SUMMARY OF INFORMATION IN THIS REPORT On December 4, 2014, OSBI Special Agent SONNY STEWART opened a partial OSBI investigation at the request of the Sulphur Springs, Texas Police Department to look for a Fugitive, WILLIAMS LEE HONEA, W/M, DOB: 08/03/1981, 1504 CR 1858, Yantis, Texas 75497, who was wanted in Texas for Armed Robbery. HONEA was supposedly staying with friends in Grant, Oklahoma, across State Highway 271, from the Choctaw Nation Casino. STEWART enlisted the help of Hugo, Oklahoma Police Detectives BILLY JENKINS and STEVE BABCOCK and Choctaw County Sheriff TERRY PARK and Under Sheriff LARRY HENDRIX. At approximately 1445 hours, HONEA was spotted by STEWART running out of the Casino. HONEA, seeing STEWART, ran on foot across the highway toward the District 2 County Barn and stole a truck. The truck had a .223 rifle in it sitting between the front seats. A pursuit ensued and during the pursuit, HONEA presented the rifle out of his window and pointed it toward the officers who were behind him. During the pursuit, Detective JENKINS, who was set up at a location in the median of Highway 271, fired two shots at HONEA as he drove by his location. Also during the pursuit, Detective BABCOCK fired two shots at the rear tires of the truck HONEA was driving striking the left rear quarter panel and rear bumper. The pursuit ended when an OHP Trooper performed a TVI on HONEA'S vehicle. HONEA'S vehicle came to rest in the parking lot of the Choctaw Nation Casino with Detective BABCOCK directly behind him and Sheriff PARK and Under Sheriff HENDRIX directly to their right. HONEA exited the vehicle with the rifle in his hands and BABCOCK fired at him with an AR-10 .308 Caliber Rifle while leaning out the driver's side window. At the same time, HENDRIX and PARK exited their vehicle and both fired their side arms at HONEA. Supp. Sheriff DDR 5 - 0078 HONEA was struck several time. Upon arrival of the Paramedics, HONEA was transported to the Choctaw County Hospital where he was pronounced dead. RBWILLIAMS 02/19/2015 15:19 9 ACISS software licensed by Oklahoma State Bureau of Investigation Page 2 of 7 OKLAHOMA STATE BUREAU OF INVESTIGATION TITLE OF REPORT: AGENT SONNY STEWART'S INVESTIGATIVE ACTIVITY On Thursday, December 4, 2014, at approximately 0745 hours, Sergeant DAVID GILMORE of the Sulphur Springs Texas Police Department contacted Special Agent SONNY STEWART. GILMORE informed STEWART that the Sulphur Springs Police Department was working an Armed Robbery that had occurred in their City on November 17, 2014. Investigators had identified and obtained a Felony Warrant for WILLIAM LEE HONAE, who also had Outstanding Warrants, in other Counties in the State of Texas. On December 4, 2014, Investigators had received information that HONAE was staying in the Hugo, Oklahoma area. GILMORE requested assistance from STEWART in attempting to locate and arrest HONAE if possible. STEWART checked the Oklahoma District Court Records and with Officers of the Hugo Police to determine if they had contact with HONEA. STEWART could not locate any information concerning HONAE having contact with Law Enforcement in Oklahoma. STEWART relayed the information to GILMORE. At 1136 hours, GILMORE contacted STEWART again and advised that Sulphur Springs investigators had received information from an Informant who had been communicating with HONAE since the robbery. HONAE had been calling from 580/743-1471 HONAE told the Informant that he was staying with his friend “Stretch” who lived across the street from the Choctaw Nation Casino near Hugo, Oklahoma. GILMORE provided a Cell Phone Number that was provided by the Informant as the number HONAE had been using. STEWART made contact with Hugo Chief of Police JOHN PAUL BOZEMAN and inquired if he knew anyone in the area that went by the Street Name “Stretch”. BOZEMAN advised that JASON DAVIDSON was known as Stretch. BOZEMAN further advised that DAVIDSON was the son of AUDIE DAVIDSON. STEWART was aware that AUDIE DAVIDSON lived east of the Choctaw Casino in Grant, Oklahoma. STEWART was also aware that the Hugo Police Department had an Informant who may know if HONAE had been staying with the DAVIDSON’S. It is the property of the OSBI and is loaned to your agency; it and its content are not to be distributed outside your agency. 10 Supp. Sheriff DDR 5 - 0091 AGENT SONNY STEWART'S INVESTIGATIVE ACTIVITY OSBI2014-1297/8 STEWART made contact with Hugo Detectives BILLY JENKINS and STEVE BABCOCK and requested that they attempt to verify through their Informant if HONAE had been seen at the DAVIDSON residence. STEWART contacted Choctaw County Under Sheriff LARRY HENDRIX and briefed him on the situation. HENDRIX was able to verify that the Cell Phone Number, that HONAE had recently used, belonged to DAVIDSON. STEWART contacted GILMORE to inform him that the information he had provided had been corroborated, and if JENKINS and BABCOCK were able to confirm that HONAE was at DAVIDSON'S residence that an Arrest Team would attempt to serve the Outstanding Warrant. GILMORE informed STEWART that HONAE had a history of violent contacts with Law Enforcement; he was armed when he robbed the store in Sulphur Springs and the Informant had reported that HONAE made statements that he would not go down without a fight and he was prepared to die. STEWART contacted JENKINS who had made contact with his informant in Powderly, Texas. The Informant advised that she recognized HONAE as a person she knew as “BOB” and she had last seen him at DAVIDSON’S residence within the last thirty minutes. The Informant also advised that DAVIDSON and HONAE may have gone to the Choctaw Casino, in Grant Oklahoma. JENKINS and BABCOCK were in the area of the Choctaw Casino; STEWART requested that they drive through the parking lot of the Casino to determine if HONAE was at the Casino or at the DAVIDSON home. In the mean time, STEWART and Deputies of the Choctaw County Sheriff’s Office would meet them in the parking lot of the Choctaw Casino. At approximately 1404 hours, STEWART contacted LARRY HENDRIXS and informed him that it was believed HONAE was either at the DAVIDSON residence or the Casino. HENDRIXS advised that he and Sheriff TERRY PARK would meet STEWART at the Hugo Police Department. At approximately 1406 hours, STEVE BABCOCK called STEWART and advised that while driving through the back parking lot of the Choctaw Casino, they observed DAVIDSONS pickup. Standing next to the truck was a white male wearing an orange shirt and nit hat. BABCOCK and JENKINS stopped to make contact with the individual who was later identified as HONAE. As the Officers exited their vehicle, HONAE ran into the rear entrance of the Choctaw Casino. BABCOCK advised that he had no authority on Tribal 11 Supp. Sheriff DDR 5 - 0092 AGENT SONNY STEWART'S INVESTIGATIVE ACTIVITY OSBI2014-1297/8 Property and asked STEWART what he should do. remain at the vehicle. STEWART requested that BABCOCK STEWART contacted HENDRIX and updated him with the new information. HENDRIX advised that he was on the other line with Choctaw Tribal Police and agreed to meet STEWART at the Casino. Upon arriving at the Casino, STEWART checked with BABCOCK who was still stationary on the back side of the Casino. STEWART noticed a white male wearing a long sleeved grey shirt running in an easterly direction from the front doors of the Casino. As the subject continued running out of the parking lot STEWART attempted to intercept him. The subject crossed an access road and both lanes of Hwy 271. The subject turned around and noticed STEWART chasing him. STEWART was able to determine at that point that the subject was HONAE. STEWART caught up to HONAE at a right-of- way fence on the east side of Hwy 271. HONAE was attempting to jump over the fence. As STEWART exited his vehicle, HONAE was able to make it over the fence. STEWART identified himself as a Police Officer and ordered HONAE to the ground at gun point, HONAE continued running east bound toward a County Barn that was east of the fence line. STEWART radioed the HONAE’S location and direction of travel and then headed south on the northbound shoulder of Hwy 271 to the next County Road (E2125 Road). STEWART turned east and then north onto County Road N4220 Road. As STEWART approached a County Barn entrance, an employee waived STEWART down and advised that, “He is in the Dodge pickup.” STEWART observed a silver colored Dodge pickup turning east bound on E 2120 Road from N4220. STEWART radioed the vehicle description and direction of travel. BABCOCK was able to intercept the vehicle, operated by HONAE, followed by STEWART traveling eastbound on E 2120 Road. The vehicle operated by HONAE was traveling at a high rate of speed. The HONAE turned around in an open field almost striking STEWART’S unit as he re-entered the roadway west bound. HONAE went through a set of sharp turns and lost control of the vehicle which went through a barbed wire fence, the vehicle then re-entered the roadway continuing westbound to the Intersection of E2120 and N4220 Roads. During this time, LARRY HENDRICKS caught up to the pursuit and took up the primary position with BABCOCK as secondary. The subject vehicle was traveling over 100 MPH north on N4220 Road. STEWART’S vehicle was unable to keep up with the pursuit. 