The jury returned guilty verdicts on 34 multiple counts of the indictment, including counts alleging aggravated murder, attempted murder, aggravated robbery and associated firearm specifications in connection with two shootings. I sentenced the defendant, the fifth ranking member of a dangerous gang, the Heartless Felons, to life imprisonment without the possibility of parole, plus twenty years. Upon appeal, the Eighth District Court of Appeals affirmed the defendant's convictions and sentences in all respects, except the $2,880 amount in restitution that I had ordered the defendant to pay to compensate the family of the deceased victim for funeral expenses. As a matter of course, I maintain copies of opinions from the Comi of Appeals, whether affirming or reversing my decisions. So, in compiling the lists below, I relied upon a review of the hard copies of decisions maintained by me. Otherwise, I know of no way to actually track this information. Criminal Cases (Please note that for these cases, there is no underlying written opinion authored by me. I have included the reference to the appellate decision.): State v. Westfall, 2015 Ohio A.PP· LEXIS 148 (Ohio Ct. App. Jan. 22, 2015). The defendant was convicted of attempted murder, felonious assault, and domestic violence. The convictions were affirmed by the appellate court but the case was remanded for resentencing. The comi held that attempted murder and domestic violence were allied offenses of similar import, committed through a single course of conduct and with a single state of mind, and therefore, the offenses were subject to merger under an Ohio statute. On remand, a sentence was imposed for attempted murder only. State v. Brooks, 2014 Ohio App. LEXIS 3826 (Ohio Ct. App. Sept. 11, 2014). The sentence following a criminal conviction was reversed and remanded for resentencing. Although the trial comt found that consecutive terms were necessary to protect the public, and that the harm defendant caused by the offenses was so great or unusual that no single prison term reflected the seriousness of his conduct, it made no proportionality finding. On remand, a sentence was imposed that included a propo11ionality finding so as to impose consecutive terms. State v. Walker, 82 N.E.3d 1124 (Ohio 2016). In a 4-3 opinion, the Ohio Supreme Court held that the appellate court properly reversed defendant's aggravated murder conviction due to the State's failure to show the separate statutory element of prior calculation and design, because it appeared that the shooting occurred from a spontaneous eruption of events and there was no evidence that defendant and the victim knew one another or that he had considered the murder site ahead of time. On remand, the defendant was resentenced on his remaining convictions, to include murder. State v. Buckwald, 2014 Ohio App. LEXIS 189I (Ohio Ct. App. May 8, 20I4). The Court of Appeals voided the defendant's classification as a tier III sexoffender under the Adam Walsh Act and remanded the matter to the trial court for 44 a classification hearing in accordance with Megan's Law (the law in effect at the time the offense was committed). State v. Tatum, 2014 Ohio App. LEXIS 386 (Ohio Ct. App. Feb. 6, 2014). The Court of Appeals held that the trial court's decision to limit Tatum's closing argument affected the jury's determination on the key issue of credibility. Judgment reversed and convictions were vacated. In lieu of another trial, the defendant plead guilty and was sentenced. State v. Kemp, 2014 Ohio App. LEXIS 3347 (Ohio Ct. App. Aug. 7, 2014). Although the defendant's attorney had waived the defendant's personal appearance in court, the Coutt of Appeals held that the trial court erred by resentencing defendant by video conference because he was not physically present in the courtroom. The case was reversed and remanded for resentencing of defendant while he was physically present in the.cou1troom. State v. Redd, 2012 Ohio App. LEXIS 4704 (Ohio Ct. App. Nov. 21, 2012). The appellate court held that the trial court could not sentence the defendant to community control and prison for the same offense. The case was remanded for resentencing, the defendant was resentenced, and that resentencing was affirmed by the Eighth District Court of Appeals. State v. Shabazz, 2014 Ohio App. LEXIS 1793 (Ohio Ct. App. May 1, 2014). The trial court's decision was affirmed