I am a licensed California physician with a Specialization in Family Medicine. I received my medical degree from the University of Vermont College of Medicine in 1980. I did an internship and residency in family medicine at Madigan Army Medical Center (1980?1983). I I DECLARATION OF JAMES NUOVO, MD. 10board-certified in family medicine by the American Board of Family Medicine. I hold the position as Professor and Residency Program Director at the University of California, Davis Department of Family and Community Medicine. A true and correct copy of my Curriculum vitae is attached to this declaration as Exhibit A. 2. I was asked to be an expert medical consultant to the Medical Board of California for the purpose of reviewing vaccination exemptions issued by Mary Kelly Sutton, MD. to school- aged children. I reviewed a complaint sent to the Medical Board from Wendy M. Cerny, MD, an Assistant Chief of Pediatrics at Kaiser Permanente in Roseville. Dr. Cerny stated in her complaint dated February 22, 2017 that Mary Kelly Sutton, M.D. had signed a medical exemption for [Redacted name] ?to have a lifelong medical exemption from all vaccines.? This complaint included a letter dated February 6, 2017 signed by Dr. Mary K. Sutton. It states: ?My patient [Redacted name] (Redacted DOB) is medically exempt from all vaccines on a permanent basis, due to personal history of genetic defect, neurologic vulnerability, and allergy, 5.i-and family history of vaccine reaction, allergy,'and neurologic and autoimmune disease. This includes vaccinations against diphtheria, hepatitis B, hemophilus in?uenza type B, measles, mumps, pertussis, poliomyelitis, rubella, tetanus, varicella, pneumococcus, meningococcus,l?u, and human papilloma virus. The exemption is for all vaccines including those not mentioned here. Vaccination constitutes a greater risk than bene?t for this individual.? 3. Dr. Sutton has issued nearly identical medical exemption letters to other school-aged children, including letters dated April 5, 2017, August 14, 2018, and October 12, 2018. 4. Based upon my review, I concluded that the medical exemption letters issued by Dr. Sutton were either of questionable validity or patently without a medical basis. The standard of care requires that a medical exemption from vaccination be vaccine~speci?c and be supported by DECLARATION OF JAMES NUOVO, MD. medical indication. Issuance of a medical exemption from all vaccines and/or without a medical indication falls below the standard of care for a physician. 5. I am informed and believe that Kaiser Foundation Hospitals (KPH) is in possession of unredacted copies of the exemptions described above, as well as that child?s pediatric chart. Based on my review, and the concerns discussed above regarding the validity of the exemptions from required vaccinations, it is my conclusion that the unredacted exemptions and pediatric charts showing the children?s? medical and immunization history are necessary 10). determine whether the exemption had a medical basis in the children?s past history and treatment. 6. Based upon?my education, training and experience, I am aware that California law requires vaccination of school-age children before they enroll in a grade span, birth to preschool, kindergarten to grade six and grades seven through twelve. While there may be .- precautions and, in some cases contraindications, to vaccination, these are not common and there is no precaution or contraindication that would apply to all vaccines permanently. 7. The risk to? the public health posed by unvaccinated children is several?fold. The unvaccinated child is at risk for vaccine?preventable diseases. As examples, pertussis can be severe in small children and measles can cause complications, including pneumonia, dehydration and encephalitis. The unVaccinated child can pass vaccine-preventable diseases to children below vaccination age and other unvaccinated children and adults. There is also a public cost. Each case of measles can cost public health department thousands of dollars to evaluate and respond. 8. By reason of my professional activities, I am aware that SB 272', which amended Health and Safety Code 120325, changed immunization requirements for children entering child care or school in California as of January 1, 2016, by eliminating personal beliefs exemptions for vaccines required for schools or child?care facilities. I am also aware that, since then, medical exemptions have increased for children attending kindergarten from 0.2% in 2015-2016 to La.) I reviewed vaccine exemptions written by Dr. Sutton to exempt [redacted names], from required vaccinations. In my review, I found it signi?cant that Dr. Sutton is not a pediatrician or the primary care provider for [redacted names]. The exemptions for these children are permanent and global, applying to all vaccinations. Dr. Sutton lists reaSOns for the . exemptions, which include allergic illness, neurologic, and vaccine reaction (of the child or in his family history). Allergic and illnesses are not generally accepted contraindications to vaccination. An adverse vaccine reaction could constitute a precaution or contraindication, but only to the speci?c vaccine that caused the adverse reaction and not to all .. vaccines. To document an existing or family history of a condition or reaction without speci?cation of .the condition, the person who had the condition and. their relation to the patient, and the speci?c vaccine that the condition or reaction related to, is not standard medical charting. The exemptions issued by Dr. Sutton are permanent and global, which is medically unlikely, in. that there is no component common to all vaccines. In addition, the exemptions do not appear to be supported by information received from the KF pediatrics department. Consequently, access to the unredacted exemptions and children?s pediatric chart from KFH by release or subpoena is necessary to determine whether the child?s personal medical or family history? support the exemption issued byDr. Sutton.
