approximately 6 high. The small wooden porch measured approximately One wooden handrail with planters and other various items on top was attached to the north edge of the small wooden front porch. An apparent entry projectile defect was on the outer (north) right side of the wooden hand rail. The porch light was on and the front door was open. The exterior side of the front entry! exit door was dark brown in color, constructed of metal, with a rectangular shaped window right of the door knob. The door opened to the inside and the door knob was on the left (south) side. Three apparent projectile entry defects Were on the door. One defect was in the bottom portion of the window frame and the other two defects were in the lower center portion of the door. Entrance into the residence was through the hem door which led into the living room area. The living room was in complete disarray with various items (water bottles, blanket, pillow, shoes, papers, books, medical trash, etc.) scattered on the floor. The victim was face down in the center of the living room floor with an apparent entry gunshot wound to the base of his skull. Blood was on his upper back, shoulder, back of neck, and arms. His hands were handcuffed behind his back. He was wearing red athletic type shorts with a black stripe. A white ?Nike? tennis shoe was on his right foot and his left foot was bare. The matching white tennis shoe was on the ?oor between his legs. A pool of wet blood was on top of a blue blanket and on the floor to the left (east) of him. A larger pool of wet blood with various drag mark patterns and footwear impression patterns in the blood were on the ?oor to the right {west} of him. After the handcuffs were removed by of?cers and the victim was turned over, numerous EKG pads with silver colored snaps were attached to his thighs and arms. Three (3) larger pads with electrical cords attached were on his chest and abdominal area. Blood was on his chest, abdominal area, arms, shoulders, 17-00000322 neck, and face. There were no other apparent gunshot wounds observed on him. A brown couch with a multicolored ?owered sheet draped over it was against the east living room wall. A long ri?e labeled ARMS, MODEL 550-1, 22 S.L. LR. Ri?e, was on top of a pillow on the couch. The serial number was not observed. The butt of the ri?e was resting on the right arm of the couch, the trigger mechanism was facing the couch (east) and was resting on top of a white pillow, and the barrel was against the crease of the couch. A black card labeled ?Ardell Wispies Multipack? was resting on top of the barrel. The safety latch was off, one 1) live round stamped was removed ?om the chamber, and sever (7) live rounds stamped were removed from the tube. A lap top computer with an electrical cord attached and a water bottle were on top of the left side of the couch. Candy boxes, a lotion bottle, a water bottle, a purple floral purse, etc. were scattered along the top portion of the couch. The couch was in front of a large window with a curtain. A television stand with a television on top and various other items was against the southwest corner of the living room. A brown armchair with a yellow blanket across it was against the south wall. A small amount of blood was on the lower portion of the yellow blanket. An ottoman and a chair was against the west wall next to the window with and air conditioner. The northwest corner of the living room was cluttered with tables, chairs, plastic bags containing various items, a paint can, water bottles, etc. A large window with a blue curtain draped over it was against the west wall. A window air conditioner unit (which was on) was in the window. An apparent projectile defect was in the upper left edge of the curtain. Behind the curtain near the left side of the window frame was a through and through projectile defect. The projectile exited the mobile home and continued and Was not recovered. Left of the window frame against the west wall near cable connectors was an apparent through and through projectile defect. The projectile exited the mobile home and continued and was not recovered. The kitchen was north of the living room. Unwashed dishes were in the sink, a table with chairs was in the center of the kitchen, the counters were cluttered with food items and dishes, a clothes dryer was against the west wall, etc. A hallway, two bedrooms, and a bathroom were south of the living room. The rooms were cluttered with various items on the floors, on top of the bed, dresser, bathroom counters, etc. ASSISTANCE RENDERED: The crime scene was documented with photdgraphs and notes. The cluster of cartridge cases - three stamped 9mm and one (1) stamped 9mm on the ground northeast of the front wooden porch were photographed, collected, and marked for identi?cation as Exhibit #1 - The magazine containing the ?fteen (15) live rounds stamped 9mm on the ground northeast of the front wooden porch was photographed, collected, and marked for identi?cation as Exhibit 5. The one cartridge case stamped 9mm southeast