Rodriguez who told me that Of?cer McMahon had been involved in an of?cer involved shooting in the 400 block of Carolina Street. I arrived 011 scene and was advised by Detective Greenberg that V-Of?cer McMahon had been sequestered at the PD. Detective Greenberg briefed me on the public safety statement Sgt. Darden had obtained from Ofc. McMahon and that the suspect had been identi?ed as S-Ronnell Foster. See Detective Greenberg's supplemental report for ?uther information as well as a description of the scene. While at the scene, I observed that the window and front door to- Carolina Street- faced the scene and appeared to have a good View of the area. There was a closed screen door in the doorway, however the front door was open. The apartment lights were on and I could periodically see movement through the window and front door. - and. Carolina Street are separated by a waist high wall. DAI Rister and I walked back out to Carolina and arormd the wall to attempt contact occupants at_. As I approached the door, I could see a male subject, female subject. and at least one child tln'ough the open front door. I knocked on the door and armounced "police depaitment." The male subject canre to the door. I asked the subject if he saw what happened and he stated, "no, sir." He then said, "all I heard is a lot of shooting." When asked how nruch shooting he heard he said, heard enough shooting to be scared." When I asked if anyone in the house saw anything, he said "nope." I observed that the female subject in the living room was shaking her head no. I asked the subject for his name and he said. "Nope. Not really. you can call me When pressed, the subject eventually stated that his name was- with a DOB of- and that he didn't have a phone. It was clear that the subject was not being truthful regarding his identity and that he did not want to talk to me. I asked the subject if he did not wish to talk to me and he stated, "not really but I'm telling you what I heard and what I saw." Later dru'ing the interview with I learned that the occupants of were and the father of her children, (rmknown last.) I later conducted a local RIMS check for - and located a traf?c stop on- in which a and were contacted and 11111 through LETS. I pulled up photo via al-Photo and con?rmed this was the subject I was speaking to at. Carolina St It should be noted that I also conducted a public records search on- Carolina St apt. I and was the ?st listed person associated with the residence. My contact with- was recorded on my PDR. I later uploaded a copy to evidencecom for preservation, 680-2. It should be noted that I also reviewed _photo via al-Photo and it appeared to be the same female subject I observed in the apartment. McLaughlin 664. We were both wearing a full police uniform and I was driving marked patrol vehicle 148. We responded to the area of Florida Street and Marin Street in order to assist Of?cer McMahon 702 with a subject who was ?eeing from him. While en route to the area, Of?cer D. McLaughlin and I were concerned for Of?cer McMahon because we did not know his exact location and he was not responding to dispatch. As we drove closer to Florida Street and Marin Street, Of?cer McMahon said that shots were ?red at 415 Carolina Street. Of?cer rv McMahon sounded out of breath and upset. 771 We drove into Kissell Alley which is located to the South of 415 Carolina Street. Of?cers Bahou 662 and Blain 642 were in front of 11s in their patrol vehicle. We exited oru' vehicle and entered the yard of 415 Carolina Street. Once in the yard, I assisted Of?cers with detaining the suspect in handcuffs. The suspect was placed in handcuffs without incident. After the suspect was safely detained in handcuffs, we provided medical aid by applying chest seals to him. Vallejo Fire Department personnel arrived on scene soon after. After Vallejo Fire Department persomrel arrived on scene, Iput crime scene tape 11p around the scene. After putting crime scene tape up, Of?cer D. McLaughlin and I were tasked by Sgt. We responded to the area of Florida St and Marin St in order to assist 3P1 (Ofc McMahon Badge 702) who had a subject ?eeing from him. While responding to cover Ofc McMahon, we both noted that he was not contacting dispatch with any updates. I know from my training and experience that bicycle/foot pursuits are inherently dangerous. Due to the above listed information, the seriousness of this call signi?cantly elevated in my mind. 771 '7 As we drove closer toward the last known location of Ofc McMahon, he alerted dispatch that he had shots fn?ed at 415 Carolina St. Ofc R. Blain interview 184786 On 021318 at approx. 2000 hrs. I received a call at home from Detective Sergeant Rodriguez. He told me there had been an of?cer involved shooting in the 400 block of Carolina St. and Ofc. McMahon was the actor. Sgt. Rodriguez asked me to respond to the scene to assist in the investigation. He told me the Solano County OIF protocol had been invoked. I arrived at to 415 Carolina St. at approx. 2040 hrs. I walked though the scene and noticed the car? that was assigned to Ofc. McMahon was facing west on Carolina St. just west of Marin St. I saw a bicycle that the suspect, later identi?ed as (S)?Foster, had been riding. I walked west ahnost the entire block to 415 Carolina St. where the incident happened. I spoke with Sgt. Darden who briefed me on the incident. Sgt. Darden told me the suspect was identi?ed as (S)-Ronnell Diangelo Foster. Sgt. Darden told me Ofc. McMahon advised over the radio he was attempting to stop a man on a bike near Marin St./ Carolina St., and the man failed to yield and was riding away. At the corner of Marin St./ Carolina St. Foster got off of the bike and began running with Ofc. McMahaon chasing him. There was a long radio silence and Sgt. Darden was asking for an update. Ofc. McMahon's next radio transmission was "Shots ?red." When he arrived, Sgt. Darden asked Ofc. McMahon public safety questions and brought him to the station to be sequestered by Ofc. D. Jones. He placed Ofc. McMahon's body camera on the docking station to download the video. I walked through the scene at 415 Carolina St. 415 was in black letters facing the street on the north west corner of the building. There is a door to the residence to the left of the address numbers. Along the right (west) side of the house was a narrow walkway leading to apartments in the back of the address. I walked south along the path and came across taser wires lying on the ground. I continued down the path and formd a cell phone fruther south along the path. At the bottom of the pathway was a bank of mailboxes for the apartments. The area was illruninated by one light bulb. I did not notice any other path lighting and no porch lights of the nearby apartments were on. I saw a sign saying the are was recorded by video, however, I didn't locate any cameras. At the bottom of the stairway I formd (S)-Foster covered with a yellow blanket. His head was to the south and his feet were to the north. I was rurable to notice any on Foster. He was handcuffed and laying partially on his left side. Some items had been removed from his pockets while being tended to by of?cers. Inoticed a glass pipe with bulb at one and burn marks which I recognized