12 Supp. Sheriff DDR 5 - 0093 AGENT SONNY STEWART'S INVESTIGATIVE ACTIVITY OSBI2014-1297/8 STEWART heard TERRY PARK instructing BABCOCK to take the primary position because their vehicle could not keep up with the subject vehicle; BABCOCK took over the primary position. During this time, STEWART fell behind in the pursuit. The pursuit continued north on N 4220 Road to Country Club Road, where HONAE turned west bound, forcing a Hugo Patrol Unit, driven by JOHN PAUL BOZEMAN, off the roadway. HONAE continued west bound to Hwy 271, where HONAE turned south in the north bound lanes of traffic. HONAE forced several north bound vehicles off the roadway. HONAE entered the median and then the south bound lane of traffic colliding with the rear end of an eighteen wheeler. The collision flattened the front passenger side tire, HONAE continued south bound. BABCOCK radioed shots had been fired and the pursuit continued south bound. STEWART caught up to the pursuit as it approached the Choctaw Casino. A Highway Patrol Unit conducted a pit maneuver, on the HONAE’S vehicle, which caused the vehicle to leave the roadway in a westerly direction toward the parking lot of the Choctaw Casino. The vehicle, operated by HONAE, continued in a westerly direction, crossing a grassy median an access road and a grassy area that divided the access road from the east curb line of the Choctaw Casino parking lot. The vehicle, operated by HONAE, became stuck in the wet soil. STEVE BABCOCK pulled up behind the vehicle, Choctaw County Sheriff’s Office, occupied by LARRY HENDRICK and TERRY PARKS, pulled up facing generally the passenger side of the vehicle, and an OHP Trooper pulled up facing the direction of the driver side of the vehicle. STEWART came to a stop approximately 40 yards west of BABCOCK’s vehicle. STEWART observed motion inside the cab of the vehicle and shots being fired from BABCOCK, HENDRICKS and PARK. All of which occurred before STEWART could exit his vehicle. As STEWART approached the scene, BILLY JENKINS opened the driver door of the truck. As HONAE was pulled from the vehicle, a scoped rifle fell out of the vehicle onto the ground. HONAE was handcuffed behind his back by JENKINS and BABCOCK. The Choctaw County Ambulance Service was immediately notified and responded to the scene. FIRED CARTRIDGE CASES FROM ROADWAY ======================================================================= Description of Scene: The scene was located approximately 1,500 feet south of the East 2120 Road and U.S. Highway 271 intersection in Grant, Oklahoma. A paved, service road which traveled north and south and paralleled U.S. Highway 271, was located approximately 115 feet to the west of U.S. Highway 271. A gray, extended cab, Dodge Ram 2500 pickup truck was located facing southwest in a grassy field between the service road and the Choctaw Nation Casino 27 Supp. Sheriff DDR 5 - 0108 OFFICER INVOLVED SHOOTING OSBI2014-1297/15 parking lot. Several police vehicles with flashing emergency lights were located surrounding the rear of the Dodge truck. Several tire impressions or ruts were located in the mud and traveled from the vehicles’ resting points, back to U.S. Highway 271. The gray Dodge truck displayed Oklahoma farm tag #289NYF. The truck had sustained heavy damage to the front of the vehicle and to the passenger side of the vehicle. The front, headlight and corner lens had been broken from the housing and was hanging off of the truck. The plastic molding located along the bottom of the front bumper had been damaged and was hanging off of the front passenger side of the bumper. Grass and mud was stuck to the front bumper. The front, passenger side tire was gone and the rim was heavily damaged. Significant damage was located on the front, passenger side quarter panel. Numerous, penetrating, horizontal, gouges were located in the front, passenger side quarter panel and continued in to the hood and front, passenger side door. The passenger side mirror had been completely broken off of the truck. Additional damage ran along the passenger side of the truck, with heavy damage to the rear, passenger side of the truck. Long, penetrating, horizontal gouges were located along the passenger side bed to the passenger side tail light assembly. The passenger side tail light was completely broken and the rear bumper was damaged. The center cap of the rear, passenger side rim was also damaged and the metal was bent. The truck did not have a tailgate. The exterior of the truck had numerous, round, penetrating defects that were consistent with bullet holes. Numerous defects were located in the passenger side door area. The front, passenger side window was missing and the rear, passenger side window was shattered, but partially intact. Additional round, penetrating defects were located in the rear of the truck, the back window, and the driver side door area. The front, driver side window was partially rolled down and shattered. It was held together by window tint. The rear, driver side window was also shattered but partially intact. Several, round defects were located in the front windshield of the truck. Several defects were also observed in the interior of the truck. A bloodlike substance was located inside the truck on and around the front driver side seat. Large, red, bloodlike stains were located on the grass just south of the truck, near the front of the driver side bed of the truck. Also located on the grass to the south of the truck on the driver side, were a metal, smoking pipe containing a burnt residue (item 13), several 28 Supp. Sheriff DDR 5 - 0109 OFFICER INVOLVED SHOOTING OSBI2014-1297/15 broken pieces of glass, a silver watch (item 12), a brown leather wallet containing assorted cards (item 11), a red and white plastic plunger, a Gatorade bottle, a bottle of hand soap, and a .223 caliber rifle (item 6). The firearm was a single-shot, break-action, New England brand, rifle, s/n 403159, with a brown wood stock and a black frame. A black, Simmons brand scope was mounted to the rifle. There was no cartridge in the chamber of the rifle. Small wheel impressions were located in the grass and mud that traveled from the driver side of the Dodge truck to the Choctaw Casino parking lot. The impressions were consistent with wheels from a medical cot or gurney. Behind the Dodge truck, parked near the rear passenger side, was a white, extended cab, 4x4, Ford F150 police truck. The truck had “Choctaw County Sheriff” displayed on the driver and passenger sides, along with other police markings. The truck had a light bar on the top of the truck that was flashing red and blue. The passenger side door to the truck was open. Thirteen fired cartridge cases (item 7) were scattered across the ground between the passenger side of the Ford police truck and the passenger side of the Dodge truck. All thirteen cartridge cases had a “HORNADY 9mm LUGER+P” headstamp and a firing pin indent in the primer. Located