Interviewed: Amy Skelton – 802-586-2882 ext 2 Complainant: Anonymous Complaint: Complaint received via a phone call to the Agency of Agriculture on October 1, 2018. Complainant stated that Pete’s Greens got 300 plants from Champlain Valley Dispensary. Pete’s grew the plants and they are being harvested today. Complainant said the plants are not hemp and should test at 7.8% THC level. They said that the dispensary told Pete’s Greens that if the plants tested higher than 1% THC, the dispensary would buy the plants back from them. The complainant feels the hemp and medical marijuana laws are being abused. Samples: Sample number 0088 – approximately 17” long cannabis stem tip found on farm road Sample number 0088 sub 1 – red plant ID tag ‘CM45’ Narrative: I was notified of the complaint against Pete’s Greens on October 1, 2018 from Jennifer LaValley via a phone call. After consulting with my supervisors, I arranged to investigate at Pete’s Greens on October 3, 2018. Pete’s Greens is registered to grow hemp in Vermont under the hemp registration number of VTH345-0018. The hemp registration shows Pete’s Greens has three potential areas where hemp is grown: at 4-acre field at 4 Guy Lot Rd in Craftsbury, in a 3000 sq. ft. greenhouse, and in a 7000 sq. ft. greenhouse. On the morning of October 3, 2018, I met with Matthew Wood, A.R.M.S., and Erica Cummings, Agrichemical, Research, and Policy Specialist at Pete’s Greens. We went to the main offices and asked to speak with Pete Johnson or Amy Skelton. Mr. Johnson was in a meeting with the NOFAVT inspector, so Ms. Skelton met with us. We let her know we had received a complaint about their hemp crop and that the complainant is alleging the THC level of their crop may be higher than they expect. Ms. Skelton said they had been growing hemp for CBD. She mentioned she had looked over the hemp law and that she was under the impression that if the plants tested over 1% THC, the dispensary could buy the plants from them. We explained that if the plants tested over .3% but under 1% THC, the dispensary could buy the plants, but over 1%, they could not. I asked where the crop currently was, and Ms. Skelton was not sure. She took us to the greenhouse where the crop was being grown – photos IMG_2258 and IMG_2259. This greenhouse did not appear to have a way to secure it. The greenhouse is a covered with plastic and the ends were wide open. The greenhouse did not appear to have a way to be secured closed nor did I see security cameras. The plants were grown in about 1/3 of a greenhouse that is about 50’ x 200’. They had been growing in the ground. When we got there, a few Pete’s Greens employees were cleaning the area where the plants were grown. Ms. Skelton said the plants had been harvested earlier in the week and the employees were cleaning the area. The area had straw mulch and stumps and roots from cannabis plants. They were loading the plant debris into the back of a pickup truck. I asked if Ms. Skelton knew where the plants were taken to dry. She did not. I asked if she knew how many and what variety or varieties had been planted. She did not. She suggested we provide her with a list of information we were seeking, and she would go ask Mr. Johnson. We then went inside to the main offices to a conference room. We asked if Ms. Skelton if she knew if the hemp was grown in the other locations. She said she wasn’t sure. She said earlier in the season she had tried to find the hemp field but couldn’t find it but found pigs. We gave her some questions to ask Mr. Johnson, which included: how many plants had been planted, how many varieties, what varieties, the date the were harvested, where the plants currently are, location(s) the plants were grown, and did they grow them from seeds or from seedlings. Ms. Skelton left and came back after talking with Mr. Johnson. Ms. Skelton said Mr. Johnson told her this is the first year they had ever grown any hemp. She said that Champlain Valley Dispensary (CVD) approached Mr. Johnson and asked if he would consider growing some plants. Mr. Johnson felt this was a good trial to try growing the plants. Ms. Skelton said the plants were CBD and planted as seedlings, she thinks during the summer. She said CVD provided the plants to Pete’s Greens at no charge. As far as she knew, there were no payments exchanged nor any paperwork to document the agreement and this was more of a handshake deal. She also said there was only one variety and it was planted in only one greenhouse. She said the second greenhouse and the field were not planted. Pete’s Greens was the grower of the plants and Pete’s Greens employees tended the plants during the summer. About 230 plants were harvested on October 1 and 2 by CVD employees. Ms. Skelton said that Pete’s Greens was the grower of the plants, but CVD is the owner of them. Ms. Skelton said the hemp registration form was filled out for Pete’s Greens because they thought that is what they needed to do to grow the hemp. I asked if Ms. Skelton would see if Mr. Johnson would be willing to fill out an official statement form. She was informed the form is voluntary. She took the form and came back with a signed statement from Mr. Johnson – photo IMG_2272. She said she wrote the statement and Mr. Johnson agreed to sign it. A copy of the statement was provided to Ms. Skelton. We asked if we could look inside all the greenhouses and look at the Guy Lot Rd field to make sure all hemp plants have been harvested. Ms. Skelton said we could. She had to stay at the office. We walked around the main farm and checked all the greenhouses. We saw no cannabis plants growing in the greenhouses nor any growing in the fields around the greenhouses. As we were walking along a farm road that leads to a compost pile, I found the tip of a cannabis plant on the farm road- photo IMG_2260 and IMG_2261. The tip is about 17” long and had numerous buds. I picked up the plant tip to collect as a sample. As we continued walking along the farm road, Mr. Wood found a cannabis stump/root in a mud puddle. On the base of the stump was a red ID tag labeled ‘CM45’ – photos IMG_2262 and IMG_2263. We collected the ID tag. When we returned to our vehicles, both the 17” cannabis stem and the ID tag were put into a zip top bag and labeled - photos IMG_2264 and IMG_2265. The cannabis stem was placed into my sample cooler with ice packs. We then went to Guy Lot Rd and looked in the area near 4 Guy Lot Rd. We saw no cannabis growing. When we reached an area with cell phone reception, we called Linda Boccuzzo to update her with the information we obtained. I transported the samples to Montpelier where I filled out sample paperwork, bagged and sealed the samples, and filled out the chain of custody forms – photos IMG_2266 to IMG_2271.
