I am'a licensed California physician with a specialization in Family Medicine. I received my medical degree from the University of Vermont College of Medicine in 1980. I did an internship and residency in family medicine at Madigan Army Medical Center (1980?1983). I 1 . DECLARATION OF JAMES NUOVO, M.D. board-certi?ed in family medicineby the American Board of Family Medicine. I hold the position as Professor and Residency Program Director at the University of California, Davis Department of Family and Community Medicine. A true and correct copy of my Curriculum vitae is attached to this declaration as Exhibit A. 2. I was asked to be an expert medical consultant to the Medical Board of California for the purpose of reviewinngaccination exemptions issued by Michael F. Allen, M.D. toschool- aged children. .I reviewed a complaint sent to the Medical Board from Wendy M. Cerny, MD, an Assistant Chief cf Pediatrics at Kaiser Permanente in Roseville. Dr. Cemy stated in an email dated May 17, 2018: have gotten more names of patients at our clinic who have gotten medically inappropriate vaccine exemptions since we last talked?. This complaint included a letter dated April 24, 2018 signed by Dr. Michael F. Allen. It states: ?[Redacted name] is?a patient of mine. [Redacted name] is permanently medically exempt for all immunizations, including but not limited to: Tdap, Td, Polio, Hepatitis B,'Hepatitis A, Hib, Pneumococcal, MMR, HPV, Varicella, Meningococcal, In?uenza and any other immunization deemed necessary, now and/or in the future.? Further, this record states: ?The physical condition of this child, and the medical. circumstances related to this child are such, that immunizations constitute a greater risk than benefit for, this individual. This is based in part upon her own history of a vaccine reaction, multiple environmental and food allergies, eczema and mutation and her own neurologic vulnerability as well as her maternal family history of an autoimmune disorder, hypogammaglobulinemia, ADHD, medication, food and environmental allergies, asthma and mental health disorders. This is ?irther supported by a paternal history of multiple autoimmune disorders, asthma, food and environmental allergies andmental health disorders.? Based upon my review, I concluded that the medical exemption letter issued by Dr. . Allen was either of questionable validity or patently without a medical basis. The standard of 2 DECLARATION OF JAMES M.D. care requires that a medical exemption from vaccination be vaccine-Speci?c and be supported by - a medical indication. Issuance of a medical exemption from all vaccines and/0r without a medical indication falls below the standard of care for a physician. 3. I am informed and believe that Kaiser Foundation Hospitals (KF H) is in possession of the unredacted copy of the exemption described above, as well as that child?s pediatric chart. Based? on my review, and the concerns discussed above regarding the validity of the exemption from required vaccinations, it is my conclusion that the unredacted exemption and pediatric chart showing the child?s medical and immunization history are necessary to identify the child and to determine whether the exemption had a medical basis in the child?s past history and treatment. 4. Based upon my education, training and eXperience, I am aware that California law requires vaccinationof school-age children before they enroll in a grade span, birth to preschool, kindergarten to grade six and grades seven through twelve. While there may be precautions and, in some cases contraindications, to vaccination, these are not common and there is no precaution or contraindication that would apply to all vaccines permanently. 5. The risk to the public health posed by unvaccinated children is several-fold. The unvaccinated child is at risk for vaccine-preVentable diseases. As examples, pertussis can be severe in small children and measles can cause complications, including pneumonia, dehydration and. encephalitis. The unvaccinated child can pass vaccine-preventable diseases to Children below vaccination age and other unvaccinated children and adults. There is also a public cost. Each case of measles can cost public health department thousands of dollars to evaluate and respond. 6. By reason of my professional activities, I am aware that SB 277, which amended Health and Safety Code 120325, changed immunization requirements for children entering child care or school in California as of January 1, 2016, by eliminating personal beliefs exemptionsfor vaccines required for schools or child-care facilities. I am also aware that, since then, medical 3 DECLARATION OF NUOVO, M.D. 15" '16exemptions have increased for children attending kindergarten from 0.2% in 2015-2016 to 0,5% in 2016-2017 and to 0.7% in 2017?2018. cdph. ca. go v/Programs/CID/D CD DPH%20Doc1unent%2 0Librarv/ Immunization Medical exemptions have increased for children attending 7th grade from 0.1% in 2015 -2016 to 0.4% in 2016-2017 and 2017-2018 7. I reviewed a vaccine exemption written by Dr. Allen to exempt [redacted name], from required vaccinations. In my review, I found it signi?cant that Dr. Allen is not a pediatrician, is not the primary care provider for [redacted name]. The exemption for this child was permanent and global, applying to all vaccinations. Dr. Allen lists reasons for the exemption, which include allergic illness, ?neurologic vulnerability? and vaccine reaction or injury (of the child or in his family history). Allergic and illnesses are not generally accepted contraindications to vaccination. An adverse vaccine reaction could constitute a precaution or contraindication, but only to the speci?c vaccine that caused the adverse reaction and not to all vaccines. To document an existing or family history of a condition or reaction without speci?cation of the condition, the person who had the condition and their relation to the patient, and the speci?c vaccine that the condition or reaction related to, is not standard medical charting. The exemption issued by Dr. Allen is permanent and global, which is medically unlikely, in that there is no component common to all vaccines. In addition, the exemption does not appear to be supported by information received from the KFH pediatrics department. Consequently, access to the unredacted exemption is necessary to discover the'identity of the child and enable the Board seek the child?s pediatric chart from KFH by release or subpoena and thereby determine whether the child?s personal medical or family history support the exemption issued by Dr. Allen.