of the front wooden porch was photographed, collected, and marked for identi?cation as Exhibit The ARMS Model 550-l, 22 LR. Ri?e? with the live rounds on top of the living room couch were photographed, collected, and marked for identi?cation as Exhibit The projectile collected from an impact mark on the ground southeast of the hunt wooden porch was photographed, collected, and marked for identi?cation as Exhibit The projectile collected from the wooden railing on the right (north) side of the front wooden porch was photographed, collected, and marked for identi?cation as Exhibit Multiple trajectory rods, a laser, and colored string were used to document, locate, and determine the path of the projectiles. Projectile defect #l was on the exterior side of the front entry/exit door below the window. Orange trajectory rods were used to document the defect. The directionality of this projectile originated from the outside. The trajectory had an approximate angle of departure {horizontal angle) of 129? from right to left and an approximate angle of elevation (vertical angle) of 86? with a slight upward slepe. The projectile 517-00000322 entered the living room and entered/exited the west wall left of the window. The defect on the door measured approximately 3? 5 from the bottom of the door and approximately 9 from the left edge of the door. The defect on the west wall left of the window was also marked defect and measured approximately 4?7? from the ?oor. String and a laser light were used to determine the trajectory of the projectile and if the door was open or closed. It was determined the door was opened approximately 1 when the projectile passed through it and exited the mobile home. The projectile was not recovered. Projectile defect #2 was on the exterior side of the ?oat entry/exit door. Pink trajectory rods were used to document the defect. The directionality of this projectile originated from the outside. The trajectory had an approximate angle of departure (horizontal angle) of 139? ??om right to left and an approximate angle of elevation (vertical angle) of 88? with a slight upward slope. The projectile entered the living room and entered and entered/exited the west wall right of the cable connectors. The defect on the door measured approximately 2?9 from the bottom of the door and approximately 1? 6 from the left edge of the door. The defect on the west wall right of the cable connectors was also marked as defect #2 (D-2) and measured approximately 2? 9 from the floor and l? 4 from the left edge of the window. String and a laser light were used to determine the trajectory of the projectile and if the door was open or closed. It was determined the door was opened approximately 3? when the projectile passed through it and exited the mobile home. The projectile was not recovered. Projectile defect #3 was on the exterior side of the front entry/exit door. Green trajectory rods were used to document the defect. The directionality of this projectile originated from the outside. The trajectory had an approximate angle of departure (horizontal angle) of 145? from right to left and an approximate angle of elevation (vertical angle) of 89? with a slight upward slope. The projectile entered the living room and entered the base of the victim?s skull. The defect on the door measured approximately 2?5? from the bottom of the door and approximately 1? from the left edge of the door. String and a laser light were used to determine the trajectory of the projectile and if the door was open or closed. It is unknown if the door was open or closed when the projectile passed through it and struck the victim in the base of his skull. Projectile defect #4 was on the right side of the wooden hand rail. A red trajectory rod was used to document the defect. The directionally of this projectile originated from the outside. The trajectory had an approximate angle of departure (horizontal angle) of approximately 37? from left to right and an approximate angle of elevation (vertical angle) of 88?. The defect on the hand rail measured approximately 4? 10 1/z? from the ground. The projectile entered the right (north) side of the wooden hand rail and did not exit. The projectile inside the wooden hand rail and was photographed, collected, and marked for identi?cation as Exhibit EVIDENCE DISPOSITION: Exhibit #9 were submitted to the Mississippi Forensics Laboratory (MFL) for Forensic Analysis under MFL Case #17-010893. Results of evidence examinations and reports thereof will be the subject of separate reports available through the Mississippi Forensics Laboratory. Two hundred sixty-seven (267) color digital images in NEF format were taken with a Nikon D610 digital camera during crime scene processing and transferred to a compact disc. The original compact disc in NEF format and an additional working copy in JPEG format will be maintained in the Master File. This case was initiated when 26 year old Samuel Pearman allegedly committed Domestic Aggravated Assault against 26 year old Katie Sullivan in Tate