Many of these violations are continuing and remain unresolved. 1. Requirement: Pursuant to N.J.A.C. 7:14A- 6.12(d)3i, a permittee's O&M manual shall describe an Emergency Plan which includes a Vulnerability Analysis. For a municipality or authority that is not a permittee, it is recommended that O&M procedures include the Emergency Plan with Vulnerability Analysis. 1. Description of Noncompliance: Failure of a permittee's O&M manual to include an Emergency Plan with a Vulnerability Analysis. 2. Requirement: Pursuant to N.J.A.C. 7:14A- 2.1(d), it shall be unlawful for any person to discharge any pollutant except in conformity with a valid NJPDES permit issued by the Department. Requirement: Pursuant to N.J.A.C. 7:10A- 1.12(a)2, each licensed operator shall schedule routine preventative maintenance tasks which will be undertaken to preserve the physical integrity of the system. 3. Description of Noncompliance: Failure of the licensed operator to schedule routine preventative maintenance tasks to preserve the physical integrity of the system. Reportedly the payday line cleanings are performed and logged. It appears that the rest of the collection system is handled by a reactionary maintenance program that addresses issues as they arise. 4. Requirement: Pursuant to N.J.A.C. 7:10A- 1.12(a)2i, each licensed operator shall properly operate and maintain the system. 4. Description of Noncompliance: Failure of the licensed operator to properly operate and maintain the system. Payday lines jetting reportedly performed, but problems persist at K St. & Rt. 35 impacting water quality and the adjacent bathing beach on the Shark River. 5. Requirement: Pursuant to N.J.A.C. 7:10A- 1.12(a)2i, each licensed operator shall properly operate and maintain the system. 5. Description of Noncompliance: Failure of the licensed operator to properly operate and maintain the system. Specifically, procedures have not been instituted to address and eliminate extraneous flows and I&I in the collection system. Currently there is extraneous and excessive I&I from a multitude of sources including overland river flow and flooding, ground water, tidal influences, and rain induced Inflow and Infiltration. The amount of various I&I within the system are currently unquantified flow amounts. The excessive I&I is causing unquantified, unreported, and unpermitted Sanitary Sewer Overflows into the Shark River. 6. Requirement: Pursuant to N.J.A.C. 7:10A- 1.12(a)3, each licensed operator shall be responsible for conducting inspections of the system in accordance with the schedule specified in the O&M manual. 6. Description of Noncompliance: Failure of the licensed operator to conduct inspections of the system in accordance with the schedule specified in the O&M manual. No O&M manual or procedures documenting performance, nor addressing routine daily O&M, preventative maintenance, corrective maintenance, asset management, repair and replacement, or emergency response/vulnerability analysis. Requirement: Pursuant to N.J.A.C. 7:10A- 1.12(a)3ii, the results of all mechanical equipment and appurtenance inspections essential to the proper O&M of the system shall either be recorded in ink or and maintained in bound inspection log books or be maintained in securedaccess computer databases or files or other equivalent methods of record keeping. The log shall also include a record of any breaks, breakdowns, problems, failures, emergencies, complaints and/or intervening factors within the system. 7. Description of Noncompliance: Failure to maintain a log of inspection results. Reportedly the paydays line cleanings are logged but these contemporaneous logs were not reviewed. 8. Requirement: Pursuant to N.J.A.C. 7:10A- 1.12(b)2, each Public Wastewater Collection System operator shall submit to the receiving system a monthly report summarizing all events described in 7:10A1.12(b) and the remedial action taken, by the 10th of the month following each month for which the data is collected. 8. Description of Noncompliance: Failure to submit a monthly report to the receiving system, SMRSA. None reported, None observed. 9. Requirement: Pursuant to N.J.A.C. 7:14A- 6.10(a)3, the permittee shall notify the Department of all non-compliance when required in accordance with N.J.A.C. 7:14A-6.10 by contacting the DEP Hotline at 1-877-WARN-DEP. 9. Description of Noncompliance: Failure to notify the Department of all non-compliance when required in accordance N.J.A.C. 7:14-6.10 by contacting the DEP Hotline at 1-877-WARN-DEP for each sanitary sewage overflow. 10. Requirement: Pursuant to N.J.A.C. 7:14A- 6.10(a)3, the permittee shall submit a written report as required by N.J.A.C. 7:14A-6.10 within five (5) days. 10. Description of Noncompliance: Failure to submit a written report to the Department within 5 days as required by N.J.A.C. 7:14A-6:10 for each sanitary sewage overflow. 