from my training and experience as a pipe used to smoke methamphetamine. I saw several evidence placards marking shell casings. I collected body cameras ??om Sgt. Darden, Ofc. Blain, Ofc. Bahou, Ofc. R. McLaughlin, and Ofc. D. McLaughlin. I retluned to the station and placed them on the dock to download the videos. I watched Ofc. McMahon's body camera video and noticed the following: There was no sound for the ?st 30 seconds. Ofc. McMahon activated the camera after ?ring his weapon. The video played the last 30 seconds before he activated the camera and there is no audio. It begins with Foster on the grormd and Ofc. McMahon using his taser in drive stun mode as he applies it to Foster. Theres a struggle and it appears Foster grabs the ?ashlight from Ofc. Ofc. McMahon's ?ashlight was not at the scene where it showed to be in the video. I learned Ofc. Bahou had picked up the ?ashlight to use it at the scene and was still in possession of it. I attending a briefmg along with other detectives and investigators ?'om the district attorney's of?ce. I was assigned to the Team with Det. Schillinger and Investigator Vicki Rister from the Solano ormty District Attorney's Of?ce. We were tasked with interviewing Of?cers Blain and Bahou and- The three of us interviewed Ofc. Bahou. The interview was recorded and booked into evidence. For his exact statement, refer to DVD. Ofc. Bahou told us the following: Ofc. Bahou stated he was working as a two man car assigned to beat 2, call sign 3A2, with Ofc. Blain. Ofc. Bahou was driving their marked patrol car. At approx. 1940 hrs. he was at the station with Ofc. Blain and they were just leaving. He heard Ofc. McMahon say he was attempting to stop a subject on a bicycle for vehicle code violation and the subject was taking off. Ofc. Bahou said they responded code 3 and heard Ofc. McMahon advise of "Shots fn'ed" over the radio. He then drove to the south Carolina St. alley, named Kissell Alley, in the 400 block. A WMA opened a gate leading ?'om the alley into the corntyard. He and Of?cer Blain entered the corutyard area. Of?cers Dave and Ryan McLaughlin arrived at the same time and the fom' of them went into the courtyard together. He saw Ofc. McMahon standing to the left and a BMA laying on top of some bushes to the right. As a group they contacted the BMA and placed him handcuffs and the other of?cers started life saving measru'es. I asked about the lighting in the corutyard and Ofc. Bahou said "It was dark, really dark." He said there were no street lights on and I asked if any of the apartments had the porch light on. He believed the writ to the east of the corutyard had theirs on, but to the awnings and other structlu'es in the corutyard, it did not illuminate the area and he again said "It was dark." I asked about his uniform and equipment. He told me he was still wearing the uniform he was wearing at the time of the incident. He does cany a ?ashlight, however, his ?ashlight was in the police station charging. I asked if he carried a second light on him. Ofc. Bahou said the only other light he carries is a weapon light 011 his fn'earm. I asked how he came into possession of Ofc. McMahon's ?ashlight. Ofc. Bahou said while of?cers were rending aid to the suspect, he saw the ?ashlight 011 the grormd near the feet of the other of?cers. He thought one of them put it on the ground to ?ee up their hands. He picked 11p the ?ashlight and illuminated the area so the of?cers could tend to the suspect. At some point after, he started a crime scene log and realized he needed to retrun the light to the owner. He asked of?cers whose light it was when Ofc. Blain told him she believed it was Ofc. Also present was of Rains, Lucia, Stern, St. Phalle Silver representing Of?cer MCMAHON. When asked, Of?cer MC MAHON advised that he has been with the Vallejo Police Department since July of 2017. He advised he has approximately seven years in law enforcement beginning with the Sausalito Police Department where he was a detective as well as a ?rearms instructor. He left the Sausalito Police Department and went to work for Central Marin Police Department as a patrol of?cer. When asked about his training, Of?cer MC MAHON advised he had over 1,400 hours of POST certi?ed training, including POST certi?ed investigations coru?ses, ?rearms training for ri?e, pistol, and shotgun, and tactical training. He advised he attended a tactical lifesaver coru'se. He advised he has been to classes to determine if people are under the in?uence of drugs and alcohol and various report writing classes. Of?cer MC MAHON is crur'ently assigned to graveyard patrol Monday through Thru'sday ??om 2130 horu's to 0730 hours. However, he advised that he came in early for tonight?s shift for overtime, beginning at 1630 hours. He was due to work until 0730 horu's in the morning. Of?cer MC MAHON advised that on Monday he worked the same shift, conring in at 1630 horns and working until 0730 hours. When asked when he last slept, Of?cer MC MAHON advised that he went to sleep at approximately 0845 horns and woke up at approximately 1400 horu?s. Of?cer call Sign tonight was 3 Paul 1. When asked how he was dressed for his shift tonight, Officer MC MAHON advised he was in a full Vallejo Police Department ruriform, stating that there is a badge on his chest which has his badge nrunber and Vallejo Police. He advised the luriform is solid blue and he has department shoulder patches on his shoulder. He further advised he was wearing a duty belt, which carries his patrol equipment. When asked if he was driving a patrol vehicle, he advised he was. He told me he was driving Vallejo Police vehicle number 160, which is a fully marked police patrol vehicle that has the Vallejo Police emblems on it, is black and white in color, and has emergency lighting equipment on top. When asked, Of?cer MC MAHON told me that his duty weapon is a Glock 21, which is .45 caliber. It has a l3-roru1d magazine with one round in the chamber for a total of 14 rounds. Of?cer MC MAHON advised it is standard procedru?e to carry it fully loaded with 14 rormds. He indicated that it was his personally owned ?rearm and not department issued. Of?cer MC MAHON advised that on this night, he was carrying his ?rearm with 14 rormds. He said that he carries three spare magazines orr his person and he was using department issued ammunition. I asked Of?cer MC MAHON if he was carrying any additional weapons and he advised he had a Glock 30 SF in his left pants pocket. I asked Of?cer MC MAHON if he had been afforded the opportunity to watch his body camera footage of the incident. When asked about the incident, Of?cer MC MAHON told me that he had just cleared a call on Marin Street (CAD 1802130158) and he was driving eastbormd on Capitol Street and came to the intersection of Capitol Street and Sonoma Boulevard. At this time he observed a subject riding a bicycle in and out of the roadway in the northbormd lanes (of Sonoma Blvd) from the Capitol Street stairs area. Of?cer MC MAHON advised that he is aware of the high number of vehicle versus pedestrian fatalities that have occurred recently in the city of Vallejo and he thought he would take this opportrmity to educate the public on the dangers that this person was creating for