County, Mississippi. Pearman fled prior to law enforcement arriving, which led to Deputy Perry requesting assistance from the Southaven Police Department locating Pearman at 5878 Surrey Lane, Southaven, MS. Southaven Police Patrolman, Of?cer Zachery Durden, Officer Samuel E. Maze and SGT Thomas Jones responded to the area to attempt to locate Pearman at 5878 Surrey Lane. They approached a residence thought to be 5878 Surrey Lane, which was later determined to be 5881 Surrey Lane. The residence was occupied by 36 year old HIM, lsmael Rodriguez Lopez, 45 year old HIF, Claudia Gonzalez Linares and a dog. They were awakened by a knock and the barking dog. lsmael got up and went to the door. According to the officers, the porch light went out, the door opened which allowed the dog to run out and lsmael was observed pointing a Remington .22 caliber rifle towards Officer Durden. At approximately the same time, Officer Maze encountered the dog and fired one shot as the dog charged aggressively. As Officer Durden was giving verbal commands to lsmael to drop the weapon, he heard the single shot while he continued to observe lsmael with the rifle. Findings and Circumstances On Sunday, July 23, 2017 at approximately 2022 hours, Tate County Sheriff Department (TCSD) Deputy Stanley Perry (hereinafter referred to as Degugg Percy) was investigating a domestic assault at the Citgo located at 9670 Hwy 306 in Tate County Mississippi. lt was alleged that Samuel Dwayne Pearman (herei??ter referred to as Pearman) of 5878 Surrey Lane of Southaven, MS allegedly committed domestic aggravated assault upon Katie Sullivan of 5881 Sycamore Road of Coldwater, MS. Pearman fled the scene prior to the arrival of TCSD. At approximately 2350 hours, Deputy Perry contacted Southaven Police Department (SPD) for assistance with in attempting to locate Pearman at 5878 Surrey Lane, Southaven MS. The attempt to locate request was broadcast via police radio and SPD Patrol Officers Zachary Durden (aka Zack), Samuel Maze meal) and SGT Thomas Jones (aka Tom) responded to the area. This case was initiated when 26 year old Samuel Pearman allegedly committed Domestic Aggravated Assault against 26 year old Katie Sullivan in Tate County, Mississippi. Pearman fled prior to law enforcement arriving, which led to Deputy Perry requesting assistance from the Southaven Police Department locating Pearman at 5878 Surrey Lane, Southaven, MS. Southaven Police Patrolman, Officer Zachery Officer Samuel E. Maze and SGT Thomas Jones responded to the area to attempt? locate Pearman at 5878 Surrey Lane. They approached a residence t. On Monday, July 24, 2017 at approximately midnight, I Southaven Police Of?cer Samuel Maze, was on my way to the Southaven Police Department to complete several reports. Southaven Dispatch noti?ed Southaven Police Of?cer Zachary Durden and Southaven Police Of?cer Tommy Jones to respond to 878 Surrey Lane in Southaven, Mississippi, to attempt to locate an individual for Tate County Sheriff 5 Department. Southaven Dispatch stated the individual was Samuel PEARMAN, who was wanted for aggravated assault, and was believed to be at this address. Due to the felonious nature of the warrant, I informed Southaven Dispatch that I would also respond to the call on Surrey Lane. Of?cer Durden and I pulled our patrol cars into the Desoto Woods subdivision, and began discussing how we were going to approach the residence where PEARMAN was supposedly at. I requested Southaven Dispatch to send a picture of PEARMAN to my city e-mail. Southaven Dispatch sent a copy of driver?s license information to me, and I was able to determine that PEARMAN was a caucasian male with dark hair. I entered the address Southaven Dispatch had provided into my patrol laptop to try and locate the residence we were going to. From my past experience of patrolling the Desoto Woods subdivision, I knew that Surrey Lane had several street lamps that illuminated the street. I informed Of?cer Durden that Surrey Lane had several street lamps illuminating the street, and that we should approach the residence from the East to better conceal our patrol cars. Of?cer Durden and I drove our patrol cars to Westminster Lane, turned North, and then turned Westbound on Neshoba Road. Of?cer Durden and I parked our patrol cars East tersection of Neshoba Road and Surrey Lane. I informed Of?cer Durden I believed the residen3%"t6"' ,gthwest of where we were parked, based on the where the address was plotting on my aptop. Of?cer Durden and I walked towards the residence, we were attempting to walk in the and avoid the light of the street lamps. Officer Durden stated he did not believe the residence Of?cer was at was the correct address, rather that the correct address was further North of the int?f?ie? As Of?cer Durden and I made contact with Of?cer Jones, I informed Of?cer Jones I believed the residence he was parked in front of was the residence we were looking for. Of?cer Jones stated the residence PEARMAN was supposedly at was further North down Surrey Lane. I asked Southaven