11. Requirement: Pursuant to N.J.A.C. 7:14A-22.3(a), no person shall build, install, modify or operate any treatment works except in conformance with a valid Treatment Works Approval. At a minimum the Department requests any treatment works or engineering specs on the 6th avenue pump station, the Route 35 interceptor, and the Inlet Terrace lift station. The Department also request specification on the sidewalk stormwater lines and the parallel lateral side walk interceptor east of K St. 12. Requirement: Pursuant to N.J.A.C. 7:14A-23.10(a)3, pump stations shall be provided with two power sources, one as backup. 12. Description of Noncompliance: Failure to provide auxiliary power to the 6th Ave. & Railroad Ave. (Klein’s) Pump Station as required by the regulations. 13. Such alarms shall be telemetered to a police station or other staffed location so that competent emergency assistance can be obtained on a 24-hour basis. 13. Description of Noncompliance: Failure to provide adequate alarms to the 6th Ave. & Railroad Ave. (Klein’s) Pump as required by the regulations. 14.Requirement: Pursuant to N.J.A.C. 7:14A-23.10(b), at least two pumps, each designed to handle peak flows equivalent to 2.5 times the average daily flow shall be provided. If more than two pumps are provided, their capacities shall be such that upon failure of the largest pump, the remaining pumps can handle peak flow. 14. Reportedly there are emailed communications between the licensed operator and the supervisor of the water & sewer dept. about issues. The Department has not reviewed the emails, and neither the licensed operator or Belmar have reported incidents to the hotline. 30. Requirement: Pursuant to N.J.A.C. 7:10A- 1.12(a)2ii, each licensed operator shall schedule routine inspections and preventative maintenance tasks which will be undertaken to preserve the physical integrity of the system. 30. The licensed operator must ensure that health and safety measures related to the O&M procedures are followed by the licensee, employee and agents of the system so as to protect human health, safety, welfare and the environment within 30 days of receipt of this document. [N.J.A.C. 7:10A- 1.12(a)2] 33. The licensed operator must develop a schedule for routine inspections and preventative maintenance tasks for the entire system, not just problem areas within 30 days of receipt of this document. [N.J.A.C. 7:10A- 1.12(a)3] 34. The licensed operator must ensure that the system is operated and maintained properly within 30 days of receipt of this document. [N.J.A.C. 7:10A- 1.12(a)3] 35. The licensed operator must be familiar with and ensure compliance with all laws, rules, regulations, license conditions and orders relating to N.J.A.C. 7:10A within 30 days of receipt of this document. [N.J.A.C. 7:10A- 1.12(a)] 36. The licensed operator must retain system records, current permits, written O &M procedures, log books, computer databases or files or other equivalent records, pertinent documents and correspondence for at least 5 years and have them available to the Department or other controlling agency within 30 days of receipt of this document. [N.J.A.C. 7:10A- 1.12(a)] 37. Clean the sanitary sewer line from Klein’s Restaurant leading to the 6th Avenue Pump Station within 30 days of receipt of this document. The licensed operator must assist Belmar in investigating and resolving the surcharges occurring in the system, including 8th Ave. and other portions of the system affected by surcharging within 30 days of receipt of this document. [N.J.A.C. 7:10A- 1.12(a)2] Within 30 calendar days of receipt of this Notice of Violation, you shall submit in writing to the individual issuing this notice, an explanation of the corrective measures you have taken or will take to achieve compliance. This Notice of Violation serves as notice that the NJDEP, Water Compliance and Enforcement, has determined that violations have occurred. It does not constitute final agency action and may not be appealed or contested. The issuance of this Notice or compliance therewith does not preclude the State of New Jersey or any of its agencies from initiating formal administrative and/or judicial enforcement action (including assessment of penalties), with respect to the violations listed above or for any other violations. You may appeal or contest such formal actions. Violations of the above the New Jersey Pollutant Discharge Elimination System regulations (N.J.A.C. 7:14A-1 et seq.) are subject to penalties of up to $50,000 per day/offense. Violation of the above Licensing of Water Supply and Wastewater Treatment System Operators regulations (N.J.A.C. 7:10A-1 et seq.) are subject to penalties of up to $5,000 per day/offense, as well as revocation or suspension of operating license.
