FOR LACK OF JURISDICTION

The Court considered the State?s Plea to the Jurisdiction and Defendant Blue Ridge
Land?ll, Motion to Dismiss for Lack of Jurisdiction. After considering the motions, response,
and the arguments of counsel, the Court concludes that the Plea to the Jurisdiction and the Motion
to Dismiss for Lack of Jurisdiction should be GRANTED.

The Court ?nds that Plaintiff, City of Pearland, lacks standing to bring the claims set forth
in its petition and this Court therefore lacks subject matter jurisdiction over those claims. This case

is hereby DISMISSED. This is a ?nal and appealable order.
