Defendant-Appellant Joseph Percoco moves for a stay of his surrender date and bail
pending appeal pursuant to Fed. R. App. P. 9(b). The Government opposes the motion. On
February 22, 2019, the Court entered a temporary stay of surrender pending consideration of the
motion by this panel.
Upon due consideration, it is hereby ORDERED that the motion is DENIED. The
temporary stay of surrender entered on February 22, 2019, is VACATED. Mr. Percoco is ordered
to surrender to begin serving his term of imprisonment no later than March 14, 2019.
