The Complainant submits this complaint to the Court and states that there is probable cause to believe
Defendant committed the following offense(s):
COUNT I
Charge: Assault - 4th Degree - Peace Officer - Demonstrable bodily harm
Minnesota Statute: 609.2231.1(c)(1), with reference to:  609.101.2, 609.2231.1(c)
Maximum Sentence: 3 YEARS AND/OR $6,000

Charge Description: That on or about 2/8/2019, in Hennepin County, Minnesota, MAXWELL TIMOTHY
JANES assaulted victim, a peace officer, while that officer was effecting a lawful arrest or executing a duty
imposed upon him by law, and inflicted demonstrable bodily harm upon the officer.

 STATEMENT OF PROBABLE CAUSE
 

Complainant has investigated the facts and circumstances of this offense and believes the following
establishes probable cause:
That on February 8, 2019, at approximately 12:39 a.m., officers were dispatched to the Main Post Office
located at 100 1st Street South in Minneapolis, Hennepin County, Minnesota, on a welfare check. In route,
officers were advised that a male was loitering outside the post office, was attempting to gain admittance,
and was inappropriately dressed for the cold temperatures (sub zero temperatures). A physical description
of the male was provided.
Upon arrival, officers observed a male, subsequently identified as MAXWELL TIMOTHY JANES, hereafter
defendant, matching this description gain unauthorized access to a loading dock when the garage door
opened. Officers stopped the male and noted he appeared to be intoxicated and substantially
underdressed for the conditions. Officers placed defendant inside their squad car to identify him and
remove him from the cold. Defendant advised officers he was about to "vomit." Officers opened the rear
squad door to allow defendant the ability to vomit if required. Defendant exited the squad and proceeded
to punch one of the officers in the face, causing the officer demonstrable bodily harm. Defendant then
actively fought with officers. Officers eventually restrained defendant and transported him to jail.
At present, defendant is in custody.

determined that probable cause exists to support, subject to bail or conditions of release where applicable, Defendant’s arrest
or other lawful steps be taken to obtain Defendant’s appearance in court, or Defendant’s detention, if already in custody,
pending further proceedings. Defendant is therefore charged with the above-stated offense(s).

36 hours after the arrest or as soon as such Judge or Judicial Officer is available to be dealt with according to law.