Dispatch to restate the address they had provided earlier. Southaven Dispatch stated the address was 5878 Surrey Lane. Once hearing the address again, I noticed the address of the house I believed PEARMAN to be at was not the correct address. Officer Durden informed me and Of?cer Jones that his global positioning system was plotting 587 8 Surrey Lane just North of the intersection of Surrey Lane and Neshoba Road, and on the Western side of Surrey Lane. Of?cer Jones retrieved his shotgun from his patrol car, and he, Of?cer Durden, and I began walking towards the location Of?cer Durden stated. Upon arriving at the believed location, Of?cer Durden and I began looking at the residences for the street numbers to determine which residence we were looking for. I was not able to see any address numbers on the houses in the area we were looking. I began looking at the mailboxes, which were on the western side of the street, and noticed that there were multiple mailboxes that did not have address numbers. I informed Of?cer Durden I could not see any addresses which matched the one provided by Southaven Dispatch. During my experience of patrolling the Desoto Woods subdivision, it is common to be sent to a residence which does not have the numerics of the address posted on the mailbox or the i Wt house. During these types of events, it is common for of?cers to knock on the door of a residence to con?rm where the correct address is. Of?cer Durden, Of?cer Jones, and I walked into the driveway of the residence we believed was the one PEARMAN was supposedly at. I asked Of?cer Durden and Of?cer Jones if they believed we were at the correct address, and both stated they believed we were at the residence. The residence was a mobile home, which had a very bright porch light, which illuminated a majority of the ?ont yard. I noticed there were several vehicles in the driveway, and the driveway was littered with vehicle parts and trash. We began approaching the residence. Of?cer Durden and I both withdrew our duty pistols from our holsters on our approach to the residence; Of?cer Jones was carrying his patrol shotgun. I informed Southaven Dispatch we had arrived on scene. Southaven Dispatch advised all of?cers to hold radio traf?c until further notice. There was a large tree in the front yard, and I saw a small cable wrapped around it, with one end laying on the ground several feet away. I informed Of?cer Durden and Of?cer Jones there was possibly a dog at the residence. There was a wooden fence on the South end of the mobile home, and this is where Of?cer Jones stood so that he would be able to see the back of the residence. Of?cer Durden stated he was going to go to the front door and knock on it. I saw that the front porch, which was on the? Northeast side of the mobile home, was elevated, and had a railing around it. Comi?gpn of?cer safety is to knock on the front door, then step away from the door incase someone answers door with a weapon. I informed Of?cer Durden to knock and then to step off the porch so he ?in the funnel?. I noticed there were several windows on the front of the mobile home. One side, where Of?cer Jones was standing; one near the roof of the mobile home, which - {lieved a bathroom Window, and a double? paned window next to the front porch, whiCh I be ?'fved a bedroom window or a living room window. From my training and experience, I deci and near the double-paned window so that I could see Of?cer Durden and Of?cer Jones a threat if one were to appear in the window. I looked at Of?cer Jones, and he ded his at me, signaling that he was ready. I looked at Of?cer Durden, who was standing on nodded at him, signaling to him I was also ready for him to knock on the door. After several seconds I began hearing someone walking from the South end of the mobile home to the North end, where Of?cer Durden was standing. I got Of?cer Durden?s attention, and signaled to him with my left hand that someone was walking in his direction. Several seconds later, the bright front porch light went out, ad I thought to myself, ?well, they aren?t going to answer the door?. I began side- stepping through the yard towards Of?cer Durden so I could see the ?ont door better. As I was walking his way, Of?cer Durden turned his ?ashlight on, illuminating the front porch and ?ont door. As he did so, I saw the barrel of a ri?e protruding from the front door, pointing in Officer Durden?s direction. At the same time, I saw a large dog running off the from porch, charging at me. I pointed my duty pistol at the dog, and began walking backwards. The dog was very aggressive, snarling, and baring his teeth, and I believed the dog was about to attack me. While I was walking backwards, the dog stopped approximately four to ?ve feet from in front of me. Of?cer Durden began giving loud, audible, verbal commands to ?put the gun downl?. Of?cer Durden gave the command to ?put the gun downl?, multiple times. While Officer Durden was giving verbal commands to ?put the gun down?, the dog continued snarling and baring his teeth at