on the ground next to the driver side door of the Ford police truck were two fired cartridge cases and a 9mm cartridge. The fired cartridge cases and the cartridge all had a “HORNADY 9mm LUGER+P” headstamp. Located on the ground behind the Ford police truck, were a black glove and box of .223 caliber ammunition (item 9). The ammunition was a full 20 count box of cartridges labeled “Hornaday Superformance Match, 223 REM, 75 gr BTHP”. Behind the Dodge truck, parked near the driver side, was a gray or pewter police Chevrolet Tahoe. The Tahoe was an unmarked police unit, but it was equipped with red and blue flashing lights in the front, back, and sides. The lights were on. A fired cartridge case (item 7) was located on the ground next to the driver side of the Tahoe. The cartridge case had a “HORNADY 308 WIN MATCH” headstamp and a firing pin indent. A black, DPMS brand, .308 caliber assault rifle (item 5) was located leaning against the front, driver side seat, with the muzzle in the front, driver side floorboard. The rifle was magazine and chamber loaded with .308 caliber cartridges. The cartridges had a “HORNADY 308 WIN MATCH” headstamp. There were nineteen cartridges loaded in the magazine. The safety was engaged. 29 Supp. Sheriff DDR 5 - 0110 OFFICER INVOLVED SHOOTING OSBI2014-1297/15 Four fired cartridge cases (item 7) were located inside the Tahoe. A fired cartridge case was located in the front, passenger side seat of the Tahoe. Another fired cartridge case was located in the rear, passenger side floorboard. Lastly, two fired cartridge cases were located in the trunk compartment of the Tahoe. One was located between the back seat and the passenger side wall and the other one was located in the rear of the trunk on the driver side. All four fired cartridge cases had a “HORNADY 308 WIN MATCH” headstamp and a firing pin indent. Behind the Ford police truck, parked near its passenger side, was a white police Chevrolet Tahoe. The Tahoe was a marked Choctaw Nation Tribal Police unit and displayed several police markings. The Tahoe was equipped with red and blue flashing lights on the front, back, and sides. The lights were on. Behind the gray or pewter police Tahoe, parked near its driver side, was a black Oklahoma Highway Patrol Dodge Charger. The Charger was marked with Oklahoma Highway Patrol emblems and decals. It was equipped with red and blue flashing lights, however, the lights were off. The Charger was also equipped with a black push bumper. The bumper was slightly bent on the driver side and a fog light on the bumper was broken out. Located in the Choctaw Nation Casino parking lot, to the west of the vehicles were five metallic fragments and one bullet jacket (item 10). Narrative / Additional Information: On December 4, 2014 at approximately 1446 hours, OSBI Special Agent MICHAEL SHUFELDT received a call from OSBI Assistant Special Agent in Charge JENNY VIRDEN. VIRDEN reported that OSBI investigative assistance had been requested regarding an officer involved shooting near the Choctaw Nation Casino in Grant, Oklahoma. VIRDEN advised that OSBI Special Agent ROBERT WILLIAMS was the case agent. At 1448 hours, SHUFELDT received a telephone call from WILLIAMS. WILLIAMS reported that a subject, later identified as WILLIAM LEE HONEA had been shot by police and transported to the Choctaw Memorial Hospital in Hugo, Oklahoma. WILLIAMS requested that SHUFELDT respond to the hospital and collect photographs of HONEA and his injuries. SHUFELDT arrived at the Choctaw Memorial Hospital at 1505 hours. Upon arrival, SHUFELDT was informed that HONEA had been declared deceased. SHUFELDT photographed HONEA’s body and his injuries (for complete details, refer to 30 Supp. Sheriff DDR 5 - 0111 OFFICER INVOLVED SHOOTING OSBI2014-1297/15 OSBI2014-1297/16). SHUFELDT left the hospital after HONEA’s body had been released to the funeral home. SHUFELDT responded to the shooting scene and arrived at approximately 1715 hours. Several law enforcement agencies, including the OSBI, OHP, the Choctaw County Sheriff’s Office, the Hugo Police Department, and the Choctaw Nation Tribal Police were on scene at the time of SHUFELDT’s arrival. Representing the OSBI were Special Agent BRAD KNIGHT, Special Agent CHAD DANSBY, Special Agent SONNY STEWART, and WILLIAMS. Special Agent STEVEN CARTER also responded and arrived at a later time. The primary scene had been cordoned off with yellow police tape and a secondary scene had been established with yellow police tape and law enforcement vehicles. DAVID AUTRY of the Hugo Police Department initiated and maintained a crime scene log. KNIGHT had collected overall photographs of the scene prior to SHUFELDT’s arrival. SHUFELDT and KNIGHT entered the scene and located fired cartridge cases. The fired cartridge cases were marked with evidence markers and photographed by KNIGHT. Several bullet fragments had been located in the parking lot of the Casino and marked by the Choctaw Nation Tribal Security prior to SHUFELDT’s arrival. The fragments were also marked and photographed by KNIGHT. SHUFELDT and KNIGHT used a Nikon Total Station to document the scene and items of evidence. During the scene processing, DANSBY transferred a brown paper sack containing an orange pull-over shirt (item 14) to SHUFELDT. The shirt had been located on a couch in the Choctaw Event Center and reportedly worn by HONEA prior to the shooting. SHUFELDT secured the item in his vehicle. SHUFELDT was informed that Hugo Police Officer BILLY JENKINS had fired his weapon in the roadway during the pursuit. SHUFELDT transported JENKINS to the location and he identified the exact spot where he fired his weapon. The location was in the southbound lane of U.S. Highway 271 at the State Highway 109 intersection. JENKINS reported to SHUFELDT that he had fired two rounds from his pistol, which was loaded with .357 Sig ammunition. SHUFELDT located and photographed the two fired cartridge cases (item 15). One cartridge case was centrally located in the turning lane next to the center median. The other was located almost directly east of the first cartridge case, on the shoulder of the roadway. SHUFELDT collected both items and returned to the scene. SHUFELDT collected items 7 - 15 and KNIGHT collected items 5 and 6. At 2225 hours, JAY MAGAR with Jay’s Affordable Wrecker Service arrived on scene. MAGAR did not have a rollback wrecker, so he requested assistance from RICKY and STEVE BOLING of 31 Supp. Sheriff DDR 5 - 0112 OFFICER INVOLVED SHOOTING OSBI2014-1297/15 R&S Wrecker Service. RICKY and STEVE arrived and the truck was released to them. Choctaw County Sheriff TERRY PARK escorted the truck to the Choctaw County Drug Task Force barn, where it was secured. The vehicle was processed by SHUFELDT and KNIGHT on December 5, 2014 (for complete details, refer to OSBI2014-1297/17). On December 5, 2014, SHUFELDT secured items 7 - 15 in the OSBI Southeast Regional Office (SERO) evidence vault. Also on December 5, 2014, KNIGHT received items 1 - 4 from STEWART. KNIGHT retained items 1 – 6 until December 8, 2014, at which time he transported them to the OSBI Forensic Science Center (FSC) in Edmond, Oklahoma for analysis. On the same day, KNIGHT received items 1 - 5 back from the FSC and item 6 was retained for analysis. Items 1 – 5 were returned to the corresponding agencies on December 9, 2014. SHUFELDT was responding to an officer involved shooting in Grant, Oklahoma. WILLIAMS informed SHUFELDT that the victim of the shooting (later identified as WILLIAM HONEA) had been transported to the Choctaw Memorial Hospital in Hugo, Oklahoma. WILLIAMS requested that SHUFELDT respond to the hospital and collect photographs of HONEA'S injuries. SHUFELDT arrived at the hospital at approximately 1505 hours. SHUFELDT was informed by medical personnel that HONEA had been declared deceased and his body was in the trauma room. Hugo Police Officer CODY HENRY had been assigned to secure HONEA'S body and was present in the trauma room upon SHUFELDT'S arrival. Hugo Police Assistant Chief JOHN MITCHELL also responded and arrived after SHUFELDT. SHUFELDT made contact with