in part, vacated in part, and remanded for resentencing. Defendant's jury conviction for aggravated murder was reversed, because there was no evidence of prior calculation and design, or that defendant was aware that the shooter had a gun. There was sufficient evidence to support two of the counts for felonious assault. The defendant was resentenced, and that resentencing was affirmed by the Eighth District Court of Appeals. State v. Ross, 2013 Ohio App. LEXIS 3176, (Ohio Ct. App. July 18, 2013). The convictions were affirmed, but the matter was remanded for resentencing because the trial court did not conduct the appropriate analysis required under R.C. 2929.14(C) when it imposed consecutive sentences. The defendant was resentenced and that resentencing was affirmed by the Eighth District Court of Appeals. State v. Bryant, 2015-0hio-3678, 2015 Ohio App. LEXIS 3586 (Ohio Ct. App. Sept. 10, 2015). The trial court erred by not terminating defendant's post-release control under R.C. 2967.28 because the 2004 sentencing entry did not set forth the consequences for violating post-release control, and defendant completed his sentence. The judgment was reversed and remanded. State v. Curlee-Jones, 2013-0hio-1I75,2013 Ohio App. LEXIS 1069 (Ohio Ct. App. Mar. 28, 2013). The jury convictions for one count of tampering with evidence and two counts of assault on a police officer were reversed, and the case 45 was remanded for the trial court to vacate those convictions. The judgment of the trial court was otherwise affirmed. State v. Nitsche, 66 N.E.3d 135 (Ohio Ct. App. 2016). The trial court's judgment was affirmed as to defendant's convictions, but the matter was reversed in part and remanded for further proceedings with respect to the restitution order for funeral expenses of victim. The Court of Appeals remanded the case to me for consideration of the defendant's present and future ability to pay the amount ordered in restitution. Upon remand, 1 conducted a hearing and based upon evidence adduced at the hearing, determined that the defendant did not have the present or future ability to pay restitution. State v. Rogers, Nos. CR-11-552699, CR-11-544682, CR-11-545992, CR-11553547, CR-11-553806, CR-11-556821, CR-11-555183, and CR-11-557079 (Ohio Corn. Pl. Mar. 7, 2012), aff'd in part, rev 'din part, and remanded, 2013 Ohio App. LEXIS 3323 (Ohio Ct. App. July 25, 2013), reversed and trial court's judgment reinstated, 38 N .E.3d 860 (Ohio 2015). The trial court's judgment was affirmed in part, reversed in pai1, and remanded with instructions to establish the underlying facts of the defendant's conduct in CR-545992 and to determine whether the subject crimes should merge for sentencing purposes. The appellate court certified a conflict between its decision and the Sixth District's decision in State v. Wallace, 2012-0hio-2675. The Ohio Supreme Court determined that a conflict existed and reversed the Eighth District Court of Appeals' decision and reinstated the sentences imposed by the trial court. Civil Cases: Marathon Hotels, Inc. v. Miller Galer Faeges Lapine, L.L.P, No. CV-14-836757 (Ohio Corn. Pl. Mar. 18, 2016), rev 'd and remanded, 2017 Ohio App. LEXIS 960 (Ohio Ct. App. Mar. 9, 2017). I granted a motion to disqualify an attorney. Journal entry supplied. The appellate court reversed and remanded on the grounds that, since the attorney was acting as personal counsel for appellants, he could not have also been a "third-patty neutral" as defined in Ohio R. Prof. Conduct 2.4(a) and would not have been prohibited from representing appellants as set forth in Ohio R. Prof. Conduct l.2(a). Midland Funding L.L.C. v. Hottenroth, No. CV-10-729712 (Ohio Corn. Pl. June 25, 2013), rev'd and remanded, 26 N.E.3d 269 (Ohio Ct. App. 2014). I granted summary judgment to defendants. Journal entry supplied. The appellate court reversed in part and remanded for further proceedings. The appellate coui1 found that it was error to apply the 15-year limitations period for a written contract under former R.C. 2305.06, to determine that the creditors' claims accrued in October 2004 and to fail to apply the borrowing statute, R.C. 2305.03(B), since the creditors' claims accrued sometime between April 12, 2005, and March 15, 2007. The appellate court also found that a fact issue remained as to the debtor's pennanent residency when the complaint was filed for 15 U.S.C.S. § 