me, and slowly walking in my direction. The dog made a quick lunging motion towards me, and I thought the dog was trying to bite me. I ?red my duty weapon once at the dog to keep him from attacking 7 me. I then began looking back at the ?ont door, and could still see the barrel of the ri?e pointed in Of?cer Durden?s direction. Of?cer Durden then ?red his duty weapon multiple times. I began quickly side- stepping towards Officer Durden, pointng my duty pistol at the front door of the mobile home. I could hear a woman screaming from within the mobile home, near the front door. Of?cer Durden began informin Southaven Dispatch that shots had been ?red, the suspect was down, to notify and send emergency medical personnel, and that he had ?red his duty weapon approximately four to ?ve times. An Of?cer began asking on the radio of there were any injured officers at the scene, and Officer Durden stated no of?cers were injured. While Of?cer Durden was informing Southaven Dispatch of the events, I noticed Officer Durden was standing in a exposed position in the middle of the from yard. I began telling Of?cer Durden ?Zack, walk to me!? multiple times. Of?cer Durden began side-stepping to my location, and when he got within arms reach, I grabbed him by the back of his ballistic vest and pulled him behind the large tree in the yard. Of?cer Durden then reloaded his duty pistol with a magazine from his duty belt. Officer Jones was standing to my le?, and he stated, ?we need to get the shield?. I told Of?cer Durden to remain where he was until I got back. I holstered my duty pistol and ran back to my patrol car to retrieve the ballistic shield I carry for our shift. I retrieved the ballistic shield, and ran back to Of?cer Durden and Of?cer Jones? location behind the tree. When I arrived back with Of?cer Durden and Of?cer Jones, a woman was standing with them. I assumed she was the woman I had heard screaming inside theiijsgresidence earlier. Of?cer Durden stated to me we have to go in there and help him?. I told Of?cer Durif we were not going inside the residence, because we could not see inside the residence; we did who else was inside the residence, nor if there anyone else was inside with a weapon. Of?cer Du had ?red his duty pistol at, laying on the ?oor insid, *?fhe inside the residence, and she shook her head as if "?"say and stated I told Of?cer Jones we needed to detain the woman and take her to a safe away from the front of the mobile home. Of?cer Jones was already holding his handcuffst?iand placing them on the female. I told Of?cer Durden that if he cori?jd see the pect laying on the ?oor, that we could go ahead and clear the residence for additional threaw i?Of?cer Durden and I began approaching the front porch of the residence. Officer Durden stepped inside the residence, and took a step to the left of the door, I immediately stepped inside the residence, and took a step to the right, checking the room to our right for threats, there were none. As I walked back to where Of?cer Durden was standing in the living room, Of?cer Durden stated, ?we have to start helping the guy?. Of?cer Durden was pointing his duty pistol in the direction of the hallway. The suSpect was laying in the middle of the living room ?oor, facedown, with his feet towards the front door. I could see the suspect was wounded in his torso, and had a large wound on the back of his. head. There was blood and brain matter on the ?oor surrounding the suspect. I could hear the suspect breathing; however, it was very laborious. I told Of?cer Durden we were going to ?nish clearing the structure for additional threats before we began rendering aid to the suspect. I could see a hunting style ri?e laying on a couch next to the front door. Of?cer Durden and I began walking down the hallway of the mobile home. I saw there were two doors on our left, one on our right, which appeared to be a door leading outsidethe hallway. The hallway was very tight, and it was dif?cult for Of?cer Durden and I to tactfully clear the hallway. Of?cer Durden stated he was going to clear the ?rst room on our left. I told him to go ahead, and as he began doing so, I moved past him, covering his back. Of?cer Durden stated there was no on in the ?rst room. Of?cer Durden told me that he would clear the second room on our left, which he did. Itold Of?cer Durden that since the hallway was so tight, and the door at the end of the. hallway was closed, I was going to open the door, and for him to stand back in the room he had just cleared. I approached the last door, and quickly opened the door, stepping backwards in the process. As I opened the door, the same dog that had attempted to bite me outside quickly ran out of the room and began growling at Of?cer Durden and I. I told Of?cer Durden not to move. The dog quit growling, and began urinating on the ?oor where it stood. I believed that the dog was scared, and only wanted to get away from us; however, due to the tightness of the hallway, the size of the dog and the potential threat it could be, I decided