The Board voted to provisionally deny your application. Section 4 ofthe Cosmetology Law, 63 17.3. 510, requires that all individuals be of good moral character at the time of making application. Your application disclosed that in 2011 you were convicted of driving under the influence of alcohol or a controlled substance, driving under the influence at the highest rate of alcohol, driving under the influence of :1 alcohol (minor), use of drug paraphernalia, two counts of simple assault and disorderly conduct, misdemeanors. Your convictions and conduct suggest that you may not be of sufficient good moral character. If you do not appeal this provisional determination to the Board within 30 days of the date ofthis letter, the decision will become final. If you wish to appeal, you may do so by filing a written request within 30 days ofthe date of this letter addressed to the State Board ofCosmetology, Attn: Board Counsel, P.O. Box 69523, Harrisburg, PA 171063523. Your appeal letter must state all factual and legal bases for your appeal. If you desire you may present written or testimonial evidence to the Board. At the formal hearing, you will have the burden of proving that you possess the qualifications for licensure and fitness to practice. You will be permitted to present evidence in support of your appeal. You will also be permitted to bring an atlomcy to represent you at the hearing or you may appear alone.