himself and the traf?c on Sonoma Boulevard. Of?cer MC MAHON advised that he was about to initiate a stop on the subject for not having a light on his bicycle and moving in and out of the roadway as he was. He indicated that this subject saw him and had a ?deer in the headlights look.? Of?cer MC MAHON advised that that was not a normal reaction in his experience. He indicated that in his experience when people see police of?cers, they either cuss at you, wave at you, or stare at you. He said that based on the way this person was looking at him, he believed that ?something was wrong.? He advised that the subject then immediately ?ed northbormd on Sonoma Boulevard riding in the lanes of traf?c. Of?cer MC MAHON activated his emergency lighting equipment and siren and pointed his spot light at the subject. Of?cer MC MAHON states that the subject then stopped his bicycle just prior to Florida Street. Of?cer MC MAHON advised that when the subject stopped, he stopped on the sidewalk and bladed his stance to conceal the right half of his body behind a van, which was parked on the street. Of?cer MC MAHON stated that he thought this was odd. Of?cer MC MAHON then advised that he had just read an article that sent out by another of?cer about attacks on police of?cers and how subjects often blade their stance prior to attacks and he advised he was cognizant of that fact. When asked, Of?cer MC MAHON advised that he believed it was an article sent out by Of?cer MCCARTHY. Of?cer MC MAHON then he began talking to the subject. He introduced himself as Of?cer MC MAHON with the Vallejo Police Department and stated that his riding pattern was erratic. Of?cer MC MAHON then asked him to come over and sit in front of his car stating that the subject?s mannerisms were such that he did not want to leave the cover of his vehicle because he had a feeling that ?something?s not right.? Of?cer MC MAHON states that at that time, the subject immediately took ?ight headed northbound 011 Sonoma Boulevard. Of?cer MC MAHON got back into his patrol vehicle, noti?ed Dispatch that he had a suspect that was ?eeing from him on a bicycle and that they are now passing Carolina towards Florida. Of?cer MC MAHON indicated that the suspect was weaving in and out of traf?c on his bicycle. He states that they turned westbound onto Florida Street at which time the subject cut through the chru'ch parking lot on the (southwest) corner of Florida and Sonoma Blvd. Of?cer MC MAHON advised that he knew that he could not get his vehicle through there from prior experience so he drove down to Marin Street with his lights and sirens activated. Of?cer MC MAHON exited his patrol vehicle, went arormd the back side of his patrol vehicle and initiated a foot pru'suit with the suspect. Of?cer MC MAHON ordered the suspect to stop several times, stating, ?Hey, Police Department. Stop. You?re 1u1der arrest. Stop numing.? Of?cer MC MAHON advised that the suspect kept numing and he saw him reaching for his waistband. Of?cer MC MAHON advised he yelled at the subject ?Don?t reach for yoru' waistband. Get yoru' hands away from yoru? waist.? Of?cer MC MAHON believed that the suspect may be armed with a ?rearm or some other type of weapon, stating that he knows from his training and experience that when suspects um that they reach in their waistband to feel their weapon and make sru'e it is there. Of?cer MC MAHON advised that the suspect continued to disobey his orders. He stated that when he was approximately 10 to 15 feet away from the suspect he utilized his department issued taser in an attempt to apprehend the suspect. Of?cer MC MAHON states he ?red the taser at which time he knew that one probe stuck in the suspect?s back, but he does not believe the second probe made contact because the suspect was not incapacitated, which you normally see with a successful deployment of a taser. Of?cer MC MAHON advised that the suspect continued to mm, at which time Of?cer MC MAHON re-holstered his taser, continued to issue commands, such as, ?Hey, stop nmning. Police. You?re under arrest.? The suspect disobeyed and kept numing while looking back at Of?cer MC MAHON with his hands in his waistband. Of?cer MC MAHON indicated that he was still unsru?e if the suspect was armed. He stated that he was trying to get traf?c out on the radio, but he could not get his radio traf?c out based on other of?cers? radio traf?c. Of?cer MC MAHON advised that the suspect then turned southbormd in between houses indicating that there was a pathway between the houses that sloped down towards the alleyway. He described the area that the pathway went to as a foyer and then he described it as a small area with concrete, wood, and bushes. He states that as the suspect was rurming, the suspect fell, at which time Of?cer MC MAHON was able to catch up to him. Of?cer MC MAHON advised that the suspect got up, at which time he pushed him back down to keep him on the ground, stating that the suspect then fell down two or three stairs. Of?cer MC MAHON states that he got on top of him, stating ?Police. Keep your hands away from yoru? waistband.? Of?cer MC MAHON advised that the suspect was trying to get up and ?alligator roll? away from him. When asked what Of?cer MC MAHON meant by alligator roll, he stated that the suspect was trying to quickly turn to get 11p while Of?cer MC MAHON was next to him. Of?cer MC MAHON stated that he was telling the suspect to stay on the grormd and to show him his hands, but the subject was not listening to him. Of?cer MC MAHON advised that, at this point, he could see the suspect?s right hand, but could not see his left hand. Of?cer MC MAHON advised he, again, drew his taser believing that with the one probe in his back, perhaps, he could complete the circuit by drive struming and possibly incapacitating the suspect. Of?cer MC MAHON advised he utilized his taser and the taser was still ineffective and that the suspect continued to try to get 11p and resist. Of?cer MC MAHON advised that the suspect was yelling something along the lines of ?What the fuck? What are you doing?? or something to that effect. He stated he wanted to keep the suspect on the grormd and he still had no idea if the suspect was armed or not. Of?cer MC MAHON stated that he struck the subject several times with his ?ashlight. He stated he could not say how many times he struck the subject, but that it was no more than ?ve times. Of?cer MC MAHON states that the strikes on the suspect were also ineffective. Of?cer MC MAHON states that, at some point, the suspect was able to ?trun and stand up at the same time he ripped the ?ashlight from my hand.? Of?cer MC MAHON stated that, at that time, he recognized he was ?all out of options for the most part.? He reiterated that he tried his taser and that did not work; he had been in a foot pursuit; he was wrestling on the grormd with him; he was not obeying commands. Of?cer MC MAHON stated he feared for his life. Of?cer MC MAHON advised that he knows from his training and experience that if the suspect was to hit Of?cer MC MAHON in the head with his ?ashlight, he could be knocked unconscious, have his weapon taken ??om him and be killed with his own weapon. Of?cer MC MAHON fruther? advised that he knew that simply being hit in the