Office of the Chief Medical Examiner (OCME) Investigator BLAKE MCGEE by telephone. MCGEE reported that he would be responding to the hospital to observe HONEA'S injuries. MCGEE informed SHUFELDT to collect overall photographs of HONEA, but not to manipulate his body until he arrived. SHUFELDT collected overall photographs. MCGEE later called SHUFELDT back and advised that he would no longer be responding to the hospital. MCGEE reported that he was going to respond to the scene of the shooting. MCGEE told SHUFELDT he could manipulate HONEA'S body for photographs. MCGEE also informed SHUFELDT to release HONEA to the funeral home. SHUFELDT observed that HONEA was wearing a gray sweater, blue jeans with a brown leather belt, white K-Swiss tennis shoes, and a silver cross necklace. The left leg of HONEA'S blue jeans had been cut by medical staff and a bag of IV fluids was attached to his left leg, just below his knee. In HONEA'S left back pants pocket, SHUFELDT located a deck of Choctaw Casino playing cards. In his left front pants pocket, SHUFELDT located $0.10 (one nickel and five pennies). A black folding knife, a black Bic brand "CASH" cigarette lighter, and a black Samsung brand cell phone was located in HONEA'S front right pants pocket. SHUFELDT collected the items located in HONEA'S pockets as evidence. SHUFELDT collected photographs of HONEA'S injuries with and without a scale. SHUFELDT observed a tear type injury to the back of HONEA'S right ear and two holes in the back of HONEA'S head. A large knot was observed on the front of HONEA'S head in his hairline, just above his right eye. SHUFELDT observed two holes in HONEA'S back. One hole was located near the center of his back and the other was located on the right side of his back, almost centered between his shoulder and waistline. SHUFELDT observed a piece of red plastic-like material stuck to HONEA'S skin near the hole in his back on the right side. Several splotched or burn type, circular injuries were observed on HONEA'S back. SHUFELDT also observed a large tear injury on the inside of HONEA'S right forearm, near the bend in his arm. A tear injury was also located on the top of HONEA'S left hand, just above his pinky knuckle. SHUFELDT observed three holes on HONEA'S back, right above his right shoulder. The three holes were very close together in proximity. Several splotched or burn type, circular injuries were observed near these three holes. At approximately 1728 hours, SAM BOYKIN and SHANE MILLER of Miller and Miller Funeral Home arrived at the hospital. BOYKIN and MILLER assisted with the manipulation of HONEA'S body for photographs. At 1650 hours, HONEA'S body was placed in a body bag and sealed. SHUFELDT signed the seal with the date and time. HONEA'S body was released to BOYKIN and MILLER at that time. END NOTE: On December 5, 2014, SHUFELDT secured the items collected from HONEA'S pockets in the OSBI Southeast Regional Office (SERO) evidence vault in Antlers, Oklahoma. SHUFELDT placed the photographs of HONEA'S body on two DVDs. FIRED BULLET FROM YETI COOLER ================================================================== Description Of Scene: The scene consisted of the gray 2002 Dodge Ram 2500 extended cab pickup that was towed on December 5, 2014 from the grassy area between the access road and parking lot in front of the Choctaw Casino, 1516 US Highway 271, Grant, Oklahoma, 74738. There were numerous bullet defects in the pickup. The vehicle was missing the right front tire and the right front aluminum wheel was flattened on the bottom. There was a heavy reddish-brown dirt residue on the sides of the pickup and on the wheels of the pickup. There was damage to the left front headlight and signal light and to the lower part and right hand side of the bumper. The right side of the vehicle was damaged from the front to the rear. The right front fender was damaged and pushed toward the rear, along with the radio antenna. The right side of the hood was crumpled. The right end of the front bumper was pushed in and towards the rear. The damage to the right front fender extended rearward to the passenger door. The front edge of the passenger door was crumpled and the door was pushed slightly rearward. The right side mirror was broken off with the base still attached to the door. The damage on the right side of the pickup extended to the right side of the bed above the fender where scratches and a long cut or gouge were located. The marks on the fender continued to the right rear corner of the vehicle where the taillight assembly had been damaged. The lenses and a portion of the housing were missing. The interior of the pickup contained broken glass, a bloodlike substance, farm related items and miscellaneous items. There was a piece of a plastic trim or vent and broken glass located in the driver’s seat. A metal spur with a leather strap was located above the door sill at the left side of the driver’s seat. The passenger side airbag was deployed and there were bloodlike stains on the airbag. Additional bloodlike stains were located on the front right portion of the driver’s seat back and on the top of the driver’s seat back. There were bloodlike stains on the steering wheel, on the upper dash, and on the inside of the windshield. There were bloodlike drops and bloodlike spatter on the dash panel below the steering wheel in front of the driver’s seat. There was additional bloodlike drops on the front of the driver’s floorboard below the lower dash panel. There were heavy bloodlike stains and pooled bloodlike substance on top of the center console which was in a down position between the driver’s seat and front passenger seat. The bloodlike substance had flowed from the top of the console and down the right side, rear, and front of the console. The bloodlike substance had pooled on the center seat area and then flowed between the center seat and the front passenger seat. The flow of bloodlike substance down the rear of the console accumulated on a pair of Carhartt faded tan canvas overalls and a gray-green colored Carhartt hooded jacket located in the center of the rear floorboard. The trim on the top of the dash of the pickup was damaged in numerous places with large pieces missing from the dashboard. The passenger side airbag was deployed. There were bloodlike stains on the front and left sides of the airbag. The driver’s floorboard contained a rubber floor mat with dirt and livestock feed with miscellaneous small trash items. A headlamp with elastic band was located at the right edge of the driver’s floorboard. There were bloodlike drops on the forward edge of the floor mat. A fired bullet was located on top of the driver door hinge brace [1] after the driver's door was opened. A metallic fragment consistent with a piece of a fired bullet was located in the back of the upper portion of the driver seat [3]. 47 Supp. Sheriff DDR 5 - 0128 PROCESSING OF DODGE 2500 PICKUP 289NYF OSBI2014-1297/17 The vehicle had a manual transmission with the shift lever on the center hump between the driver and front passenger floorboards. There were two foam drink holders on the shift lever. A molded console with round receptacles for beverages was at the base of the shift lever. A rubber boot connected the molded console and the base of the shift lever. There were bloodlike stains on the console and on the rubber boot of the shift lever. The passenger side floorboard contained a red 5-gallon bucket with livestock feed. The bucket was turned on its side with a large amount of feed in the front passenger floorboard of the pickup. There was a blue and silver mug, a leather glove, a 12-CC plastic syringe, an opaque plastic measuring cup, and a box of Hornady 223 Remington 55 grain V-MAX ammunition [5]. The box of ammunition was closed and contained 17 cartridges. There were three empty positions in the cartridge holder inside the box. The rear passenger compartment contained a blue Yeti Cooler on the right rear passenger seat. The cooler was upside down with the drain valve toward the passenger side of the vehicle. The rear floorboard contained a reversible