Komoda run a vehicle license plate over radio. Dispatch advised that the plate returned to a felony vehicle, later advising the the vehicle was wanted in regards to a robbery and the the suspect, Jeffrey Barboa, was armed and dangerous. I heard Ofc. Komoda attempt to conduct a traffic stop on the vehicle when sufficent untis were available, however the driver failed to yield. monitored the pursuit radio traffic as the suspect led pursuing officers through Vallejo, to w/b i80, and eventually terminating on Richmond Parkway at which time I heard Lt. Nichelini advise that shots had been fired. Detective Schillinger and I responded to the scene to assist in the investigation. "1 r. Upon arrival, was advised that Richmond PD had envoked the Contra Costa County Fatal Incident Protocol. I observed the suspect vehicle, a white Honda Accord in the w/b number two lane against the curb. A body was on the ground near the drivers door. I observed multiple shell casing in the roadway east of the body which had been circled with chalk. VPD units 184 and 189 were parked in the along the south curb of the number one lane directly south of the vehicle and body. VPD unit 187 was south east of the suspect vehicle in a felonly stop position. A silver VPD Crown Victoria was parked behind and off the driver's side of unit 187. Upon hearing conversation about the positioning of the vehicles, Lt. Nichelini indicated that Units 184 and 189 had been moved to shield the body from e/b traffic on Richmond Parkway prior it being closed. r. I then responded to Richmond PD where I attended a briefing on the incident. I took custody of CD from Det. Caitham which had been created of the pursuit radio traffic. I played the audio recording at the briefing, after which I logged in to my evidence.com account and played the 4 available Axon videos from the victim officers. At the conclusion of the briefing, I turned over the CD to Richmond PD Lt. Eric Smith. 7v After returning to VPD, Cpl. Kenny, Det. Martinez, Ofc. Thompson, and were transported back to the scene to retrieve VPD involved vehicle after we had been advised that the Contra Costa County Crime Lab had finsihed processing the scene. It was discovered at this time that unit 189 had sustained damage and was not driveable. BAUTISTA #560 17-9795 On 08/02/17, at about 1705 hrs, I was working as the patrol supervisor, S3 dressed in full police uniform and driving marked Vallejo PD unit #150. During this time, I heard Ofc. Komoda run a vehicle license plate (C 7NAJ 690) over the radio and dispatch ultimately advised that it returned to a wanted armed robbery vehicle with Jeffrey Barboa listed as the suspect. After following the vehicle and waiting for a short period of time for a cover unit, the suspect vehicle took off and led of?cers on a pursut throughout the city of Vallejo. Some time during the pursuit, I gave of?cers permission to use the PIT maneuver in order to stop the vehicle. An of?cer then attempted to utilize the PIT in Vallejo but it was unsuccessful and the pursuit continued onto the freeway heading west on Interstate Highway 80. During this time, I was the last vehicle in the pursuit as we were coming into Rodeo going towards Pinole. Seeing that there were 4 units in the pursuit, I elected to drop out of the pursuit and go back to Vallejo to supervise. While back en route to Vallejo, I continued to monitor the pursuit and stood by at the Carquinez Bridge. Shortly after, I heard Lt. Nichelini advising that shots were ?red and that all of?cers were okay. I then advised dispatch that I would be making the calls and noti?ed Detective Sgt. Rodriguez of this incident. I learned that a pursuit had begun in the City of Vallejo. Of?cer Komoda had run a license plate on a vehicle that was listed as a wanted vehicle from robbery in the City of El enito. There were a 4 vehicles that had pursued the suspect vehicle into Contra Costa County. There were 6 Of?cers that were involved and 5 of those Of?cers had used deadly force. The suspect had been pronounced dead at the scene. I coordinated with Contra Costa County Of?ce and Richmond Police Department representatives who would be in charge of the investigation. I arrived at the scene and met with 0 DA Chief Paul Mulligan. The decision was made that Actor and Witness Of?cers would be transported to Vallejo Police Department where they would be sequestered pending interviews. I attended a brie?ng at the Richmond Police