head with his ?ashlight could lead to his death. Of?cer MC MAHON stated, ?Without even thinking about it, I had my ?rearm out.? He indicated that as subject was coming upwards with the ?ashlight, he discharged his fn'earm, ?eliminating the threat.? I asked Of?cer MC MAHON 110w many times he discharged his fn'earm and he stated warma say four or ?ve times, but I?m not exactly sru?e.? When asked what happened after that, Of?cer MC MAHON stated that the suspect dropped the impact weapon (the ?ashlight) and fell into the bushes and was motionless. Of?cer MC MAHON stated that he was able, at that point, to get his location out to Dispatch via radio. At this point, Of?cer MC MAHON became visibly emotional, his speech became choked up and his eyes began to water. I asked Of?cer MC MAHON if he needed to take a break. He advised he did not. I asked Of?cer MC MAHON what he thought would have happened if he did not fn?e his weapon and he replied, ?that he was gonna kill me.? Of?cer MC MAHON then stated his thought was ?Oh shit, this guy just took my light ??om me. We?re ?ghting and nothing I?ve used on him is working. He is gonna smack me in the head. He?s gonna take my grui and shoot me or he?s gonna beat me down with my own ?ashlight and there?s nobody here to help me and nobody knows where I?m at.? I asked Of?cer MC MAHON to go back to the beginning of the incident when he fn?st saw the suspect and describe what he looked like. Of?cer MC MAHON advised that the suspect was a black male adult, approximately mid-305. He was wearing a dark colored hooded sweatshirt, light jeans and he was on either a white or yellow bike. I asked Of?cer MC MAHON if he recognized the suspect and he advised that he did not. I asked Of?cer MC MAHON if, at any point drn'ing the incident, he recognized the suspect. Of?cer MC MAHON stated that he did not know who he was, he just wanted him to stop and talk to him about the safety violations. When asked, Of?cer MC MAHON indicated that the suspect was still on the bike, but he had both feet down. He could not see the suspect?s right hand because it was concealed by the van. He could see a portion of the left side of the suspect?s body. When asked what happened when Of?cer MC MAHON tried to talk to the suspect, Of?cer MC MAHON stated that the suspect bladed his stance, which was an indication to him that something was not right. He did not want to come over to where Of?cer MC MAHON was at and stated that he refused to listen to his orders to come out in front of his vehicle. Of?cer MC MAHON stated that he said, ?Hey look, I just wanna talk to you about some of his (your) bike riding actions.? Of?cer MC MAHON advised that the suspect was looking arormd, which he recognized to be pre-?ight indicators and then he did take off. Of?cer MC MAHON states he then got back into his vehicle. The vehicle lights were ah?eady activated and chased the suspect northbound on Sonoma. He states he updated Dispatch to what was going on. Of?cer MC MAHON advised the suspect turned west onto Florida Street, made a sharp southbound turn through the church parking lot. I reminded Of?cer MC MAHON that he mentioned that at some point the suspect fell off his bike. I asked Of?cer MC MAHON to talk to me about that. Of?cer MC MAHON stated that when the suspect was going through the parking lot, Of?cer MC MAHON drove to Marin Street in an effort to cut the suspect off. Of?cer MC MAHON advised he knew the area and he believed he knew where the suspect was going to go. Of?cer MC MAHON stated that when the suspect fell off his bike, it was on the north part of the sidewalk (on Carolina). Of?cer MC MAHON states he got out of his vehicle and went around the back of the vehicle and, at that point, the suspect had gotten up. I asked Of?cer MC MAHON if the suspect was riding on the sidewalk and he stated no, he had been riding in the middle of the street and then fell advising the suspect fell in ??ont of a parked car. I asked Of?cer MC MAHON where he was when the suspect fell off his bike. Of?cer MC MAHON indicated that he was behind the suspect. Of?cer MC MAHON stated that there was a parked car parked on the side of the street and the suspect fell in front of the car while Of?cer MC MAHON was towards the rear end of the car. Of?cer MC MAHON advised he got out of his vehicle and ran arorurd to the sidewalk because he believed the suspect was going to mm to the sidewalk but the suspect ran southbound. I asked Of?cer MC MAHON if he was still in his vehicle when the suspect fell off his bike and he stated he was. I asked how far away Of?cer MC vehicle was from the suspect at this time and he stated approximately 15 or 20 yards. I asked Of?cer MC MAHON if, at any point, did his vehicle come into contact with the suspect on his bicycle. Of?cer MC MAHON advised that it did not. I asked Of?cer MC MAHON which direction the suspect began running. Of?cer MC MAHON indicated that the suspect was rtmning westbormd, but was rurming across the street in a south to southwest direction. Of?cer MC MAHON states that he deployed his taser, which was ineffective. I asked Of?cer MC MAHON if he remembers where he was when he deployed his taser and he stated he did not. Of?cer MC MAHON then stated that he knows it was before he and the suspect went down the walkway of 415 Carolina. Of?cer MC MAHON states he remembers getting tangled up in the taser wires before the walkway. Of?cer MC MAHON advised that he saw one of the probes hit the suspect in his back, but he was not sru?e where the other probe went, but he knew the taser was ineffective based just on the sound the taser was making and the fact that the suspect was not incapacitated from it. I asked Of?cer MC MAHON to talk to me about his training in regards to the taser. Of?cer MC MAHON advised that at the three law enforcement agencies he has worked for, he has utilized the taser. He has had several taser deployments on suspects, indicating that some have been successful and some have not been successful. In each department where he carried a Taser, he was provided department training on it. Of?cer MC MAHON indicated that he recognized the taser was ineffective based on the loud ?clacking sormd? that it was making and the fact that the suspect was not immediately incapacitated. When asked what happened next, Of?cer MC MAHON indicated that the suspect was still grabbing for his waistband and looking back at him. Of?cer MC MAHON began thinking about What the suspect was trying to do. Of?cer MC MAHON thought the suspect might be reaching for a weapon. Of?cer MC MAHON indicated that because he could not get out on the radio what was happening as he was going down this pathway, his thought process was to take the suspect into custody and then let Dispatch know where he was. I asked Of?cer MC MAHON if the suspect was talking to him at this point and he advised he was not. I asked Of?cer MC MAHON if the suspect said anything to him up to this point and Of?cer MC MAHON advised nothing that he could remember. I asked Of?cer MC MAHON if the suspect said anything to him back at the van. Of?cer MC MAHON advised that the suspect said something, he could not remember what it was, but he thought it might have been something along the lines of, ?Man, stop