camouflage/orange hooded jacket, a pair of Carhartt bib overalls (previously described), a Carhartt hooded jacket (previously described), a softball, a “CAT” baseball cap, and a spotlight. There was a bloodlike substance that flowed from the center portion of the rear floorboard to the passenger side and forward along the door sill of the passenger side doors. The bed of the Dodge pickup contained a silver-colored toolbox at the front of the bed. A rubber mat was in the floor of the pickup bed. There was a brown plastic cooler, bundles of blue/white poly hay twine, a piece of plastic faring, a package of blue exam gloves and a brown paper sac in the forward portion of the pickup bed near the toolbox. There were numerous bullet defects located in the windows and body of the pickup. They were located on the left side, rear, and right side of the pickup. There were no bullet entrance defects observed in the forward facing portions of the vehicle. All observed bullet defects entered the vehicle from the sides and rear. The trajectories were all observed to be in a forward direction from the left and right sides or from the front to the rear. Bullet Defect #1 A (BD#1A) was located on driver side of the pickup bed 8 ¾” back from the left front corner of the bed between the left rear fender well and the cab. BD#1A was 42 ¼” high, about the same height as the top of the fuel tank access. The projectile penetrated the outer wall of the pickup bed, the front of the pickup bed (BD#1B), and the rear wall of the pickup cab (BD#1C) near the left rear corner. The trajectory was downward at 4 degrees above the horizontal plane and 67 degrees to the right of the vertical plane. There were no corresponding defects observed on the interior of the cab. 48 Supp. Sheriff DDR 5 - 0129 PROCESSING OF DODGE 2500 PICKUP 289NYF OSBI2014-1297/17 Bullet Defect #2 A (BD#2A) was located on the top of the driver side of the pickup bed 15 5/8” to the rear of left front corner. The projectile penetrated the outer wall of the pickup bed (BD#2A), struck structural supports between the inner and outer bed walls, and exited the rear portion of the rectangular pocket (BD#2B) on the left front corner of the top bed rail. The projectile penetrated the interior wall of the left front bed pocket (BD#2C) and apparently fragmented. There were numerous small defects and gray residue (BD#2D) on the left edge of the tool box lid near the left front corner. There were also numerous defects and gray residue (BD#2E) on the interior vertical surface of the front of the pickup bed and similar numerous small defects/dents with associated gray residue (BD#2F) on the rear of the cab above BD#2E. The trajectory was downward at 2.5 degrees above the horizontal plane and 63 degrees to the right of the horizontal plane. There were also five irregularly shape penetrating defects (BD#2G) into the left rear corner of the pickup cab to the left of the rear window. These defects were higher than BD#2E and BD#2F. A corresponding defect was observed on the forward facing portion of the door jamb when the rear driver side door was opened. Another corresponding defect was located in the door seal at the rear of the rear driver side door. The trajectory was upward for both defects and consistent with bullet fragment(s) from BD#2B. Bullet Defect #3 A (BD#3A) was located on the rear side of the left rear corner of the pickup cab at a height of 60 ½”. The defect was a round penetrating defect that entered the left rear corner of the cab (BD#3A). There was a corresponding defect (BD#3B) through the left rear interior corner of the cab and through the seat belt. There were corresponding defects (BD#3C, BD#3D) in the rear and front portions of the driver seat at the very top of the seat. A penetrating defect through the windshield (BD#3E) was located in line with defects BD#3A-BD#3D and exited the windshield approximately two-thirds of the way up the windshield and twelve inches right of center. The trajectory at BD#3A and BD#3B was 63 degrees to the right of the vertical plane and level at 0 degrees. Bullet Defect #4 A (BD#4A) was located on the rear-facing portion of the pickup bed above the bumper. The defect (BD#4A) was round and penetrated the rear wall of the bed, a structural bed support (BD#4B), and dented a second structural support (BD#4C) beneath the pickup bed. BD#4A was 34 1/8” high and located 20 ½” left of the vehicle centerline. The trajectory was 3 degrees left of the vertical plane and downward at 2 degrees above the horizontal plane. Bullet Defect #5 A (BD#5A) was located at the rear of the pickup cab. The projectile penetrated the junction of the glass and rubber gasket at the lower edge of the rear window behind the driver’s seat. BD#5A was 54 1/8” high and 20” left of the vehicle centerline. There was a corresponding defect in the upholstery of the rear seat back (BD#5B). Bullet Defect #6 A (BD#6A) was located at the top edge of the rear window behind the driver seat. There was a corresponding defect in the headliner at the left rear of the cab (BD#6B). There were corresponding defects in the central portion of the roof liner to the left 49 Supp. Sheriff DDR 5 - 0130 PROCESSING OF DODGE 2500 PICKUP 289NYF OSBI2014-1297/17 of the dome light where it dipped downward (BD#6C, BD#6D). Following the trajectory forward, there was an additional defect (BD#6E) in the headliner near the inner edge of the passenger side visor. Above the headliner, the projectile entered the interior wall of the top of the cab and dented the outer wall of the roof of the cab near the front windshield and slightly right of center (BD#6F). BD#6A was 69 ½” high and located 18 ¾” left of the vehicle centerline. The trajectory at BD#6A and BD#6B was 24 degrees left of the vertical plane and upward at a 4 ½ deg below the horizontal plane. Bullet Defect #7 A (BD#7A) was located approximately three-quarters of the way up from the bottom of the rear window. The height was 63 ¼” and the defect was located 3” left of the vehicle centerline. Bullet Defect #8 A (BD#8A) was located approximately one-quarter of the way up from the bottom of the rear window. The height was 55” and the defect was located 5” right of the vehicle centerline. There was a corresponding defect located in the notch of the upper right driver seat (BD#8B). The trajectory was 30 degrees to the right of the vertical plane and downward at 2 degrees above the horizontal plane. Bullet Defect #9 A (BD#9A) was located in the cargo lamp/brake light housing on the rear portion of the cab above the rear window. The projectile penetrated the central portion of the lamp housing and entered the rear of the passenger compartment headliner (BD#9B). A grazing defect located in the headliner across the middle of the cab (BD#9C) and a penetrating defect into the headliner over the driver door (BD#9D) were in line with BD#9A and BD#9B. Additional defects to the headliner and door sill (BD#9E) corresponded with the trajectory identified by BD#9A-D. A fired bullet [3] was recovered from the seal around the door located at BD#9E. BD#9A was 69 ¾” high and located ½” to the right of the vehicle centerline. The trajectory through BD#9A and BD#9B was 32 degrees to the right of the vertical plane and horizontal at 0 degrees. Bullet Defect #10 A (BD#10A) was located in the driver side rear door window. The projectile penetrated the window approximately two thirds of the way up from the bottom and one-quarter of the way forward from the rear edge of the window. BD#10A was 65 ½” high and located 14” forward from the left rear corner of the cab. There was a corresponding defect (BD#10B) where the plastic trim on the front interior portion of the rear driver-side door was damaged. There was a penetrating defect in the windshield (BD#10C) that corresponded to the trajectory from BD#10A and BD#10B was located slightly above and to the left of the rear-view mirror on the windshield. The trajectory at BD#10A was 59 degrees to the right of the vertical plane and upward at 1 degree below the horizontal plane. Bullet Defect #11 A (BD#11A) was located on the