Please find attached a draft of a new Solicitor's Opinion concerning incidental take under the Migratory
Bird Treaty Act. Given the Fish and Wildlife Service role in enforcing the MBTA, we wanted to reach out
to you for your input. I know this is a bit of a tight turn around, however, we are hoping to get this out in
the next few days; would it be possible for you to look over this draft and let us know your feedback by
COB tomorrow?
At this stage, please do not forward it. That said, if there are other people who you think may be able to
provide helpful input, please let us know.

Greg - Good insights. Gary will make sure they are integrated to the extent possible. Dep Sec’s
Office has seen several iterations and has been plugged in since Day 1.
