Ellis and one ofthe lurors that convicted him. Because ofRick'S sentence, he was placed in a maximum security prison despite being a nonviolent offender. This has become a problem and a majorobstacle for Rick's rehabilitation. Due to the gang presence in maximum security prisons, Rick has received constant threats against his life as he refuses to i in a gang. My brother is a first time NON- Violent drug offender who has never been violent a day in his life and had no previous criminal record. His crimes did not involve any harm, assault, injury or death. By assigning him to a maximum security facility the bureau of prisons has insured that he has been placed in a dangerous environment with threats made on his life in Florence High if he does not bend to the will of the gangs within this facility and we are working to get him to a safer place. My grandmother is 96 years old and her health is fading to the point that she is near death. Frederick took care and lived with my grandma before he was incarcerated and he was her primary caretaker. My brother also has been a vital role in my own sons life who is severely autistic. When Rick was locked up, i had my sons babysitter and caretaker taken away from me so I could work and support my family. Rick also has been a main caretaker to my nephew, Alex, who was born Without arms and has epilepsy. Our family has had to scramble to get our children?s caretakers who know how to handle the various handicaps. My son, who is autistic, is not able-to visit Rick at all in a Max security facility and if you know anything about autism, that type of life change can set children years back. i have already seen the effects in my poor child. My family is not famous, nor do we know any superstars and we do not have a lot of money to hire expensive legal representation. 1 know you are fully aware of the financial burdens put on families with incarcerated loved ones. With my brother not having a violent bone in his body, we can not comprehend why he was sent to a max security prison where he is not able to even do the therapies and things that Honorable Judge T. 5. Ellis sentenced him to do. The RDAP program that he was sentenced to enroll is not even available in the max seCurity prison. There have been national articles written about my brother?s case and the injustice of the mandatory minimum sentence he received which included, a juror on his case, going to the media that he "does not feel any safer? with my brother locked up in this sentence. The judge at the sentencing hearing even stated that he did not wish to give Rick this sentence and that he felt the prosecution had stacked the charges against my brotherthe outdated laws we have in place and we would have to go to Congress to get these laws changed so the Judge could have say in a convicts sentence. Judge Ellis also spoke to my brother?s attorney, hoping his attorney would make sure that Rick completed the RDAP program and that he would work to get the prosecution to work out a deal with my brother. To date, the judge, the jurors and even the counselors within Florence High have stated that Frederick does not belong in a maximum security facility, however that there is nothing that any ofthem can do to change this outcome as it rests on the shoulders of the Bureau of Prisons. So, while he isjust a number to you, he is a brother, a son, an uncle, a nephew, a friend, a service worker, a contributor to society. He should never have been sent to a max security facility being a Non?Violent offender and he should have immediate access to the RDAP program and therapies that the Judge sentenced him to complete. He has family members who are in dire Straits without his help and my grandmother, nephew and son desperately need access to him in a safer place. On July '16, 2015. the Designations, Security. and Classification Center (DSCC) designated Mr. Turner to USP Florence, Colorado. Due to Mr. Turner's term oi incarceration, oscc applied a Public Seiety Factor Sentence Length.