passenger side door above the door handle. The projectile entered the outer wall of the door and exited the interior panel/trim (BD#11B). There was a defect in the right side of the front passenger seat (BD#11C) in line with BD#11A and BD#11B. The trajectory through BD#11A and BD#11B was 7 degrees left of the vertical plane and downward at 3 degrees above the horizontal plane. Bullet Defect #12 A (BD#12A) was located on the passenger side door above the door handle at the lower edge of the window trim. The projectile penetrated the door and exited the door panel on the interior of the door (BD#12B). There was a grazing defect on the front side of the left front corner of the front passenger seat back (BD#12C) in line with BD#12A and BD#12B. BD#12A was 43 5/8” high and located 31 ¾” forward from the right rear corner of the cab and 6 7/8” forward from the rear edge of the passenger door. The trajectory at BD#12A was 12 degrees left of the vertical plane and downward at 9 degrees above the horizontal plane. Bullet Defect #13 A (BD#13A) was located through the interior window seal on the top of the front passenger side door. There was a corresponding grazing defect in the top of the interior door panel of the door. BD#13A was 44 7/8” high and located 34” forward from the right rear corner of the cab and 9 1/8” forward from the rear edge of the passenger door. The trajectory at BD#13A was 14 degrees to the left of the vertical plane and downward at 11 degrees above the horizontal plane. Bullet Defect #14 A (BD#14A) was located on the rear edge of the front passenger side door approximately 1-2 inches to the rear of the window and slightly less than halfway up the window from the bottom. The projectile penetrated the door and the leading edge of the rear, passenger side door, damaging the door sill (BD#14B). BD#14A was 53 ¾” high and located 28 ¾” forward from the right rear corner of the cab and 3 ¾” forward of the rear edge of the passenger door. The trajectory was 15 degrees left of the vertical plane and downward at 4 degrees above the horizontal plane. Bullet Defect #15 A (BD#15A) was located on the forward edge of the rear, passenger side door, slightly less than halfway up from the bottom of the window. The projectile tore the outer metal but did not penetrate into the door. The projectile [4] was lodged behind the rear edge of the front passenger side door. BD#15A was 53 ¼” high and was located 26” forward from the right rear corner of the cab. Bullet Defect #16 A (BD#16A) was located on the metal backer for the right rear passenger side window located on the forward edge of the rear passenger side door. The backer appeared to be damaged by a projectile, but the projectile did not penetrate the backer. BD#16A was 43 ¾” high and 25 ½” forward from the right rear corner of the cab. Bullet Defect #17 A (BD#17A) was located on the passenger side of the pickup cab at the upper right rear corner. There was no apparent corresponding, penetrating defect into the passenger compartment of the pickup. The trajectory at DB#17A was 43-44 degrees left of the vertical plane and upward at 2 degrees below the horizontal plane. Bullet Defect #18 A (BD#18A) was located in the upper rear portion of the right rear window. The defect was 59 ½” high and located 15 ¼” forward of the right rear corner of the cab. Bullet Defect #19 A (BD#19A) was located in the right rear door below the right rear window. There was a secondary defect on the interior door panel (BD#19B). A third defect was located in a corner of the Yeti cooler in the back seat (BD#19C). A fired bullet [6] was located inside the corner of the Yeti cooler. BD#19A was 43 5/8” high and located 13 ¼” forward from the right rear corner of the cab. The trajectory was 28 degrees left of the vertical plane and downward at 4 degrees above the horizontal plane. Bullet Defect #20 A (BD#20A) was located in the in the right rear corner of the cab at approximately the same height as the door handle. There was no apparent corresponding, penetrating defect into the passenger compartment of the pickup. BD#20A was 39 ½” high and 2 ¼” forward from the right rear corner of the cab. The trajectory was 47 degrees left of the vertical plane and downward at 6 degrees above the horizontal plane. Bullet Defect #21 was located at the rubber trim at the bottom of the driver door window above the interior door handle. The defect penetrated the window and impacted the rubber trim and top edge of the exterior metal door, denting the door outward. The rubber trim was perforated and torn by the projectile (BD#21A). Bullet Defect #22 was located on the passenger side of the vehicle at the junction of the front and rear passenger side doors. The projectile impacted the front edge of the rear door (BD#22A) approximately one-third way above the lower door edge. The secondary defect was located on the rear of the front passenger door (BD#22B) where an approximate two inch tear or gouge was located. The projectile entered the front passenger side door. No apparent exit was observed. Bullet Defect #23 was located in the lower dash to the left and below the steering wheel. A projectile entered the trim below and left of the steering wheel (BD#23A) and penetrated right to left in a downward angle. A secondary defect (BD#23B) was a defect at the far left side of the dash that was consistent with an exit created by a projectile. Narrative / Additional Information: On December 5, 2014, OSBI Special Agents BRADLEY KNIGHT and MICHAEL SHUFELDT met at the Choctaw County Sheriff’s Office at approximately 1300 hours. Choctaw County Sheriff TERRY PARK unlocked the building where the 2002 Dodge Ram 2500 extended cab pickup was stored. The 2002 Dodge pickup had been involved in the 52 Supp. Sheriff DDR 5 - 0133 PROCESSING OF DODGE 2500 PICKUP 289NYF OSBI2014-1297/17 officer involved shooting on December 4, 2014 at Grant, Oklahoma, and had been towed from the scene and stored at the Choctaw County Sheriff’s Office. KNIGHT placed a jack under the right front hub in order to achieve a similar tilt of the vehicle observed at the scene. The vehicle was observed to have a 4 degree tilt downward to the right and a 1.5 degree tilt downward and to the front. After jacking up the right front hub, the closest representation of the Dodge pickup was a 4.5 degree tilt downward to the right and a 3 degree tilt downward and to the front. These angles were measured with the level and angle finder from the left front corner of the pickup bed. KNIGHT documented the various defects in the vehicle with photography, then labeled and measured the locations of the defects. SHUFELDT assisted with the documentation of the locations of the defects and a search of the vehicle. OSBI Special Agents SONNY STEWART and ROBERT WILLIAMS arrived at the scene. STEWART assisted KNIGHT with measurements and documentation of the bullet defects. KNIGHT and SHUFELDT collected the bullets and bullet fragment from the Dodge pickup. One fired bullet was located on top of the driver's door hinge brace. Another fired bullet was recovered from bullet defect #9E. There was a bullet fragment collected from the back portion of the driver's seat. A fired bullet was recovered from bullet defect #15. A 20 count box of Hornady 223 Rem 55 grain V-MAX ammunition containing 17 cartridges was recovered from the passenger floorboard. SHUFELDT recovered a fired bullet from the Yeti cooler that was located in the right rear seat of the Dodge pickup. SHUFELDT retained possession of the items and entered them into evidence at the Antlers Evidence Vault. The past seven years he had been the Lieutenant of the Detective Division. From 1993 to 1999, BABCOCK was a reserve for the Choctaw County Sheriff’s Office.. On December 4, 2014, BABCOCK reported to the Hugo Police Department for work at 0630 hours. Sometime after lunch, Hugo Detective BILLY JENKINS received a picture and warrant for WILLIAM HONEA. The warrant was out of Sulphur Springs, Texas. JENKINS had received information that HONEA was staying with JASON DAVIDSON in Grant, Oklahoma. BABCOCK and JENKINS drove to