to spray the dog with my 0C spray. The dog began blinking its eyes, drooling, and shaking its head. Itold Of?cer Durden to ?get skinny?, and we both leaned against the hallway wall. As we did, the dog ran past us back towards the hiring room of the mobile home. I informed Officer Durden I was going to ?dump into the last room, and for him to follow behind me?. Of?cer Durden and I cleared the last room. Of?cer Jones informed Southaven Dispatch there was a large dog inside the residence. I informed Southaven Dispatch we had cleared the structure. Of?cer Durden and I quickly walked back to the living room, and began giving aid to the suspect. Of?cer Durden asked me if I had any latex gloves in my pocket, and informed him that I did not. Itold Of?cer Durden to go get some gloves, and that I would begin working on the suspect. Of?cer Durden ran out of the mobile home to retrieve gloves. The suspect was laboriously breathing, and it sepia if he was snoring. Due to the potential threat the suspect still posed, I decided to place handcu Eggpect, detaining him. I saw the suspects right hand partially concealed under right leit an?i?ivas completely concealed under his body. I pulled the suspects arms from under his br an ?laced him in handcuffs. Of?cer Durden then returned to the mobile home and stated that we ne??ii the suspect over. As we began turning him over, I noticed the suspect appeared to be a ignor a dark complected caucasian male. Captain Vickers then grabbed me and helped me out of the mobile home. Captain Vickers began asking told him I was not injured. Captain Vickers lead me back to where Of?cer Durden?s and my patrol car were parked. Of?cer Durden and I remained near our patrol cars until additional officers arrived on scene, and began checking on us. Criminal Investigations Detective Seth Kern arrived on scene and began speaking with Of?cer Durden. Detective Kern took possession of Of?cer Durden?s duty pistol. Special Operations Captain Wayne Perkins arrived on scene, and began speaking with him. I informed Captain Perkins I wanted to speak with my Police Benevolence Association attorney. Captain Perkins stated he would begin working on it. Detective Bryan Rosenberg arrived on scene, and informed me that he needed my pistol. I gave my pistol to Detective Rosenberg, and he placed another pistol in my duty holster. Officer Whitney Walley then tranSported me to the Southaven Police Department. While in-route to the Southaven Police Department, Tony arese, my Police Benevolence Association attorney contacted me, and began discussing with situation with me. On Monday, July 24, 20.17 at approximately 0005 hours (12:05 l, Southaven Police Of?cer Zachary Durden, was dispatched to 5878 Surrey Lane located in the Desoto Woods subdivision on an attempt to locate call. Southaven Police Officer Sam Maze and Southaven Police Officer Tommy Jones were also enroute to this location as well. We were attempting to locate a white'male, Samuel Pearman, who was wanted for aggravated assault through Tate County. When Officer Sam Maze and I turned on to Surrey Lane from Great Oaks Drive, we turned East on Tuscany Way, then North on Westminister Lane, then West on Neshoba Road. Southaven Police Officer Maze was following me while driving West on Neshoba Road, approaching Surrey Lane. According to my Garmin in my car, 5878 Surrey Lane was located just North of Neshoba Road. We stopped and parked our vehicles on Neshoba Road in front of the trailer that was at the corner of Neshoba Road and Surrey Lane. When i exited my patrol vehicle and Southaven Police Of?cer Maze exited his patrol vehicle, he told me that the on his computer was showing;ng the residence was South of Neshoba Road and told him that my personal was showing it was Neshoba Road. We all three looked for the and walked North on Surrey Lane to see if the numbers were getting bigger or a?ermine if we were walking in the right direction. I remember while walking North, the ?rst address i saw was a smaller number than 5878 and the next address i saw was also smaller than 5878 but since the numbers were getting larger, we all three knew we were heading in the right direction. On the West side ofthe Road on Surrey Lane, there was a trailer that had a front yard that was well lit by a flood light on the front of the trailer. i don't recall what the numbers on the address were for the trailer before this one or the one before that, but knowing that the numbers were getting larger and closer to 5878, we all three were convinced that the well lit trailer on the West side of Surrey Lane was 5878 Surrey Lane. i looked on the trailer for the correct numbers but could not locate any numbers on the trailer. Even though we were all convinced that this was 5878 Surrey Lane, i figured if it was the Wrong address, whoever answered the door would tell us it was the wrong address and be able to point us in the right direction of the correct address. As we approached the trailer with the front yard that was well lit, I saw a couple of cars in the front yard