Department and was assigned to an interview team with 0 County DA Inspector D. Medina and Richmond Police Detective L. aston. We were assigned to interview Of?cers Komoda, D. McLaughlin, Estrada and Lt. Nichelini. The interviews were recorded both audio and video, a copy of those interviews was later booked into evidence at the Vallejo Police Department and provided to the Det. aston. At the request of the Chief Mulligan all of the documentation of the interviews of involved Of?cers was done by 0 DA Inspectors or Richmond Detectives. I heard as the pursuit was initiated in the City of Vallejo by Vallejo PD Of?cers and continued through the city, and went westbound Interstate 80, and ultimately ended in the 3400 block of Richmond Parkway, in the City of Richmond. I overheard that at the termination point of the pursuit there were shots ?red and no of?cers were injured. Detective Rose and I responded to the scene to assist in the investigation. Upon my arrival in the 3400 block of Richmond Parkway, in the westbound lanes, there were multiple police vehicles, including a white vehicle, later identi?ed as the suspect vehicle. There was a body on the ground near the driver?s door of the suspect vehicle, with a blanket draped over him. Based on my observations and conversations with fellow Investigators, I learned that protocol had been initiated by the Richmond Police Department, due to the fact that this shooting occurred in their jurisdiction. I was assigned to a team which consisted of Contra Costa DA Investigator GARCIA and Richmond PD Detective DEAN. One of our assignments was to interview the AMR staff that was on scene. We were also assigned to interview the witnesses who were detained at the scene by Richmond PD Of?cers. The three witnesses were transported to the Richmond Police Department to be interviewed. I conducted an interview with Witness? in an audio and video recorded interview room. Present in the room was Detective DEAN and Investigator GARCIA. While talking with he provided the following statement in summary: At around 4:50 pm, earlier in the afternoon, he concluded a business meeting at the Ruth?s Chris Steakhouse in Walnut Creek. When he left Walnut Creek, he was driving his Cadillac CT SV and traveled westbound Highway 4 to westbound Interstate 80. As he was getting on westbound Interstate 80, he could see in the distance police vehicles coming from the east with their flashing lights traveling westbound on 80. Based on the driving behavior of the white vehicle, he suspected it was being pursued by the police. The suspect vehicle passed him in the adjacent lane to his driver?s side. - described traf?c at this time as congested. After the suspect vehicle passed him, he knew nothing good was going to come of the situation as it began to weave throughout the entirety of the roadway in an unsafe and negligent manner. As the police vehicle?s passed him, they were traveling in the fast lane, trying to move traf?c over in a safe manner. Based on his observations of the suspect vehicle?s driving behavior, he was certain that someone was going to be injured. As the pursuit passed him and continued westbound 80 out of view, - took the Richmond Parkway exit. After taking the exit he turned westbound onto Richmond Parkway. As he approached the 3400 block of Richmond Parkway, he saw police vehicles pass him going eastbound Richmond Parkway in the opposite direction. Initially, he suspected the additional police cars were going to the freeway to join the pursuit. As he came to the red light at the intersection on the 3400 block of Richmond Parkway, he was in the 1 westbound lane in the #1 position at the stop light. To his immediately left was a vehicle in the turn pocket lane. He looked in his driver?s side mirror and saw the same suspect vehicle approach him from behind traveling at 35 to 40 miles an hour. The suspect vehicle then tried to split lanes between - vehicle and the other vehicle in the turn pocket lane. In doing so, the suspect vehicle collided with his left rear tire, causing moderate damage. Once the suspect vehicle split the lanes, pulled his vehicle along the north curb line of Richmond Parkway, just into the intersection to get out of the way. The suspect vehicle continued west on Richmond parkway through the intersection and drifted toward the north curb line and struck the curb, coming to a stop. He then saw one of the pursuing police vehicles ram the driver?s