Judgment ?led by all parties in this case. After considering the motions, the
responses, the law, the admissible evidence, and the arguments of counsel, the
Court is of the Opinion that:

The Houston Police Of?cer?s Union Motion is granted;

0 The City Of Houston?s Motion is granted; and

The Houston Professional Fire Fighters Association, IAFF Local 341?s
Motion is denied.

Therefore, the Court declares that:

1. Proposition B, which amends and adds Section 24 to Article IX of the
Houston City Charter, is preempted in its entirety by Chapter 174 Of
the Texas Local Government Code.

2. PrOposition B, which amends and adds Section 24 to Article IX Of the
Houston City Charter, is unconstitutional and void in its entirety
because it violates article X1, section 5 of the Texas Constitution.

All relief not granted herein is denied. This is a ?nal judgement disposing
Of all issues and it is appealable.