1692i 46 purposes where the creditors relied on the debtor's Ohio transactions and the debtor denied that she lived in Ohio when the suit was filed. Ed. of Health of Cuyahoga Cty. v. Lipson O'Shea Legal Grp., No. CV-12-784198, 2013 WL 12198167 (Ohio Com. Pl. Mar. 27, 2013), rev 'd and remanded, 6 N .E.3d 631 (Ohio Ct. App. 2013), a.ff'd, 50 N .E.3d 499 (Ohio 2016). This was an issue of first impression, where Lipson O'Shea Legal Group sought release of certain county board of health records under the Ohio Public Records Act. I granted summary judgment to the county board of health, holding the records were prohibited from disclosure under an exemption under the Act. On appeal, the court of appeals reversed and the Ohio Supreme Court affirmed the reversal; and the matter was remanded to trial com1 for review of, and I did review, sample files from Board of Health to determine what could be released after redaction. Lillie & Holderman v. Dimora, No. CV-11-754423 (Ohio Com. Pl. Nov. 19, 2012), aff'd in part, rev 'din part, 2013 Ohio App. LEXIS 3544 (Ohio Ct. App. Aug. 8, 2013). I granted summary judgment to the plaintiff law firm for money owed by the defendant client. Journal entry supplied. The appellate court found that the trial court properly granted summary judgment on the theory of quantum meruit, in absence of an express contract; but erred in granting summary judgment for the law firm on the issue of the reasonableness of the attorney fees because, although the attorney was not required to offer independent expert testimony on the issue of a reasonable rate, his affidavit testimony was insufficient to suppo11 the legal conclusion that his fees were reasonable. After the remand, the appellate court later affirmed the trial court's actions in Lillie & Holderman v. Dimora, 2015 Ohio App. LEXIS 263 (Ohio Ct. App. Jan. 29, 2015). Lakeview Holding (OH), L.L.C. v. Haddad, No. CV-11-763892 (Ohio Com. Pl. July 2, 2012), rev 'd and remanded, 2013 Ohio App. LEXIS 1667 (Ohio Ct. App. May 2, 2013). I denied defendant's motion for sanctions. Journal entry supplied. The appellate com1 reversed the judgment. It remanded the case for a hearing on the motion for sanctions, holding that while the evidence, when fully developed, might not warrant sanctions, appellant was entitled to a complete hearing on her motion and supplemental motion before that determination was made. Upon remand, a hearing was conducted, but the parties then settled the matter. HSBC Bank USA, N.A. v. Surrarrer, No. CV-11-761438 (Ohio Com. Pl. May 28, 2013), a.ff'd in part, rev 'din part, 2013 Ohio App. LEXIS 5867 (Ohio Ct. App. Dec. 19, 2013). I adopted a magistrate's decision granting summary judgment. Journal entry supplied. The appellate court affirmed in part, reversed in part, and remanded for further proceedings. The appellate court held that summary judgment was not appropriate because it held that there were material questions of fact regarding the bank's rights to enforce the note and reliance on assignments of the mortgage to establish enforcement rights was not sufficient where the bank claimed that the note had been negotiated and that anyone who had possession could have enforced its terms. 47 Winters Law Firm, L.L.C. v. Groedel, No. CV-12-775860 (Ohio Com. Pl. June 22, 2012), rev 'd and remanded, 2013 Ohio App. LEXIS 266 (Ohio Ct. App. Jan. 24, 2013). I denied appellant's requests to proceed to arbitration (ordering mediation first). Journal entry supplied. The appellate comt reversed and remanded, but later affirmed the trial court's actions after the remand in Winters Law Firm. L.L.C. v. Groedel, 2013 Ohio App. LEXIS 5468 (Ohio Ct. App. Nov. 27, 2013)). The case was remanded for a hearing on motion to enforce arbitration. Chavalia v. City of Cleveland, No. CV-14-837765, 2016 Ohio Misc. LEXIS 4210 (Ohio Com. Pl. June 7, 2016), aff'd in part and rev 'din part, 2017 Ohio App. LEXIS I 061 (Ohio Ct. App. Mar. 23, 2017). I denied summary judgment to ce1tain 911 dispatchers and the City of Cleveland in a wrongful death action. The appellate court affirmed the judgment in part as to the dispatchers; but reversed in part as to the city. The court held that the city had statutory immunity and the claim was not within the exception to immunity because the dispatchers' acts were a governmental function rather than a proprietary function. The matter was remanded for further