messing with me.? I asked Of?cer MC MAHON what happened as they were running southbound down the walkway of the house and Of?cer MC MAHON advised that they came to an area which he referred to as a foyer. He described it as a small enclosed area with bushes. I asked Of?cer MCMAHON if it was fair to call it a corutyard and he advised that it could be a corutyard, stating it was tight quarters. He stated that other than that, it was dark and that he did not see any other lighting whatsoever. I asked Of?cer MC MAHON if there was any reason why he didn?t activate it earlier. He replied that there was a lot of stuff going on. He said that while chasing the suspect, he was using his left hand to deploy the Taser. He then replied there was a lot going on. Located in Foster?s right pant coin pocket were two plastic bindles. These bindles were located by Assistant Caputo and provided to me. One bindle had a white powder in it and the second had clear Two pieces of Mamba candy were located in Foster's left front pocket. Clear colored stone earrings were removed from Foster?s left and right ears and I collected them. A gold colored necklace with medallion was removed by Dr. Josselson and I collected it. A vial of blood was given to me by Assistant Caputo. Six bullets were located and I collected the bullets. The bullets were located in Foster?s right sweatshirt sleeve, right shirt, on the table near Foster?s left neck, right chest cavity, left chest cavity and right temple. I then r?etruned to the Vallejo Police Department where I attended a brie?ng and was assigned to Team consisting of Det. Greenberg and DAI Rister. Team was assigned to interview Of?cer Bahou. Blain and interview the Suspect's child's mother I called- and brie?y spoke with her 011 the phone. She agreed to conre the Vallejo Police Department to be interviewed. - never came. I called her numerous times and she refused to answer my calls. I was present in the interview room when Balrou and Blain were interviewed. Refer to supplements for fruther. On 02/ 14/ 18, Det. Greenberg and I spoke with Vallejo Fire?ghter- -) at Station 21. is assigned to Engine 21. In regards to the incident in question, he responded the 415 Carolina Street regarding a possible shooting where there were possibly multiple casualties. When he arrived on scene, he noticed the Suspect was laying on his side and handcuffed behind his back. He noticed the Suspect had what appeared to be two gunshot wormds to his front chest area and one to the back. He noticed there were chest seals placed over the wounds. He attached a cardiac monitor to the Suspect and con?rmed the Suspect had no heart - pronounced the Suspect deceased at 1951 horu?s. When- was tending to the Suspect. he noticed there were items of evidentiary value around the Suspect. He advised he did not disturb or touch any evidence. Detective RODRIGUEZ advised he had no further info at that time and advised that this was going to be a call out. I responded to the area of the 400 block of Carolina. I made contact with detectives already on scene. I was advised that the suspect was identi?ed as Ronnell FOSTER. I learned that the scene was located behind 415 Carolina. As I made my way into the rear of 415 Carolina, which is a multiunit apartment complex, I observed taser wiring on the ground along a wooden pathway deck that proceeded south. As I continued, I observed the wooden deck come to an end and several steps down into a concrete alcove area. I observed multiple evidence placards in the area. I observed the deceased lying on the ground with a yellow tarp over him. I went to Carolina which is located next to 415 Carolina to the west. I spoke with a and her mother, at this location. I learned that both females were cooperative and advised them to stay in their house and some of?cers would come speak with them regarding anything they saw or heard. Both females agreed and waited. Both females were later contacted by Vallejo Police. See additional reports for their statements. I learned that a witness by the name of had been transported to the Vallejo Police Department. He stated that he had been a LA Police Commissioner?s Of?ce Locksmith. He advised that during his time there of ten years, he would accompany the Los Angeles Police Department and various other agencies, such as DEA and the Sheriff?s Of?ce, on warrant services and evictions. He said his primary role as a locksmith was to open the doors and then once the scene was secured open any safes or things that require locksmith abilities. He said he is especially trained for this job. He advised that he did carry a ?rearm during this time and wore a bullet proof vest. He described one incident in which he had been shot at through the front door while trying to lock pick it. He advised that he went through a training program for this that took three months and required him to qualify with his ?rearm twice a year. He advised he has also worked other jobs in the past, which included working at Genetech at one time. He advised he has lived at- Carolina Street, I, for approximately 17 years. He advised that for approximately the last ten years, the complex has been having problems with the neighbors west of them which is also an apartment complex. He advised that he manages the complex he lives in for a person named - who he later identi?ed as He advised that the problems with the tenants across the yard have been going on for a long time, so he is constantly on the lookout for any problems. He stated he often has his front door opened because he is a smoker and that his front door was opened on this date. advised that on this date, he heard the of?cer coming down the walkway yelling ?stop, stop He stated that he saw a person come down the steps and that the of?cer was pursuing him. He advised this was a pursuit situation and described them as being in pursuit mode and later stated that the way the of?cer was hollering stop, you could tell something was happening. - described the walkway as a wooden deck with wood planks. He stated that it came from Carolina Street and down into the backyard where it then goes down some steps onto some concrete in an alcove. He advised that he saw the suspect come down the steps into the concrete alcove and that he was ?ghting with the of?cer and resisting the of?cer. - later indicated the he had direct view of the incident. - stated that he heard the of?cer giving commands to turn around, give me your hands, get down, stop. -advised that the suspect was yelling at the of?cer, although he did not know what the suspect was saying. He described the suspect?s tone of voice as angry and aggressive. He advised that the of?cer tried to handcuff the suspect, but that the suspect pulled away from the of?cer, struggling with him. He stated that the of?cer then ?red at the suspect approximately ?ve times. advised the of?cer gave the suspect every opportunity to comply. - stated he believed the of?cer was justi?ed in what he did because the suspect was coming at him. - advised he knew the police of?cer was a police of?cer because he observed that the of?cer was wearing an of?cer?s uniform, had a ?ashlight and a taser. further advised that he had never seen this of?cer before and did not know him. I