CIVIL EMERGENCY ORDER CONTRACTING AND INCURRING OBLIGATIONS CITY OF SEATTLE WHEREAS, the existence of a civil emergency within the City of Seattle has been roclaimed in the Mayoral Proclamation of Civil Emergency Dated February 8, 2019 at I I m; and WHEREAS, the facts stated in that proclamation continue to exist and I am basing this order on the facts as stated in that proclamation; and WHEREAS, I am issuing this order in addition to and in connection with my exercise of powers speci?ed in Seattle Municipal Code 10.02.030 and pursuant to RCW Chapter 38.52. Therefore, BE IT PROCLAIMED BY THE MAYOR OF THE CITY OF SEATTLE, THE HONORABLE JENNY A. DURKAN, THAT: I, JENNY A. DURKAN, MAYOR OF THE CITY OF SEATTLE, ACTING UNDER THE AUTHORITY OF SEATTLE MUNICIPAL CODE SECTION 10.02.030 AND MY MAYORAL PROCLAMATION OF CIVIL EMERGENCY, DATED, FEBRUARY 8, 2019 AT WM, HEREBY ORDER: SECTION 1: I authorize City Department heads generally to enter into contracts and incur obligations necessary to combat this weather disaster, protect the health and safety of persons and property, and provide emergency assistance to the victims of such disaster. SECTION 2: The City Department heads shall exercise this power in light of the exigencies of the situation without regard for time-consuming procedures and formalities prescribed by ordinance (excepting mandatory constitutional requirements), including but not limited to, budget law limitations and requirements and competitive bidding and publication of notices pertaining to the performance of public work, entering into contracts, the incurring of obligations, the employment of temporary workers, the rental of equipment, the purchase of supplies and materials, the levying of taxes, and the appropriation and expenditures of public funds. SECTION 3: A copy of this Civil Emergency Order shall be delivered to the Governor of the State of Washington and to the County Executive of King County. To the extent practicable, a copy of this Civil Emergency Order shall be made available to all news media within the City and to the general public. In order to give the widest dissemination of this Civil Emergency Order to the public, as Order-Contracting and lncurring Obligations Page 1 many other available means as may be practical to use shall be used, including but not limited to posting on public facilities and public address systems. SECTION 4: This Civil Emergency Order shall immediately upon issuance, or as soon as practical, be ?led with the City Clerk for presentation to the City Council for rati?cation and con?rmation, modi?cation or rejection, and if rejected this Civil Emergency Order shall be void. If the City Council modi?es the Order, such modi?cation shall be effective only if it is agreed to by the ordered or contracting party. If the ordered or contracting party refuses to accept the modi?cation, the Order shall be deemed to be rejected by the City Council. If the City Council rejects this Civil Emergency Order, such rejection shall not affect the City?s responsibility for any actions taken prior to the rejection of this Civil Emergency Order, including the City?s responsibility for the actual costs incurred by those who were ordered by or entered into contracts with the City.
