Re: Internal Affairs Complaint Against Of?cer David McLaughlin

To Whom It May Concern:
This of?ce, along with the Law Of?ce of Joseph S. May, represents Mr. Santiago Hutchins.

On August 1 l, 2018, Vallejo Police Department Of?cer David McLaughlin, who apparently was
off duty and not in uniform at the time, drew his ?rearm and held Mr. Hutchins at gunpoint. This
occurred outside of Rocco?s Ristorante Pizzeria, located at 2909 anacio Valley Road, in Walnut
Creek, CA. Subsequently, while Mr. Hutchins was on the ground, Of?cer McLaughlin used
unreasonable and excessive force upon Mr. Hutchins, in?icting serious injuries. Exerting his
authority as a police of?cer, McLaughlin then caused Mr. Hutchins to be arrested by the Walnut
Creek Police Department. The incident is believed to have been logged by the Walnut Creek
Police Department under Incident 18-26344.

Please consider this letter a formal internal affairs complaint regarding the unlawful conduct of
Of?cer McLaughlin described above. We respectfully request that the Vallejo Police Department
engage in a formal investigation and take any appropriate actions to address this matter.
However, please instruct your IA investigator to refrain from contacting our client, Mr. Hutchins,
directly; any communication regarding this matter, in writing, by phone, or otherwise, must be
directed to my of?ce, or Mr. May?s Of?ce (415.781.333) only.