proceedings. Stewart, et al. v. Woods Cove II, L.L. C., et al., No. CV-15-8550 I 0 (Ohio Corn. Pl. Oct. 17, 2016), rev 'd and remanded, 2017 Ohio App. LEXIS 4700 (Ohio Ct. App. Oct. 26, 2017). I dismissed plaintiffs' claims. Journal entry supplied. The appellate court found that I erred in dismissing plaintiffs' claims and effectively considered factual issues outside of the pleadings and improperly determined that no foreclosure actions had been brought against the properties at issue. The court reversed and remanded for further proceedings consistent with its opinion. g. I recused myself upon explaining to the attorneys for the State and defendant(s) that I had represented lead investigator L.H. in two separate legal matters, and he had contributed to my campaigns for judge. I inquired of the lawyers representing the parties if they wanted me to recuse myself, since the lawsuit involved a slip-and-fall and claims of negligence/liability against the provider of snow removal services, and my husband owns a business that provides snow removal service. His company has been sued by plaintiffs alleging slipand-falls as a result of snow removal services provided by his company, and in fact, his company was a defendant in a pending lawsuit based upon a slip-and-fall. Plaintiff was in the course and scope of his employment as a firefighter when the fire engine he was occupying overturned. The accident was due to the negligence of his fellow employee who was operating the fire engine. The ultimate issue was whether or not plaintiff was "legally entitled to collect" or "legally entitled to recover" from the operator and owner of the fire engine. The UM insurer for the owner of the fire engine, Scottsdale Indemnity Company, did pay my client UM coverage in lieu of defending an appeal to the Ohio Supreme Court. I sought ce1tiorari with the Ohio Supreme Court, but the majority rejected the appeal. The dates of my representation were 2000 to 2004. The legal activity that I was actively engaged in between April 2015 and December 2017 was being a member of the Board of Professional Conduct for the Ohio Supreme Comi. Justice Terrence O'Donnell nominated me for the position, and the Supreme Court appointed me to the Board. During the summer of 2017, and at the request of the Director, Richard Dove, I had agreed to serve another three-year term, however, after my recommendation for a nomination for a federal judgeship was announced, it was agreed that someone else would be appointed. During my tenure on the Board, I attended oneor two-day Board meetings every two months in Columbus. As part of my Board responsibilities, I was given panel assignments, either as the chair or member, to hear cases involving alleged misconduct by lawyers, magistrates or judges. Therefore, I was responsible for attending the hearings, primarily in Columbus, and consulting with the other panel members on recommendations to be made to the Board, and as a panel chair, I was responsible for conducting pre-hearing conferences, ruling on motions made, and writing the panel report and presenting it to the Board. For the past two and a half years, I have been an active member of the William K. Thomas Inn of Court, the mission of which is to promote professionalism in the legal field. Although in my current judicial position I have presided over cases involving Progressive and Farmers, or their insureds, I have never had any attorney/paiiy ask that I recuse myself after informing them of my financial interests in these two companies. b. The Senate commission interviewed me in Columbus, Ohio on August 21, 2017. On August 25, 2017, I was contacted by a staff member of Senator Portman and advised that I was one of three candidates recommended by the commission. On September 6, 2017, I was interviewed by members of Senator Portman's staff, and on September 8, 2017, I was interviewed by Senator Portman. On September 28, 2017, I received a call from Senator Portman advising me that he was forwarding my name to the White House, and on September 29, 2017, I was advised by Senator Portman's staff that Senator Brown agreed with Senator Portman forwarding my name to the White House. On October 12, 2017, I 67 interviewed with attorneys from the White House Counsel's Office and the Department of Justice in Washington, D.C. On April 12, 2018, President Trump forwarded my nomination to the Senate. b.
