City of New London Department of Recreation 120 Broad Street • New London, CT 06320 • Phone (860) 447-5230 • Fax (860) 447-7956 MEMORANDUM OF AGREEMENT Between City of New London And Mitchell College This Memorandum of Agreement sets forth the terms and understanding between the City of New London and Mitchell College for shared use of the Toby May Softball Field #2. Background The City of New London owns two softball fields at Toby May Park which is adjacent to Mitchell College. These fields have been “home” fields for the NL Little League softball teams. Mitchell College has agreed to renovate one of the fields to create a DIII collegiate softball field at the College’s expense. The renovation cost is estimated to be approximately $500,000. The College will use the softball field during the Spring college season, and for its practices, and other softball-related activities, the New London Girls Little League will be able to use the renovated softball field for its practices and games and the New London High School Girls Softball Team will have the field available for special games or when its field is not usable. The College will also provide maintenance for the field and its equipment (scoreboard, dugouts, etc.) at the College’s expense (estimated to cost $25,000 per year). Maintenance will include field grass grooming, field lining, maintaining the dugout, bleachers and scoreboard, and trash pick-up after College events, as more specifically detailed in a lease to be entered into between the College and the City (the “Lease”). General Mitchell College event parking will remain on Mitchell campus and the College will lease a port-o-let for the College players and guests during the college season if the College finds it necessary. The College will conduct two clinics for the New London Girls Little League. The City of New London will provide seasonal maintenance of the Toby May Restrooms (park side). Shared Use Representatives from the College and the Parks and Recreation Commission will meet each January to determine that year’s schedule for shared use. The College will have priority for use for College games and practices, which occur in the spring and fall, and for other softball-related activities, such as recruiting events and camps that may take place in the summer and fall. During the College’s season (March-May), no use of the field other than by the New London Girls Little League and High School Girls Softball Team will be permitted so that the field’s condition can be maintained to the standard required by NCAA rules. Outside of the season, the parties will mutually agree on other uses of the field. The guiding principle will be that no use will be permitted of the field which could cause significant damage to its condition as a DIII softball field, or which conflicts with the time needed to restore, reseed, etc. All uses shall be subject to the terms of the Lease. The Parks & Recreation Commission and the College will evaluate the effectiveness and adherence to this agreement after the first year of the agreement, and may mutually agree to modifications. Duration This Agreement may be modified by mutual consent of authorized officials from Mitchell College and the NL Parks & Recreation Commission. It shall become effective upon signature by the authorized officials from the named parties and will remain in effect until modified by mutual consent of the parties. This Agreement shall end on the date that the Lease ends.
