ORDER MODIFYING CONDITIONS OF HOUSE ARTREST The matter came on before this Court on the Motion of Defendant, Fredericka Carol Wagner, to Modify Conditions of House Arrest. The Court held a hearing on this Motion on January 10, 2019, at which Defendant presented arguments for the relief sought, and the Special Prosecuting Attorney requested that this Court defer ruling on the Motion in order to provide the State with time to investigate the reasons set forth in Defendant?s request. At the conclusion of the hearing, this Court ordered that ?the State of Ohio shall ?le a written argument with regard to Defendant?s Motion to Modify Conditions of House Arrest on or before January 31, 2019.? The Court further ordered the Defendant to furnish any additional information and argument in support of Defendant?s Motion on or before January 31, 2019. The Court notes that on January 31, 2019, Defendant ?led a Supplemental Memorandum in Support of Defendant?s Motion to Modify Conditions of House Arrest, together with Exhibits, which evidenced Defendant?s routine appearances at her workplace, Springs, and her regular attendance at church St ices and Sdn?e?l COMMON PLEAS COURT MAR 29 2019 JUSTIN P. The Court further notes that the State has ?led no written information or argument in opposition, as ordered by the Court, nor any other ?ling regarding Defendant?s Motion to Modify Conditions of House Arrest, as of the date of this Order. IT IS THEREFORE ORDERED, ADJUDGED AND DECREED that Defendant?s Motion to Modify Conditions of House Arrest is well taken and for good cause shown, the Conditions of Defendant?s bond, set by this Court on November 15, 2018, is hereby modi?ed as follows: 1. Defendant shall be permitted to travel between her home and her place of employment, Springs Home, Inc., located at 799 Mt. Edna Road Piketon, Ohio, travelling over Defendant?s property the shortest distance reasonably passable (approximately one mile), during all times and from time to time when Defendant?s services are needed or required at Springs, but only upon notice to pretrial services and in accordance with conditions imposed; and 2.