side of the suspect vehicle. He could not recall where on the driver side of the suspect vehicle the police vehicle rammed into. At this pointhis vehicle and was evaluating the damage his vehicle sustained. Note: During the interview with -, we referred to a Google satellite overview image of the area in question. As he was doing this, he saw the driver/ suspect exit the driver door of the white suspect vehicle, he presented a large knife or machete in his right hand as he was facing the of?cers. With the knife raised and cocked back, the suspect began to advance, closing the distance to the of?cers. - recalled hearing the suspect scream at the of?cers, Kill me, two to three times. The of?cers were screaming back at the suspect to get down numerous times. As the suspect continued to advance towards the of?cers, he took three to ?ve steps and was clearly not complying with the of?cer?s commands. As a result, the of?cers began to ?re their weapons at the suspect. recalled hearing 25 to 30 gunshots. He did not see the suspect fall to the ground. said the gun?re stopped the suspect from actively advancing towards the of?cers. said that if the of?cers would not have shot the suspect, he would have de?nitely killed someone. After the gun?re stopped, - recalled seeing of?cers go to their vehicles. He suspected they were retrieving ?rst aid equipment, but did not pay attention to see if ?rst aid was rendered. was unable to provide a description of the suspect. When he initially saw the suspect vehicle as it passed him on the freeway, he recalled it having damage to the left rear quarter panel. The suspect vehicle which struck his vehicle prior to the termination of the pursuit was the same vehicle he saw driving recklessly on the freeway while being pursued by the police. Benicia PD Case 17-453 011 3/14/17 BPD responded to girl. Upon arrival they learned that on the report year old and S-Jeffery were The victim located syringes in the house and confronted the suspect who became upset and assaulted the Victim. - reported that S- Jeffery was a recovering Meth addict. who had been clean for 16 years. S-Jeffery was booked into Solano County Jail. Benicia PD Case 17-455 011 3/15/17 S-Jeffery was arrested for violation of a court order. that had been granted that day keeping him away In this case S-Jeffery was the RP who had called for a civil standby. Suspect was booked into County Jail Benicia PD Case 17-757 011 4/27/17 BPD contacted about a restraining order violation. She had a valid restraining order that he was violating by contacting her and threatening to have she and her deported. BPD contacted S- Jeffery by telephone. He denied any knowledge of the order and was hostile with the Of?cer on the phone. The case was sent to Solano orurty Of?ce for review. Benicia PD Case l7-1070 On 6/ 7/ 7 the RP reported that she was the victim of a theft and S-Jeffery was the suspect. The PR was theF of the suspect. The suspect had access to the victims Chase account information to make payments. The suspect used the information to withdrawal $35,000. The suspect was able to receive two $5,000 withdrawals on two separate days and was able to also get a cashier?s check in the anrorurt of $25,000. A stop was placed on the check and the bank reimbru?sed the victim the $10,000. The suspect was ID as S-Jeffery. The case had been sent to the Solano County Of?ce for a warrant. Benicia PD Case 17-1135 011 6/ 16/ 17 RP contacts BPD to report that? S-Jeffery While collecting items that the S-Jeffery left behind the RP located a hand written note that read ?Hello. this is a Bank Robbery put 20.000 in 100, 50, 20, 10 in the bag. No Dye packs No Tracker No GPS No one will get hint? The letter is signed with hearts and a smiley face. RP in this case is the same as the RP in BPD case 17-1070 BPD put out a TRAK ?yer and contacted the FBI. The note does not match any known robberies. They learned that S-Jeffery was staying at the hotel. He approached the clerk with the sword drawn and on his shoulder while holding the scabbard for the sword in his other hand. He was asking for-. The employees did not know- and had not seen him and reported the same to S-Jeffery. The suspect was escorted off site by secm?ity. As responding lurits arrived they observed S-Jeffery ?eeing in a white Honda. A pru?suit was initiated and reached speed over 100 MPH before the pru?suit was terminated. The Of?cers determined that the only crime that had