and a tree. The South side of the front yard had shadows and the North side of the front yard was very Htwell lit by the flood light on the front of the trailer. The front door of the trailer, which was facing East towards the road, was located closer to the Northern part of the trailer. The door knob on the front door from the outside, was located on the left side of the door. The flood light that was illuminating the front ya rd, was North of the door but close to the door. The trailer had a few wooden steps that led up to the front door on a small wooden deck-like area. Southaven Police Officer Tommy Jones had his shotgun with him and positioned himself on the South side of the front yard close to one of the vehicles in the yard. Southaven Police Of?cer Tommy Jones had his shotgun with him due to the nature of the call and due to the fact that the male we were attempting to locate was wanted for a violent felony through Tate County. Southaven Police Of?cer Sam Maze was positioned just North of him and closer to the road in the front yard but still in the area of the yard that was not well lit. looked around the area of the trailer and saw that on the North side of the trailer, there was a fence. Southaven Police Officer Tommy Jones told me that there was a fence on the South side of the trailer as well. Looking at the trailer from the front yard, all the lights appeared to be turned off inside the trailer and could not hear any noise coming from inside the trailer. five times loud enough to wake someone i walked up to the front door of the trailer and knocked the door and positioned myself in the up if they were sleeping. i went down the wooden ste area of the yard that was well lit. Due to the naturng l?kall, i had my handgun in my hand and held it behind my right leg. I positioned myself in the are ?pf yard that was well lit on purpose so that whoever answered the door or looked out re answering the door, would be able to clearly see that it was a police of?cer who wkno I r'l?gtheir door. From where was standing, was just North of the front door in the yard. gihile was standing in the well lit area of the yard, Southaven Police Of?cer Sam Maze signaled to me that he could hear someone walking in the trailer towards the egg-where .tgtg?efront door located. I nodded my head at Of?cer Maze and continued to watch the front ?ve to seven seconds after I nodded at Officer Maze, the flood lights were turned gin/as standing directly in the light, when the lights were turned off, everything was completely dark. i waited approximately a second or two before using the light attatched to my handgun to illuminate the front door. When I shined the light from my handgun on the front door, immediately saw a male aiming a rifle directly at me. could tell the stock ofthe ri?e was in his right shoulder and his head was leaning to the right as if he was taking aim. I could clearly see the end of the barrel of the rifle pointed directly in my direction. I began to yell "police" but about making it halfway through that word, all could yell over and over again was, "Put the gun down." I yelled "Put the gun down" three to four times. I got into a ready stance lowering my body and saw what looked like him taking cover behind the door. The door wasn't even halfway opened when i had ?rst shined my light on the door and after getting into a ready stance, i saw him shift to his left, exposing less of himself in the doorway and looked like an attempt to use the front door as cover. I then heard a gunshot but I did not know where the gunshot came from. I knew that I had given the male at the doorway mulitple verbal commands to put the gun down and the male never put the gun down. I shot three to four rounds from my handgun at the male with the rifle. After shooting three to four rounds, my magazine from my handgun fell out. While keeping the light from my weapon illuminating 1: 1.: the front door and watching the front door, I was moving slowly towards Officer Sam Maze and reloading my handgun. While moving slowly towards Of?cer Sam Maze, i could see through the opening of the front door, the male laying on the floor inside the trailer. I immediately got on my radio and said that shots were fired, there was one male suspect down, requested EMS and that I had fired three to four rounds from my handgun. Dispatch came back over the radio copying my traf?c and asked if any officers were hurt. replied to dispatch and told them that all the officers on scene were ok. - was with Officer Sam Maze behind the tree that was in the front yard and he left running towards his patrol car telling me he was going to go get the shield. While he went to go get the shield, Southaven Police Of?cer Tommy Jones was still positioned behind the car with his shotgun pointed towards the front door. A female then came out of the trailer with her hands up yelling. told her to walk towards me and that she was safe. When she walked to me, I told Officer Tommy Jones that was sending the female to him. She walked to him and about that