After a careful review of these pages, I have determined to release 63 pages to you in their entirety, and I am further releasing 180 pages in part, with portions redacted, pursuant to Exemptions (b)(5) and (b)(6) of the FOIA (5 U.S.C. §552 (b)(5) and (b)(6)). I have also determined to withhold 33 pages in their entirety, pursuant to Exemptions (b)(4) and (b)(5) of the FOIA (5 U.S.C. §552 (b)(4), (b)(5)). Furthermore, I have determined that 20 pages should be sent for consultation to other agencies and returned to this Department for final disposition. Finally, I determined that (8) eight pages are nonresponsive and duplicative to your request. VERSIGHT Page 2 of 2 Case No. 2018-00972-FOIA-OS Equity Forward v. HHS, Civil No. 18-1509 (D.D.C.) FOIA exemption (b)(4) permits the withholding of trade secrets and commercial or financial information that is privileged or confidential. FOIA exemption (b)(5) protects inter-agency or intra-agency memoranda or letters which would not be available by law to a party other than an agency in litigation with the agency. This exemption protects documents that would be covered by any privilege an agency could assert in a civil proceeding. These privileges include, among others, the deliberative process privilege, the attorney-client privilege, and the attorney work-product privilege. FOIA exemption (b)(6) permits a Federal agency to withhold information and records about individuals in “personnel and medical files and similar files, the disclosure of which would constitute a clearly unwarranted invasion of personal privacy.” The definition of “similar files” has historically been broadly interpreted to include a wide variety of files, and the United States Supreme Court has held that Congress intended the term "similar files" to be interpreted broadly, rather than narrowly. I have analyzed these records and find they meet the threshold requirement of this exemption. Additionally, I have reviewed and weighed the public interest in disclosure of this information against the privacy interest in nondisclosure, and found that the privacy interest outweighs the public’s interest in disclosure. We will continue to review the remaining records as efficiently and expeditiously as possible, consistent with our available resources and the Order of the Court. This functio nality increases a doctor's ability to provide safe and effective care to their patients. Following the enhancement of the KASPERPOMP reports, a 2% decrease was seen in high opioid prescribing to adults, and a remarkable 25% reduction in opioid prescribing to youth aged 0-17 between the last quarter of 2015 and the end of the first quarter of 2016. o Kentucky's PfS program has partnered w ith the Kentucky Office of Drug Control Policy (KyODCP) and the Kentucky Department of Criminal Justice Training (KyDOdT) to develop and im plement a naloxone administration training program for Kentucky's 8500+ Jaw enforcement officers. As of 2016, a total of900 law enforcement officers representing mult iple agencies all across the Commonwealth have now been trained to administer naloxone under this program. o Kentucky has used the ESOOSfunding to begin tracking suspected hero in and opioid overdose reported to the ir syndromic emergency department system in near real-time. SEMPP: Safe & Effective Management of Pain Program (SEMPP)implements the 2016 CDC Guideline for Prescribing Opioid for Chronic Pain and the West Virginia Safe & Effective Pain Management Guidelines to improve patient care and prevent prescription drug overdose and abuse in collaboration with West Virginia insurance payers. SEMPPperforms detailed pat ient case reviews for those above a higher risk morphine milligram equivalent (MME) threshold, in order to ensure the safe and effective management of pain for all patients . SEMPPalso aims to educate state-wide prescribing and dispensing prof essionals on the guidelines. West Virginia ESOOShas used funding t o build th eir infrastructu re from the ground up . They received fund ing from CDC's Nationa l Violent Death Reporti ng System (NVDRS)in January 2017 to abstract med ical examiner/coroner data . Even as a newcomer to th e NVDRSsystem, West Virginia has leveraged their resources and worked closely with CDCstaff to build the ir capacity. Despite the ir high mortality numbers, with the help of ESOOSfunding and TA (and an all-handson-deck approach with NVDRSand OCME staff), staff were able to hit the f irst data submission deadline and have greatly improved the ir data quality. The West Virginia University Inju ry Control Research Cente r (WVU ICRC)was instrumental in the development and implementation of a pilot take-home program for naloxone, a lifesavi ng med ication that can reverse an opio id overdose, in rural commun ities in West Virginia. The 8-holir tra in.ingfocuses on overall addiction management, opioid prescribing guidelines, and the recently implemented Virginia Medicaid (DMAS) ARTSbenefit for service reimbursement and how to include t hfs benefit into a clinic business model. The CDCGuideline were, embedded as a best practice t hroughout the entire curriculum. 28 trainings were held across the state in a 3 month period 1 and over 750 prescribe rs were trained. Virginia's POMP is now interoperab le with 23 other states, and frequently sends and receives requests from borde ring states, with the exception of North Carolina. Virginfa is also one of the 12 states participation in the Prescription Behavior Surveillance System through Brandeis University . Currently, Virginia's system automatically registers prescribers, and 50,000 prescribers and 13,000 pharmacists are enrolled . Prescriptions are reported within 24 hours of dispensing or the next business day. With recent POMP enhancements, prescribers can now indicate delegates through a quicker online process. There is also the ability to send a systemgenerated individual prescribing report covering a period of time. Virginia is also implementing clinical alerts/unsolicited reports starting in July 2017. Additiona lly, Maryland is engaged in a project to improve understanding of the impacts of opioids on return to work and the risk of re-inj ury after return to work . Working with insurers and workers' compensation data, the plan is to identify information such as type of injury, amount of time away from work, whether an opioid was prescribed after an injury , associated health outcomes , and more. This information is vital to identifying risk factors and developing interventions specific to the workers' compensation population to address prescription drug abuse and overdoses.
