Hambleton Total deputies using force: 3 Report #17-015681 On September 7, 2017, about 0737 hours, the suspect was arrested for battery on a John George staff member. The suspect was subsequently transported to SRJ. While being transported to SRJ, the suspect made multiple threats to assault staff. Once at SRJ, the suspect had calmed down and was able to be escorted to the ITR booking counter without incident. Once at the booking counter, the suspect attempted to break away from Deputy Krause’s grasp, and then kicked Deputy Krause in his right shin. Deputy Krause used a hair-pull takedown and took the suspect to the floor, where her head struck the ground. Ground control and compliance techniques were used by multiple deputies in order to prevent the suspect from further assaulting deputies and to place her in the WRAP. No deputies suffered any injuries during the incident. The suspect suffered a 4 inch laceration to the top of her head, as well as a muscle strain in her neck. She was transported and treated at Valley Care Medical Center where she received 8 staples to treat her laceration. The Use of Force was in compliance with General Order 1.05. The Use of Force was prompted by the suspect attempting to break away from and assaulting Deputy Krause. Once controlled by deputies, the suspect still assaulted deputies by trying to head butt them. The incident was debriefed in a subsequent muster. About half way through the incident, Deputy Swalwell noticed Deputy Krause’s VieVu was displaying a red light, indicating either the memory was full or the battery was out. At this time, Deputy Swalwell gave Deputy Krause his VieVu to use for the remainder of the incident. It is for this reason, Deputy Krause does not have VieVu footage of the incident. It should be noted, in several other VieVu footages, Deputy Krause is making a conscious effort to capture the incident on his VieVu by holding it up for a better view. The problem was it was not recording. Deputy Krause has been counseled about having a better awareness of the status of his VieVu camera and downloading the videos more frequently. Deputy Krause understood the importance of maintaining a working VieVu and has since remedied the issue. I also advised Deputy Krause to take photographs of the suspect’s injuries after it gets cleaned up, but before it gets bandaged. Deputy UOF on uncooperative battery suspect who continued threats of violence during transport. At SRJ the suspect initially cooperated and then tried to pull away from the deputy and then mule kicked the deputy in the shin. Deputy used used a leg sweep take down to take suspect to the ground and control her. Suspect received a head laceration from hitting the ITR floor. Suspect medically treated and cleared for incarceration. UOF was within policy however I had Lt. Schellenburg counsel Deputy Krause about the responsibilities and consequences of using force.
