The Defendant has not been charged by information or Indictment within twenty-one (211) days from the date of the Defendant's arrest or senrice of capias upon Defendant. 3. Florida Rule of Criminal Procedure 3.133(b) provides that a defendant who is not charged by Information or Indictment within twenty-one (21) days from the date of arrest or service of capias on him shall have the right to an adversary preliminary hearing on any felony charge pending against him.
