The Complainant is: Anonymous The Complaint was formally filed against: Antonio Alatorre Respondent The Violations alleged are: Conflict of Interest in Public Contracts (GC 1090) The head of the commission for Gold Coast Health Plan (GCHP), Antonio Alatorre, is trying to push through a contract for America's Health Plan (AHP) with GCHP. He is the interim CEO of AHP and is an officer of Clinicas, the funding source of AHP. At a recent commission meeting, there was a discussion about AHP. The commission's general counsel told Mr. Alatorre that he needed to leave the room during the discussion, as required by the Brown Act. He refused to leave. This is all recorded. During commission meetings, Mr. Alatorre clearly makes decisions or steers the commission to make decisions that are self-serving for his company, Clinicas, and AHP. The Complainant is: Anonymous The Complaint was formally filed against: Antonio Alatorre Respondent Scott Campbell Witness The Violations alleged are: Conflict of Interest Antonio Alatorre is the Chair of the Ventura County Medi-Cal Managed Care Commission (VCMMCC) as well as the interim CEO for AmericasHealth Plan (AHP) and also the Chief Business Development Officer for Clinical Del Camino Real (CDCR), a subsidiary of AHP. CDCR is a contracted provider with GCHP. Mr. Alatorre violated FPPC rules regarding financial conflicts of interest regarding discussions about whether GCHP should enter into a Plan-to-Plan contract with AmericasHealth Plan (AHP). The violations occurred during the 09/24/2018 and 10/29/2018 VCMMCC Commission Meetings. At the 09/24/2018 VCMMCC Commission Meeting, GCHP and AHP staff jointly presented to the Commission an overview of the benefits of entering into a Planto-Plan contract for a 12-month pilot program. Mr. Alatorre's employment with CDCR and affiliation with AHP required him recused himself. Against GCHP legal counsel's advice, Mr. Alatorre refused and sat through the presentation. Additionally, Mr. Alatorre verbally engaged during the presentation, which is documented in the meeting minutes of the 10/29/2018 amended commission meeting packet materials (pages 18-20). Another violation occurred at the 10/29/2018 commission meeting. During an AHP presentation. Mr. Alatorre stated he was recusing himself from the presentation, but did not leave the room. When another Commissioner questioned whether that was appropriate, GCHP legal counsel, Scott Campbell, replied that he had advised that Mr. Alatorre to recuse himself and leave the room. Mr. Alatorre refused to leave.