Powderly, Texas, and visited with DAVIDSON’S ex-wife, STEPHANIE DUNHAM. DUNHAM lived next door to DAVIDSON in Grant, Oklahoma. JENKINS spoke with DUNHAM and provided her with a picture of HONEA. DUNHAM thought the person in the picture was the same person she saw at DAVIDSON’S house during lunch. JENKINS and BABCOCK returned to Choctaw County. JENKINS called OSBI Special Agent SONNY STEWART. When JENKINS hung up the phone, he told BABCOCK they needed to check the Choctaw Casino for HONEA. BABCOCK drove to the rear of the Casino as he knew DAVIDSON usually parked in the rear parking lot. As they approached the rear of the vehicle, they saw a white, 4-door, Chevrolet pickup. This vehicle description was given to JENKINS earlier by DUNHAM as a possible vehicle driven by DAVIDSON. HONEA was also supposed to be wearing a stripped toboggan and orange sweatshirt or sweater. A person matching the description was standing by the vehicle. BABCOCK asked the person who he was and he replied, “JIMMY JONES.” BABCOCK asked if the person was from Hugo and he replied yes. BABCOCK returned to the vehicle to get a picture of HONEA and the subject ran into the Casino. BABCOCK did not pursue, as he was not sure if the person was HONEA and he felt he was out of his jurisdiction. STEWART was contacted and informed of the situation. BABCOCK was talking to STEWART on the cell phone when STEWART advised he had observed a white male running out the front door of the Casino and across Highway 271. BABCOCK got into his Investigative Division Tahoe, which was not equipped with a camera and headed toward STEWART’S location. JENKINS did not come with BABCOCK, as he was in the restroom when BABCOCK left. When BABCOK got into his vehicle, he heard STEWART on the radio saying the suspect was in a grey Dodge pickup. BABCOCK exited the Casino from the main driveway and crossed Highway 271 onto a county road. BABCOCK observed a grey Dodge pickup headed east on the county road directly east of the Casino. BABCOCK confirmed, through STEWART, that the vehicle was the vehicle in question. BABCOCK activated his emergency lights and began pursuing the vehicle. The vehicle pulled into a driveway and accelerated through the yard and back onto the county road. BABCOCK then activated his emergency siren to warn the public of the pursuit. HONEA drove the vehicle through several turns and then entered a field to the south of the road. BABCOCK followed HONEA through the field and HONEA exited the field headed west on the same county road. HONEA almost hit STEWART’S vehicle while exiting the field. HONEA was approximately 150 yards ahead of BABCOCK at this point of the pursuit. Choctaw County Deputy LARRY HENDRIX, with Choctaw County Sheriff TERRY PARK, got in behind HONEA. HONEA headed north on the Old Paris Highway. HENDRIX asked BABCOCK to come around them, as his vehicle was faster and could keep up with HONEA. BABCOCK went around HENDRIX and was again the first vehicle in the pursuit. As HONEA approached the Hugo Golf Course, he attempted to turn west onto the road joining the Old Paris Highway and State Highway 271. BABCOCK observed a marked Hugo Police Tahoe traveling east on the same roadway as HONEA. The Hugo Police vehicle had to take evasive action to prevent being hit by HONEA. HONEA drove across the northbound lane of 271 and hit a northbound eighteen wheeler. Sparks began flying from HONEA’S vehicle and he proceeded south in the northbound lane of Highway 271, causing at least three vehicles to leave the roadway. BABCOCK then shot two rounds from his Glock service pistol from his driver’s window in attempt to shoot the driver's rear tire of HONEA’S vehicle. BABCOCK attempted to shoot the tires due to HONEA putting the public’s lives in danger and possible death. Prior to shooting, BABCOCK insured no vehicles were in the path of the projectiles of his firearm. 58 Supp. Sheriff DDR 5 - 0139 INTERVIEW OF STEVEN MARK BABCOCK OSBI2014-1297/18 HONEA crossed into the southbound lane and continued south on Highway 271. BABCOCK observed a rifle come out the driver’s window of HONEA’S truck and heard a shot from the rifle. BABCOCK advised other units on the radio that shots had been fired. As the pursuit approached the 109 West intersection, JENKINS was standing outside a parked Choctaw Security vehicle and appeared to discharge his firearm at HONEA’S vehicle. The pursuit continued south until someone on the radio advised BABCOCK to let the Trooper by. The Trooper "TVI’d" (Tactical Vehicle Intervention) the vehicle in front of the Casino, causing him to leave the roadway headed west across the ditch and then across the access road into a grassy area in front of the casino. As HONEA approached the parking lot, he got stuck in the grassy area. BABCOCK was trying to stop when he observed HONEA’S driver’s door open and HONEA exiting the vehicle with a rifle in his hands. During the pursuit, BABCOCK had placed his DPMS 308 rifle out the driver’s window. BABCOCK then began firing his rifle out the window at HONEA. BABCOCK thought it appeared that HONEA kept trying to get in and out of his vehicle behind the door pillar. BABCOCK saw PARK approach the vehicle on the passenger side discharging his firearm at HONEA. BABCOCK stopped shooting, excited the vehicle, and approached HONEA. HONEA was sitting in the seat, slumped over towards the passenger seat with a single shot rifle. Officers pulled HONEA from the vehicle. BABCOCK returned to his vehicle and placed his rifle inside the vehicle. He rolled the windows up and did not go back into his vehicle. BABCOCK remembered thinking he was going to die because HONEA had the drop on him. Enforcement for over 30 years. He had been in Law On December 4, 2014, PARK and Under Sheriff LARRY HENDRIX went to assist OSBI Special Agent SONNY STEWART with apprehending a Fugitive from Texas who was in the Grant, Oklahoma area. PARK and HENDRIX were told that the Fugitive had made statements that he would not be taken alive. PARK and HENDRIX got about a mile from the Choctaw Casino in Grant, when they heard on the radio that the subject was running on foot east away from the Casino. HENDRIX was driving and PARK was the passenger. They drove toward the Choctaw County District 2 Barn and heard Hugo Police Lieutenant STEVE BABCOCK announce on the radio that he was in pursuit. PARK and HENDRIX got in the pursuit and followed BABCOCK. They drove through Grant, Oklahoma going south. The subject turned north and went back through Grant, on the Old Paris Highway, at a high rate of speed. The subject struck another vehicle. PARK then heard over the radio, "Shots fired, shots fired." The pursuit took them back to the front of the Casino where the subject's vehicle stopped. PARK heard someone say, "He's got a gun. He's got a gun" BABCOCK got out of his vehicle and fired his weapon at the back driver's side of the subject's vehicle. PARK got out of his vehicle, which was adjacent to BABCOCK'S vehicle, and fired three rounds into the passenger side of the subject's vehicle. PARK then walked toward the passenger side of the subject's vehicle and continued to fire at the subject. PARK continued to fire his weapon until his weapon was out of ammunition. PARK believed he struck the subject in the shoulder and in the head. PARK continued to shoot because the subject was still moving. PARK did not know if the subject had fired any shots or not. On December 4, 2014, HENDRIX had been contacted by OSBI Special Agent SONNY STEWART for assistance in apprehending a Fugitive named WILLIAM HONEA. HONEA had a Felony Warrant for his Arrest in Sulphur Springs, Texas, for Armed Robbery. HENDRIX and Sheriff TERRY PARK got in a vehicle and went to Grant, Oklahoma, where HONEA had been spotted running into the Choctaw Casino. By the time he and PARK arrived, HONEA had stolen and vehicle and a pursuit ensued. During the pursuit, HONEA attempted to strike his and Hugo Chief of Police JOHN PAUL BOZEMAN'S vehicles. HONEA also struck an 18 wheeler tractor trailer and lost his right front tire. An Oklahoma Highway Patrol Trooper performed a Tactical Vehicle Intervention