asked about the suspect, and he stated that he had never seen the suspect before and did not know him. -advised that he did not see what happened to the flashlight or the taser after the shots were ?red. He advised that he recognized the sound of a taser and that he use to sell tasers. - stated that the of?cer tried to do everything he could to restrain the suspect. He indicated that the of?cer did not have any other choice but to shoot the suspect. He stated the suspect was willing to do anything to get away. indicated that if the of?cer had not shot the suspect the of?cer would have been in trouble. indicated that the of?cer could have been injured and believes the of?cer?s life was in danger. - stated that you could tell the suspect was not going to back off. - stated that the of?cer took every opportunity to restrain the suspect and had no choice but to take the action that he took. - advised that although some of the complex has signs stating there is video surveillance, there are in fact no cameras on the scene. - described the people that live in the apartments west of his apartment and provided their names and contact information of the ones he had. - advised that the incident began during the nighttime and that it was dark. He stated that when the incident ?rst occurred, when he ?rst heard the of?cer yelling stop, he could tell there was some kind of pursuit happening. He heard the of?cer say get down, get down, but stated the suspect would not get down and went at the of?cer. After the incident occurred, - asked the of?cer if he was okay. - then advised the of?cer that he could open the gate to the alley. stated that he believed the of?cer was talking on his radio, trying to direct people to him. advised the of?cer that if you open the gate people would be able to come through it, and the of?cer told him to open the gate, which he did. I observed that the residence had fom? Video cameras. Three of the cameras pointed toward Sacramento St. One camera on the northwest corner of the residence pointed toward the 400 block of Carolina. T71 I contacted resident at the house and he allowed me to download the camera which faced rv Carolina St. I was able to down load one how of Video. It should be noted that the date was c01rect but the time stamp was forward by 2 hom?s and 12 minutes. The incident began at 1940 which would have been 2152 hom's on this system. I downloaded video from 02-13-18 from 2100 to 2159 hom's. I reviewed the video and did not obseive anything of evidentiary value. I did observe police cars arriving to assist however I did not observe any of the foot pln'suit/ incident 011 the video. The video is of poor quality. Of?cer McMahon was removed from the scene and transported to the Vallejo Police Department. I ?rst responded to the scene at 415 Carolina Street in the city of Vallejo. I entered the scene through Kissell Alley. The scene was in an open area behind 415 Carolina Street (southern direction). Upon entering the back of the scene, 415 was marked on the fence in the alley. I walked north down a walkway with a fence to the west and a building to the east. At the end of the walkway was a shed with the letter A in the top right corner of the doonNay. Stairs to the east of the shed were photographed. A covered patio was east of the shed along with a walkway in between the shed and the covered patio. North east of the shed was FOSTER. He was covered with a yellow blanket. Short ?patrol? placards were placed around FOSTER. I later replaced these placards and my report will refer to the placards that I placed at the scene. Seven patrol placards were located on the north east end of the shed. Wooden stairs north of the shed were noted with chipped red paint. These stairs led to a cement walkway which led to the west side of 415 Carolina Street and ultimately led out to the street. Patrol placards were also noted in this walkway. I photographed the scene and was then asked to respond to the Vallejo Police Department for a brie?ng and to photograph Of?cer McMahon. After the brie?ng, Corporal Botello, DAI Dillion and I met with Of?cer R. McMahon. He was wearing a Vallejo Police Department uniform with a long sleeve shirt and a fully equipped duty belt. I photographed McMahon in uniform and then requested that he remove his duty belt. He placed his duty belt on a table in which his duty weapon was removed and photographed. After photographing McMahon?s duty weapon, his weapon was rendered safe by Corporal Botello and packaged for evidence. Of?cer McMahon?s duty weapon is a Glock 21 45 caliber handgun, serial number -. Five live rounds were located in McMahon?s magazine. One live round was located in the chamber of the gun. Of?cer McMahon had three fully loaded magazines on his duty belt. Of?cer McMahon?s Taser was photographed with number_ noted on the interior of the Taser. I collected Of?cer McMahon?s Taser for evidence. The items marked with these placards were collected by me prior to processing the scene on Carolina Street. Prior to the arrival of the Solano County Coroner's Of?ce, I photographed FOSTER. He was lying on his right side. His blue jeans with a belt were down close to his knees. He was wearing red plaid boxers and I noted a black sweatshirt. A bloody tank top was noted under black sweatshirt. FOSTER was wearing blue Nike shoes. Some contents were removed from his person prior to my arrival to include a bottle of Neosporin, a Mamba wrapper, a package of green Now Later, ?ve yellow Mamba?s, a container of Carmex, an orange Now and Later package, a small bag of suspected marijuana, a small container with a yellow substance and a glass pipe with a bulbous bottom which appeared to be burned. I collected these items. Foster was handcuffed prior to my arrival. Upon the arrival of Deputy Coroner Smith, the handcuffs were removed and I collected them in order to return them to Of?cer Blain #642. With Deputy Coroner Smith?s permission, I processed FOSTER for GSR on his left and right hand. I swabbed left and right hands. I also obtained a buccal swab from FOSTER and swabbed his face. FOSTER was placed in a white sealed body bag which contained blue seal #136649 and Solano County Coroner?s case number 2018-0159. The bag was sealed at 0218 hours on February 14, 2018. Corporal Botello indicated there was additional evidence on Carolina Street. After processing the scene to the back of 415 Carolina Street, I responded to Carolina Street where I photographed and collected evidence on the street. We responded to 448 Carolina Street, Vallejo Bible Church. The church is located on the corner of Marin and Carolina Streets. Lt. Iacono requested that I call out Senior Police Assistant Stephanie Dailey #2053 and that we respond to the . scene. :1 I responded to the scene at 415 Carolina Street. I accessed the scene through Kissell Alley and met with Senior P.A. Dailey who responded to the scene and was taking overall photographs. I advised her of a brie?ng at the Vallejo Police Department, and when she ?nished we responded to the Police Department for the brie?ng. A At the brie?ng, District Attorney Investigator Aaron Dillon was assigned to assist Senior P.A. Dailey and me with Evidence Processing. Prior to responding to the scene again, Senior