A utility seeking to retire or remove power generation from its portfolio as part of any proceeding
before the IURC based whoily, or in part, on a governmental requirement, as defined in 8-1-1-16, must
present to the IURC as part of its Application, the State Implementation Plan, or equivalent document
from the Indiana Department of Environmental Management, or equivalent Indiana or US. Government
agency, requiring such action. A governmental requirement shall not be considered ?nal or enforceable
if formal reconsideration of the rule upon which it is based, or any compliance deadlines associated with
it, have been announced by the appropriate governmental agency.