maneuver on HONEA'S vehicle and the vehicle came to a stop on the grassy area in front of the Choctaw Casino. Hugo Police Lieutenant STEVE BOZEMAN was directly behind HONEA'S vehicle and HENDRIX was adjacent to him. HENDRIX saw HONEA coming out of the vehicle with a long gun and HENDRIX fired his weapon two or three times from inside his vehicle while still seated. HENDRIX lost visual sight of HONEA and stopped shooting. PARK had got out of the vehicle and was walking toward the passenger side of HONEA'S vehicle and was shooting his weapon. Everyone stopped shooting and HONEA was taken out of the driver's side and handcuffed. HENDRIX carried a Glock 34 9mm Pistol. HENDRIX also owned a Glock 19 and the last time he cleaned his weapons he got the two guns mixed up. HENDRIX placed the slide of one gun on the receiver of the other, so the there will be two different Serial Numbers for the slide and frame. HENDRIX carried Hornity Critical Duty 137 Grain Plus P Ammunition. PARK carried the same ammunition as well. Sometime after lunch on December, 4, 2014, OSBI Special Agent SONNY STEWART showed JENKINS a picture of WILLIAM HONEA and asked him if he knew him. STEWART told JENKINS that HONEA had a Warrant for his Arrest out of Sulphur Springs, Texas and showed him the Warrant. STEWART told JENKINS that HONEA was supposedly staying with JASON DAVIDSON at DAVIDSON'S house in Grant, Oklahoma. JENKINS told STEWART that he knew JASON'S estranged wife, STEPHANIE DAVIDSON. JENKINS had investigated some fraudulent check cases involving both JASON and STEPHANIE and had built a rapport with STEPHANIE. JENKINS told STEWART that STEPHANIE worked at the Reddy Ice in Powderly, Texas. JENKINS and Hugo Police Lieutenant STEVEN BABCOCK went to Powderly and interviewed STEPHANIE. JENKINS showed a picture of HONEA to STEPHANIE and she identified him as "BOB" and confirmed that he had been staying with JASON at their house in Grant. STEPHANIE further told JENKINS that she just saw "BOB" about an hour ago when she went to the house in Grant to put up their dog. STEPHANIE then told JENKINS that she believed JASON and "BOB" went to the Choctaw Casino. JENKINS called STEWART and told him what he learned. STEWART told JENKINS that he would gather up other officers and head his way. STEWART told JENKINS that he learned from the Texas Authorities that HONEA had made statements that he would not be taken alive. JENKINS asked STEWART if he wanted him to drive through the Casino parking lot and see if he could see JASON'S truck there. STEWART told him to check the parking lot, but not to go to the house until he and other officers arrived. JENKINS and BABCOCK drove through the Casino parking lot and found JASON'S truck on the west side of the Casino. There was a man leaning up against the truck but the man did not look like HONEA. JENKINS made contact with the man and asked if he was waiting on JASON to which he said yes he was. The man said his name was "BOB". JENKINS saw a Tribal Security Officer and informed him of the situation and he radioed other Security Officers to look for and detain the man that ran into the Casino. JENKINS went into the Casino and saw JASON. JENKINS attempted to talk with JASON, but JASON told JENKINS that he did not know who the man was other than a person whom he had given a ride. JASON denied that HONEA had been staying at his house and stated that he knew the man as "BOB". JENKINS told JASON not to leave. JASON continued to look for HONEA in the Casino when one of the Tribal Security Officers told JENKINS that HONEA had been spotted running toward Highway 271 on the east side of the Casino. JENKINS went back outside, but BABCOCK had already left. JENKINS got in a vehicle with a Tribal Security Officer and directed him to go to the Service Road. JENKINS noticed that JASON was in his truck in front of him leaving the Casino. JENKINS then heard STEWART transmit over the radio that HONEA was in a vehicle and was on the Old Grant Highway and was traveling south. JENKINS and the Tribal Security Officer drove to an Intersection just east of the Casino and stopped. JENKINS then heard that HONEA had made a u-turn and went north on the same road. JENKINS and the Tribal Security Officer then drove north on Highway 271. JENKINS could hear on the radio that HONEA was still traveling north on the Old Grant Highway. JENKINS heard Hugo Police Chief JOHN PAUL BOZEMAN on the radio say, "He almost hit me." Someone then radioed that he was headed back toward Highway 271. JENKINS told the Tribal Security Officer to stop at the Intersection of Highways 271 and 109. JENKINS got out of the vehicle and waited for HONEA to approach his location. At this time JENKINS heard BABCOCK on the radio say, "Shots fired, shots fired. He has shot at me. Shots fired." JENKINS un-holstered his weapon and saw HONEA coming toward his location at a high rate of speed. JENKINS noticed that the right front tire was missing and the vehicle was running on the rim throwing sparks. As HONEA passed his location, JENKINS fired two shots at the front driver's side window and his weapon malfunctioned. DUNHAM was married to JASON DAVIDSON and they were currently separated. DAVIDSON lived next door to DUNHAM in property owned by relatives. On the Saturday after Thanksgiving, a person known to DUNHAM as BOB, (later identified in the Investigation as WILLIAM LEE HONEA), came to DUNHAM’S residence and asked if she had seen DAVIDSON. DUNHAM told HONEA to call DAVIDSON and he told her he did not have a phone. HONEA left the residence without incident. DUNHAM assumed HONEA was staying with DAVIDSON due to him being at DAVIDSON’S residence. DUNHAM again saw HONEA at Choctaw Casino on the evening of December 2, 2014. DAVIDSON was not with HONEA at the time to DUNHAM’S knowledge. On December 5, 2014, Hugo Police Detective BILLY JENKINS contacted DUNHAM at work. JENKINS provided DUNHAM a picture and DUNHAM was able to identify him as HONEA. DUNHAM told JENKINS that DAVIDSON was at home during her lunch hour. The location, the shooting occurred, was on Tribal Trust Land. WILLIAMS contacted District Attorney MARK MATLOFF to determine who had Jurisdiction to conduct the investigation. MATLOFF stated that if the victim were Native American then the FBI needed to be contacted and the OSBI would not have Jurisdiction. But, if the victim were Non-Native American then the OSBI did have Jurisdiction to investigate. WILLIAMS contacted the Choctaw Tribal Police and they checked their Data Bases and determined that HONEA was not a member of any of the Five Civilized Tribes of Oklahoma, those being, Choctaw, Chickasaw, Cherokee, Seminole, and Creek. Dr. LANTER had performed an autopsy on WILLIAM HONEA and provided the following information: HONEA had a total of eight individual gunshot wounds to his body. Of those eight wounds, three were considered graze wounds. HONEA had a graze wound on his right ear, a graze wound on his left forearm, and a graze wound on his left hand. HONEA had two wounds in the back of his head. One wound was a gunshot wound that entered in the left side of the back of his head. The second wound was related to or was a result of the initial projectile entering the head. This wound was next to the gunshot entrance wound. Dr. LANTER was able to recover the projectile from HONEA'S head. The projectile was still intact. HONEA also had a gunshot wound that entered in the middle of his back. The projectile had a right, upward, and forward trajectory and exited in his right armpit area. HONEA had three gunshot wounds that entered in the top of his back or shoulder area. These wounds had a predominately downward trajectory and traveled toward his feet. One projectile was recovered from his abdomen and another projectile was recovered from his lower back. During the autopsy, Dr. LANTER observed numerous bumps and bruises to HONEA'S left ear and back. Dr. LANTER reported that it appeared to be "pseudo stippling". Dr. LANTER explained that pseudo stippling was caused by shrapnel peppering and was often observed after a subject had been shot while inside a vehicle.