time, Officer Sam Maze had returned from his patrol vehicle. I told him we were going to go inside and clear the tgailer to make the scene safe. Officer Sam Maze told me we needed to wait for back up before leaving Tommy Jones outside by himself and going inside the trailer. then told Officer Sam Maze thatthe le inside was on the floor and had been shot and we needed to give him medical attention as as po?ggple. Of?cer Sam Maze and I began running towards the front door of the trailer and teare i"he inside of the trailer. The male was laying face down in the living room by the front of the When Officer Sam Maze and I opened the master bedroom door, a pitbull came out, eemed extremely aggresive. A bathroom door was right next to me, so I went through the. car and cracked the door to avoid getting to close to the pitbull. The pitbull stood right in fr the room door facing Officer Sam Maze in the hallway staring and growling at 23% didn't want tovshoot and kill the pitbull so he used his pepper spray in an attemp 0 get thgipitbull to go back into the master bedroom. The pitbull backed up and was able to slip on .f the room and go back down the hallway towards the living room. I knelt down by the male and was bleeding. Right as was about to attempt to turn him over, Southaven Police Officer Tom Long came in and told me that I didn't need to be in the trailer anymore and told me to leave. I left the trailer and multiple of?cers arrived on scene. Criminal Investigations Detective Seth Kern arrived on scene and took possession of my handgun. A new handgun was issued to me and another police officer took me back to the Southaven Police Department. Jones received a call to locate a Samuel Pearman at 5878 Surrey Lane. Dispatch advised that Pearman was wanted by Tate County SO for aggravated assault. They advised the subject was possibly at this location. I arrived on Surrey Lane and stopped my unit on the 5800 block of Surrey at Neshoba. Of?cers Durden and Maze had parked on Neshoba east of Surrey. Of?cers Durden and Maze pointed to a residence on the west side of the roadway on Surrey north of Neshoba. We approached a house on foot. When we approached the residence, 1 did not see any numbers on the residence. I went to the south side of the residence. There was a wooden fence and a gate that was open. I positioned myself so I could see the front and rear of the residence. Of?cer Durden went to the front door and Of?cer Maze covered Of?cer Durden. $553., The front porch outside light was the only light on at Of?cer Durden went to the ?ont door and knocked four to ?ve times. I could barking inside the residence. A short time later the front light to the residence w$ ed was enough light from the street lights for me to see a large dog run from; door of the residence. Of?cer Durden used a light so he could see the front door. Durden used his light, I could see a gun barrel sticking out the front door. The at Officer Durden. Of?cer Durden was backing up and yell: to the gun. He yelled this three to four times. I heard a gunshot and then to four rounds. Of?cer Maze told Of?cer Durden to get back. They movecggiiack to tree in the yard. I moved to a car in the driveway to cover the of?cers back. Of?cer Durden stated the subject own inside the residence. I asked if one of them had the shield in their vehicle. Of?cer Maze stated he did and went to retrieve it. We could then hear a female in the residence. Of?cer Durden told her to come out of the residence. Of?cer Durden repeated his commands about three times for her to come out of the residence. She ?nally did. When the female came out of the residence, I put handcuffs on her and detained her for of?cer safety until we could secure the scene. O?icer Maze came back with the shield. Of?cers Maze and Durden went into the residence. The female advised that the dog was in the rear bedroom of the residence. I advised of?cers over the radio of this. Of?cer Long was the next of?cer to arrive on the scene. Of?cer Long went into the residence. Of?cers Durden and Maze advised the residence was secure for EMS. Of?cer Laboe arrived on the scene and asked what did I need. I advised him to stand by with the female. I secured the a; shotgim in my unit. I then moved my patrol unit from Surrey and Neshoba to Surrey and Brookside to block the roadway. I went back up to the residence. I went to the female. A Desoto County deputy stated he had talked to her while I was gone. I walked the female to my patrol unit. Since the scene was secure, I removed the handcuffs from her. She was placed in back of the patrol unit. I asked if she would like some water. She stated she did. I had an extra unopened bottle of water in the front seat that I gave her. A short time later Detective Kern and'Of?cer Long walked up to my unit. He asked if I knew the females name or not, and whether or not I had talked to her. I advised him I did not, but a deputy had talked to her when she was outside the residence. Of?cer Long gave me the keys to unit 3109 and I moved it to were my unit was.
