We appreciate the noti?cation and the drop off location for the birds possibly involved in fuel
spill. In accordance with the m-opinion (M67050) we are no longer involved in MBTA
incidental take issues. It has been recommended to count and identify the species but that will
be left up to the ES office to decide. Please retainidispose of the birds as the ES office sees

As noted, this morning I received a call from an -at phone number?

who indicated that he was delivering some dead waterfowl to the FWS that were collected
from a wetland that had been impacted from a fuel spill caused by a pipe breach near Buhl
Idaho. The pipe was owned by Anveavor pipeline. I noted that these carcasses were likely
to be delivered to our Law Enforcement Staff. Not knowing speci?cally who to deliver the
birds to, he mentioned that he would leave them at our office.

 

I passed on to khe limited info that I had on hand, left a message with

lonesome: Ito provide input on handling possible contaminated birds, and attempted to
contact you via phone. You returned my called just prior to 10:30 AM, at which time I
provided you with the phone information that I had been provided.

While I was in a meeting, someone (I suspect- dropped off two coolers at the front
BLM Greeters Desk that were indicated to contain bird carcasses. Unfortunately, no one
from the office actually met the person and took any information regarding the contents or
nature of the assumed bird mortality. There was a card left with the containters

I took the two coolers to our warehouse area for temporary holding, and placed them on top
of our chest freezer. Not knowing what killed the birds, I did not open the containers. Our
freezer is unavailable for use as their is some sort of construction occurring in our

workspace.

I attempted to contact both lid; l: land or more information. but neither were at
their indicated phone numbers.

followed up by phone and asked that 1 keep her informed, as this may be a


 

 

 

 

contaminant program issue. However, she noted that she spoken with
in eastern Idaho, who noted that birds had been collected that may or may have died from
gunshot wounds. I noted that- had indicated the birds being provided had been
killed due to some sort of fuel spill, so there is still uncertainty about the cause of death.

ad indicated t-that you ould be following up on the issue.

I then gave you a follow up call. You indicated that due to the new solicitors opinion
regarding incidental take, if these were moralities incidental to an oil spill, their may be no
need to hold the carcasses as there would be no need for an enforcement response. You
were going to check on this matter and follow-up as you obtained additional direction.

I briefed-egarding our conversation. indicated that she had heard that

may be delivering additional birds later on if more were recovered. She asked to
also he kept in the loop. especially if we get any related inquiries from the publichnedia.
