Dear Mr. Xxxx:
As you are aware, our office received your above-referenced consumer complaint and forwarded it to the company
for response. We received an answer, which I have attached. The document appears, based on other complaint files
and the information you forwarded on November 12, 2018, to represent the company’s standard response.
Upon staff review of the claims contained in various complaints we’ve received, the company’s response, the
Kickstarter links referenced in the response, and the Kickstarter website in general, we have determined that we will
not be taking further action with respect to your complaint. The Kickstarter website clearly sets forth that while
committing to fund a Kickstarter project MAY engender a private contract between you (the funder) and the project
creator, there is no guarantee of completion. Additionally, while there appears to be significant speculation about
what may have happened to the money that Ninja Division Publishing raised through its Kickstarter campaign(s), we
have received nothing substantive to suggest it has been misappropriated or used in a manner inconsistent with the
promoted project. Additionally, the company indicates it continues its efforts to create and produce the project you
agreed to help fund.
Based on the foregoing, we believe it is appropriate for those funders who believe Ninja Division Publishing has
violated a contract with the funder to pursue private enforcement of the contract. If you believe the company has
engaged in criminal conduct, you need to report your allegations to the police. Our office does not have original
criminal jurisdiction.
If you learn of additional information you believe to be relevant, particularly with respect to misappropriation of
funds, you are welcome to provide it to our office for review. Should you do so, please provide supporting evidence
for any allegations of wrongdoing.
