SHORT TITLE. This Act may be cited as the ø‘‘llllll Act 5 of llll’’¿. 6 7 8 SEC. 2. CARBON MONOXIDE DETECTORS IN FEDERALLY ASSISTED HOUSING. (a) SUPPORTIVE HOUSING FOR THE ELDERLY.—Sec- 9 tion 202(j) of the Housing Act of 1949 (12 U.S.C. 10 1701q(j)) is amended by adding at the end the following: Discussion draft MIR19187 S.L.C. 2 1 ‘‘(9) CARBON 2 ‘‘(A) IN MONOXIDE DETECTORS.— GENERAL.—Each owner of a 3 dwelling unit assisted under this section shall 4 ensure that not less than 1 carbon monoxide 5 detector is installed per floor in the dwelling 6 unit øin accordance with standards and criteria 7 acceptable to the Secretary for the protection of 8 occupants in the dwelling unit--Modeled after 9 smoke detector reg.¿. 10 ‘‘(B) REHABILITATION.—Each owner of a 11 dwelling unit assisted under this section that is 12 located in a property that is undergoing or 13 planning a substantial rehabilitation project 14 shall ensure that, during that rehabilitation, not 15 less than 1 carbon monoxide detector is in- 16 stalled per floor in the dwelling unit øin accord- 17 ance with standards and criteria acceptable to 18 the Secretary for the protection of occupants in 19 the dwelling unit— Modeled after smoke detector 20 reg.¿.’’. 21 22 (b) SUPPORTIVE HOUSING ABILITIES.—Section FOR PERSONS WITH DIS- 811(j) of the Cranston-Gonzalez Na- 23 tional Affordable Housing Act (42 U.S.C. 8013(j)) is 24 amended by adding at the end the following: 25 ‘‘(7) CARBON MONOXIDE DETECTORS.— Discussion draft MIR19187 S.L.C. 3 ‘‘(A) IN 1 GENERAL.—Each dwelling unit as- 2 sisted under this section shall contain not less 3 than 1 carbon monoxide detector installed per 4 floor of the dwelling unit øin accordance with 5 standards and criteria acceptable to the Sec- 6 retary for the protection of occupants in the 7 dwelling unit— Modeled after smoke detector 8 reg.¿. ‘‘(B) 9 REHABILITATION.—Each dwelling 10 unit assisted under this section that is located 11 in a property that is undergoing or planning a 12 substantial rehabilitation project shall, during 13 that rehabilitation, have installed not less than 14 1 carbon monoxide detector per floor of the 15 dwelling unit øin accordance with standards 16 and criteria acceptable to the Secretary for the 17 protection of occupants in the dwelling unit— 18 Modeled after smoke detector reg.¿.’’. 19 (c) PUBLIC AND SECTION 8 HOUSING.—The United 20 States Housing Act of 1937 (42 U.S.C. 1437 et seq.) is 21 amended— 22 23 24 (1) in section 3(a) (42 U.S.C. 1437a(a)), by adding at the end the following: ‘‘(8) CARBON MONOXIDE DETECTORS.— MIR19187 Discussion draft S.L.C. 4 1 ‘‘(A) IN GENERAL.—Each public housing 2 agency shall ensure, for each dwelling unit in 3 public housing owned or operated by the public 4 housing agency, that not less than 1 carbon 5 monoxide detector is installed per floor in the 6 dwelling unit øin accordance with standards 7 and criteria acceptable to the Secretary for the 8 protection of occupants in the dwelling unit— 9 Modeled after smoke detector reg.¿. 10 ‘‘(B) REHABILITATION.—With respect to 11 public housing for which a public housing agen- 12 cy is undergoing or planning a substantial reha- 13 bilitation project, the public housing agency 14 shall ensure that, during that rehabilitation, not 15 less than 1 carbon monoxide detector is in- 16 stalled per floor in each dwelling unit located in 17 that public housing øin accordance with stand- 18 ards and criteria acceptable to the Secretary for 19 the protection of occupants in the dwelling 20 unit— Modeled after smoke detector reg.¿.’’; and 21 (2) in section 8(o) (42 U.S.C. 1437f(o)), by 22 23 24 25 adding at the end the following: ‘‘(21) CARBON ‘‘(A) IN MONOXIDE DETECTORS.— GENERAL.—Each owner of a dwelling unit receiving tenant-based assistance Discussion draft MIR19187 S.L.C. 5 1 or project-based assistance under this sub- 2 section shall ensure that not less than 1 carbon 3 monoxide detector is installed per floor in the 4 dwelling unit øin accordance with standards 5 and criteria acceptable to the Secretary for the 6 protection of occupants in the dwelling unit— 7 Modeled after smoke detector reg.¿ 8 ‘‘(B) REHABILITATION.—With respect to a 9 property receiving tenant-based assistance or 10 project-based assistance for which the owner is 11 undergoing or planning a substantial rehabilita- 12 tion project, the owner shall ensure that, during 13 that rehabilitation, not less than 1 carbon mon- 14 oxide detector is installed per floor in each 15 dwelling unit assisted in that property øin ac- 16 cordance with standards and criteria acceptable 17 to the Secretary for the protection of occupants 18 in the dwelling unit— Modeled after smoke de- 19 tector reg.¿.’’. 20 (d) ADDITIONAL FUNDING.—There are authorized to 21 be appropriated to carry out the amendments made by this 22 Act $1,000,000 for each of fiscal years 2020 through 23 2029.