occurred was the evading. From Witness statements Of?cers learned that S-Jeffery?s was likely headed to a local Casino. S-Jeffery was arrested without incident at the Casino and was forurd to be in possession of the sword. He was booked into SLO County jail and released on 6/22/17. Benicia PD Case 17-1260 011 7/3/17 BPD was dispatched to Chase bank on the report of a subject trying pass a fraudulent check. When Of?cers arrived the subject was ID as S-Jeffery. S-Jeffery resisted Of?cers and refused to comply. The Bank was rurable to con?rm if the check was actually fraudulent because of a computer failru?e that was effecting all Chase branches. S-Jeffery was detained and released. El Cerrito PD Case 17-14809 On 7/ 22/ 1 7 El errito PD responded to All Star Douglmuts located at 3070 El errito Plaza on the report of a robbery. They learned the following. The Victim was the_ business. He was removing on cash drawer and replacing it with another and counting money. The suspect grabbed the cash drawer and ?ed the business. The clerk and- chased the suspect who ran to a white Honda. The suspect put the cash drawer in the passengers seat of the vehicle and then con?'onted the 2 victinrs. The suspect tells the victims that he had a gun and a knife and asks them if they want to ?ght. The victims back away and the suspect ?ees. The vehicle is described as a white Honda with a large dent 011 the bumper. The plate for the vehicle is given as 7NAJ 690 which is registered to S-Jeffery. A photo lineup is done later and the suspect is identi?ed. A warrant is issued and the alert is placed on the vehicle. Pleasant Hill PD Case 17-3245 On 7/ 23/ 1 7 PHPD responded to Safeway on the report of a suspect stealing a cash register. The suspect ?ed in a white car believed to be a Hyrurdai. Based on the El enito ?yer that was placed the Of?cer compared a photo of S?Jeffery to surveillance photos and believed that S-Jeffery was a close match but was not certain. The case is still open. San Rafael Case 17-5792 On 7/31/17 SRPD responded to Macy?s on the report of a theft. The Of?cers learned that the suspect had stolen a cash register. There was sruveillance video that showed that the suspect was a 30-40 years old with a muscular build and a tribal tattoo on his right bicep. Of?cers learned that the same subject had committed a similar theft/robbery in San Rafael 011 7/31/17. In that case there was a partial plate to the suspect vehicle that had been given by a witness. The plate given was They also learned that the same suspect had committed a similar crime at Penny in San Jose. Pleasanton PD Case 17-28840 On 8/2/17 between 1125-1633 hours a subject entered Macy?s and stole a cash register. The theft went un-noticed until 1633 hom?s when it was reported. The suspect was seen on video. The estimated loss was $400. Concord PD 17-12333 On 8/2/ 17 at 1530 horu?s a suspect entered the Macy?s store and stole a cash register estimated lose was $400. When a store employee con??onted the suspect he told them to ?call the fucking police?. In looking at surveillance footage the Of?cer and Loss Prevention believed that the suspect was the same person who had done similar thefts/robberies in Pleasanton, San ose. San Rafael and Dublin. The suspect was seen ?eeing in a white car believed to be a Honda. 011 8/8/ 17 I was provided with W- phone number and asked to call him by Sgt. Rodriguez. W- - had spoken to Lt. Bassett and reported that he was the- of S-Jeffery and was looking for information about what happened to his brother. W- advised that he had worked as a Police Of?cer in the City of Albuquerque. he had retired and was now working in Las Vegas in Law Enforcement. He advised that? S-Jeffery and Father is deceased and lives in Albuquerque. He provided phone number as . He advised that has had problems in the past in New Mexico with Metlr. He advised that in approx. 2005 S-Jeffery was involved in a traf?c accident where he was injru?ed. He advised that a severe brain bleed. After the accident S-Jeffery became sober. He believed that had relapsed and that he has not seen or spoken to him in 4-5 years. I answered questions that he had about the incident, and told him that someone from Contra Costa County Law Enforcement who were the leads 011 the case would be in touch with him. He advised that had not been contacted by law enforcement. I spoke with Lt. Bassett and provided phone number. he advised that he would contact her.