P.A. Dailey, DAI Dillon and I met with Of?cer McMahon #702 to photograph him, collected his duty weapon and his Taser. A Corporal Botello, DAI Dillon, and I responded to the scene and completed processing, to include Solano County Deputy Sheriff/ Coroner Smith taking possession of FOSTER. After processing the scene, I responded to the Vallejo Police Department Evidence Section to book the property in this case. .1 EVENT DESCRIPTION On February 13, 2018 at approximately 1940 hours, Of?cer McMahon was involved in a foot pursuit which led to an Of?cer involved shooting. I entered the scene through Kissell Alley. The scene was in an open patio area behind 415 Carolina Street (southern direction). Upon entering the scene from the alley, 415 was marked on the fence in the alley. I walked north down a walkway with a fence to the west and a building to the east. At the end of the walkway was a shed with the letter A in the top right corner of the doonNay. Stairs to upper unit were to the east of the shed. A covered patio was east of the shed along with a walkway in between the shed and the covered patio. North east of the shed was FOSTER. He was covered with a yellow blanket. Short ?patrol? placards were placed around FOSTER indicating items of evidence marked by Patrol. These placards were later replaced by our own evidence placards and re?ected in RA. Dailey?s report. Wooden stairs north of the shed were noted with chipped red paint. These stairs led to a cement walkway which led to the west side of 415 Carolina Street and ultimately led out to the street. Patrol placards were also noted in this walkway. Senior P.A. Dailey photographed the scene and then I asked her to respond to the Vallejo Police Department for a brie?ng and to photograph Of?cer McMahon. After the brie?ng, Senior P.A. Dailey, DAI Dillion and I met with Of?cer R. McMahon. He was wearing a Vallejo Police Department uniform with a long sleeve shirt and a fully equipped duty belt. Of?cer McMahon was photographed in full uniform, and then requested that he remove his duty belt. He placed his duty belt on a table in which his duty weapon was removed and photographed. After photographing Of?cer McMahon?s duty weapon, his weapon was rendered safe by myself and packaged for evidence. Of?cer McMahon's duty weapon is a Glock 21 .45 caliber handgun, serial number -. Five live rounds were located in Of?cer McMahon?s magazine. One live round was located in the chamber of the gun. Of?cer McMahon had three fully loaded magazines on his duty belt. Of?cer McMahon?s Taser (X-26P) was photographed with number noted on the interior of the Taser. Of?cer McMahon?s Taser did not have a live cartridge in the Taser upon removing it from its holster. I collected Of?cer McMahon?s Taser for evidence. The items remaining on Of?cer McMahon?s duty belt and the belt was returned to Of?cer McMahon. Senior P.A. Dailey, DAI Dillion, and I then respond back to the scene. Senior P.A. Dailey then began to place my yellow, tented placards near items of evidentiary value and photographed the property with both my placards and patrols placards. She then removed the patrol placards and her report will refer to the tented placards that she placed at the scene. Placards 3 through 8 marked expended .45 Auto casings. Placard 9 marked a Taser dart. Placard 10 is an expended bullet. Placard 11 is Taser cartridge and placard 12 is an expended casing. Prior to the arrival of the Solano County Coroner?s Of?ce, Senior P.A. Dailey photographed FOSTER. He was lying on his right side. His blue jeans with a belt were down close to his knees. He was wearing red plaid boxers and I noted a black sweatshirt. A bloody tank top was noted under black sweatshirt. FOSTER was wearing blue Nike shoes. Some contents were removed from his person prior to my arrival to include a bottle of Neosporin, a Mamba wrapper, a package of green Now Later, five yellow Mamba?s, a container of Carmex, an orange Now and Later package, a small bag of suspected marijuana, a small container with a yellow substance and a glass pipe with a bulbous bottom which appeared to be burned. Senior P.A. Dailey collected these items. Foster was handcuffed prior to our arrival. Upon the arrival of Deputy Coroner Smith, the handcuffs were removed and they were collected in order to return them to Of?cer Blain #642. With Deputy Coroner Smith?s permission, P.A. Dailey processed FOSTER for GSR on his left and right hand. P.A. Dailey also swabbed left and right hands, and obtained a buccal swab from FOSTER and swabbed his face. FOSTER was placed in a white sealed body bag which contained blue seal #136649 and Solano County Coroner?s case number 2018-0159. The bag was sealed at 0218 hours on February 14, 2018. I advised Senior P.A. Dailey that there was additional evidence on Carolina Street. After processing the scene to the back of 415 Carolina Street, P.A. Dailey responded to Carolina Street where she photographed and collected evidence on the street. P.A. Dailey and DAI Dillon responded to 448 Carolina Street, Vallejo Bible Church. The church is located on the corner of Marin and Carolina Streets. (V) Of?cer McMahon?s vehicle was parked in the middle of the street facing west on Carolina Street. Of?cer McMahon?s vehicle number was 160. The vehicle was secured prior to my arrival. A set of ear phones was located near the corner of Carolina and Marin Streets. The ear phones were marked with Placard 21. A key was located on the north sidewalk of Carolina Street. The key was marked with Placard 20. Placard 19 marked a blue lighter. Placard 18 marked a black cell phone. Placard 17 marked a white bicycle with head phones. North east from the street, a black and red baseball cap was located. The baseball cap was marked with placard 16 (in front of vehicle Lic# -) in the gutter in front of 421 Carolina Street. In the middle of the street of the 400 block of Carolina Street was a green door to a Taser. This item was marked with placard 15. The video is 4 minutes in length. Per the time stamp, recording starts at 1940:48 hours. The following are my observations from the video. Times referenced in this supplement will be in relation to the beginning of the video, 00:00 (0 mintues 0 seconds). All times referenced are approximate. As the video starts, the suspect appear to be laying on his left side 011 the ground. Light from Ofc. McMahon's taser is seen in the left side of the frame. 