Soto TRIBES’ MOTION FOR PRELIMINARY INJUNCTION Case 4:17-cv-00475-JAS Document 200 Filed 05/15/19 Page 2 of 4 1 2 3 4 Pursuant to F.R.C.P. 65, the Tohono O’odham Nation, Pascua Yaqui Tribe, and Hopi Tribe (collectively the “Tribes”) respectfully request a preliminary injunction to prevent the Rosemont Copper Company (“Rosemont”) from undertaking any ground- 5 disturbing activities approved by the Forest Service in its June, 2017 Record of Decision 6 or pursuant to Rosemont’s March 20, 2019 revised Mine Plan of Operations. 7 The Tribes have established that they meet all four prongs of the preliminary 8 9 injunction test, as demonstrated in the attached Memorandum in Support of Motion for 10 Preliminary Injunction and supporting declarations. Specifically, they have demonstrated 11 (1) a likelihood of success on the merits; (2) that they are likely to suffer irreparable harm 12 13 in the absence of injunctive relief; (3) that the balance of equities favors an injunction; 14 and (4) that an injunction is in the public interest. Winter v. Nat. Res. Def. Council, Inc., 15 555 U.S. 7, 20 (2008). Alternatively, they have raised “‘serious questions going to the 16 merits’” and that the equitable factors weigh in their favor. All. for the Wild Rockies v. 17 18 Cottrell, 632 F.3d 1127, 1135 (9th Cir. 2011).