00:03 Ofc. McMahon removes the cartridge from his taser. Ofc. McMahon is holding the taser in his left hand. Ofc. McMahon's ?ashlight is in his right hand. The head of the ?ashlight is oriented down. 00:07 8- Foster appears to turn to get up, his torso coming off the gIorurd. Ofc. The report concerns the processing of Of?cer McMahon's ?ashlight (662-1) for latent ?ngerprints. Prior to the latent print processing, sample swabs were collected from the textru'ed sru'face of the ?ashlight for later DNA processing. These swabs were saved as SMC item# 189237. Latent prints were located and photographed and compared to the ?ngerprint record of S-Foster. The results of the comparison were inconclusive due to the quality of the latent impressions. There were no rv latent impressions suitable for searching in the AFIS database. T71 On 1-17-2019, I received San Mateo orurty Crime lab report M18-00819-3 dated, 10-31-2019. This report concerns the DNA processing of the sample swabs (SMC 189237) collected from Of?cer McMahon's ?ashlight prior to the latent ?ngerprint processing. The report indicates that tln?ee low-level alleles were developed ?'om which no conclusions can be drawn. The sample did not contain enough information for entry into ODIS. NFI. Of?cer Blain said that the of?cer (referring to Of?cer Ryan McMahon) attempted to make a bicycle stop but the rider failed to yield. Of?cer Blain said Of?cer McMahon stated that they were westbound on Florida Street and ?that was it for the moment", meaning no more radio updates were provided. Of?cer Blain said the next thing they heard on the radio was ?shots ?red?. Of?cer Blain said there was some confusion about Of?cer McMahon?s location. Of?cer Blain said originally, they were directed to the alley south of 415 Carolina Street. Of?cer Blain said there was a patrol unit in front of them as they turned westbound into said alley. Of?cer Blain said she then saw an adult white male opening the side of a fence and he directed them to Of?cer McMahon. The clothing on the body consists of a pair of blue jeans with a black belt at the level of the mid?thigh, a black tennis shoe and white sock on the left foot, 3 black hooded sweatshirt that says ?California? on the front, a pair of plaid red boxer shorts, a black t-shirt and a white undershirt. A matching shoe and a black sock are submitted with the body. The left ear is pierced and there is a white metal stud with a large clear stone through the piercing. The right earlobe is pierced as well and a matching earring is found in the body bag. Around the neck is a gold-colored necklace with a gold?colored pendant. The body measures 5?11" and weighs 169 pounds. The head is symmetrical. The scalp is covered with short black hair of normal male distribution. There is a beard and mustache. The face is symmetrical. The irides are brown, and the pupils are round and equal. The sclerae and conjunctivae are clear. The external ears, nose and lips are normally developed. There is no evidence of fracture or hemorrhage of the nose or mouth. The buccal mucosa and tongue show no lesions. The teeth are intact and in adequate repair. The ears reveal no evidence of trauma or hemorrhage. The neck is symmetrical and the trachea is palpable in the midline. The chest, abdomen, back, upper and lower extremities are normally developed. The abdomen is protuberant, and there are no visible abdominal scars. The external genitalia are those of a normal adult male. There are no needle tracks in the antecubital fossae. The entry defect is located on the posterior mid left forearm at a point 30 cm above the fingertips. The entry defect is oblong measuring 2 cm. The bullet passes through the left forearm, fracturing the ulna, and exits on the posterolateral left elbow 47 cm above the fingertips. The exit defect measures 2.5 6 cm. The bullet then briefly passes through the skin of the posterolateral left elbow just 4 cm above the previously- described exit leaving a 5 cm round defect. Three other bullets are recovered outside the body; one on the right sleeve of the sweatshirt, one from the right side of the t?shirt, and one lying freely in the body bag adjacent to the left side of the neck. All three bullets are copper-jacketed, large caliber, mushroomed projectiles. EXAMINATION The body is examined using the thoraco~abdominal and posterior scalp incisions. HEAD: The reflected scalp shows several contusions in the midline from the frontal area to the vertex, and a 10 cm contusion in the left occipital scalp. The calvarium shows an entry defect approximately on the left side of the vertex. There is a large linear fracture extending anteriorly and a large linear fracture extending posteriorly from this entry defect. The base of the skull is unremarkable. The left temporal muscle shows hemorrhage. On removal of the calvarium, there is no evidence of epidural, subdural, or subarachnoid hemorrhage. The leptOmeninges are thin and delicate. The tentorium, cerebellum, and falx are intact. The vessels at the base of the brain have a normal configuration and show no atherosclerosis. The brain is symmetrical and weighs 1458 grams. The convolutionary pattern is smooth and symmetrical. There is no evidence of herniation or softening. Multiple coronal sections show the previously?described wound path through the brain. The cerebellum, mid-brain, and medulla show no abnormalities. The dura is stripped and reveals linear fractures in the left posterior and right posterior cranial fossae, a fracture of the right orbital roof, a fracture and an exit defect in the lateral right middle cranial fossa. The left orbital roof is intact and unremarkable. The aorta shows a normal pathway without arteriosclerosis, and the two previously-described gunshot wounds. RESPIRATORY SYSTEM: The larynx and trachea are intact. The right lung weighs 256 grams and the left lung weighs 242 grams. The trachea?bronchial tree follows its normal anatomic pathway and contains blood. The intrinsic pulmonary vessels are patent and reveal no thromboemboli. There is congestion in all lobes of each lung. The cut surface discloses the previously~described gunshot wounds to each lung. GASTROINTESTINAL SYSTEM: The tongue, esophagus, stomach, small intestine and colon are unremarkable. The appendix is present. The contents of the stomach consist of a moderate amount of partially digested food with no identifiable pills. SYSTEM: The 1422 gram liver has a normal size and shape. There is a gunshot wound through the right lobe. it has a normal consistency and a normal red?brown color throughout. The cut surface of the liver shows no focal lesions. The decedent was wearing a sweatshirt, t-shirt, boxers, jeans, a belt shoes and socks. Rigor mortis was present. Post mortem lividity was present and consistent with the decedent?s position. I took numerous photos of the decedent and the scene. The handcuffs were removed from the decedent. 021418 0218 hours: I had the decedent?s body bag sealed with blue Coroner seal #136649 at 0218 hours. I took two additional photos of the seal and later entered all of the images into the digital database at the Sheriff? 5 Of?ce. J. Morris personnel transported the decedent to the County morgue. 021418/ 0 30 hours: received a phone call from a Vallejo Police Investigator stating the decedents mother, was at the lobby of the Vallejo Police Department and had been noti?ed of the death. They gave her my phone number and stated I would speak with her in the morning. Later in the day, I met with-outside the Coroner's Of?ce. I spoke with her and gave her some suggestions regarding ?nal disposition. I left her with other members of her family and encouraged her to contact me if she needed and assistance. 021418\ 1300 hours: 1 took numerous x-rays of the decedent prior to the autopsy. 021518 0824 hours: Caputo, Forensic Technician, cut the seal on the decedent?s body bag and readied him for examination. Dr. Arnold Josselson, Forensic Pathologist, performed an autopsy on the decedent and determined the cause of death was due to multiple gunshot wounds.
