Budget Hearing Although some budget hearings have already been held, nine additional budget hearings are scheduled between 8 March and 28 March, relating to the budgets of the NFIP, IC, CIA, intelligence-related programs. Recommendations on Admiral Turner's attendance at these sessions is made on the attached listing. B. Proposed Covert Action and International Agreement Briefings These briefings would be separate and preliminary to the proposed introductory briefings covered in (C) below. The covert action and international agreement (Case Act) session should be held with Chairman Clement Zablocki, House International Relations Committee. Former Chairman Thomas Morgan dispensed with Hughes?Ryan briefings because of leakage of information from the Subcommittee securing these briefings. This situation should be rectified with Zablocki, and he should be updated on current covert action programs. The session with Zablocki will be important in establishing a modus operandi with this particular Hughes-Ryan committee. The session also would be a good forum for compliance with the Case Act by reporting on certain agreements between the CIA and foreign liaison services which the Department of State has ruled are covered by the Case Act. Admiral Turner should also meet with Chairman John Sparkman, Senate Foreign Relations Committee, and Banking Minority Member Senator Clifford Case to report on the Case Act agreements and to review with them any questions he or they may have on covert action briefings. These briefings have not been scheduled pending clearance by the White House. C. Proposed Introductory Briefings There is a need for an introductory session between Admiral Turner and committees other than the Senate Select Committee on Intelligence and Appropriations Committees which share some oversight responsibility, e. g. This fact, coupled with the sensational allegations and revelations concerning the Agency which were made in 1975 and 1976, has resulted in,a situation where at the present time the equivalent of approximately 100 full?time employees is devoted to the processing of requests, appeals, and litigation. This resource commitment is exclusive of the considerable time spent on this matter by senior Agency executives. .A case can be made, that not withstanding the admini? strative burden involved, that the very concept of FOLA is incompatible with the activities of a secret intelligence service. The question of whether or not to seek relief from the requirements of the Act should be addressed in some detail at an early date. 2. Moore II, a retired Agency employee, was arrested by the Federal Bureau of Investigation on espionage and other related charges. He allegedly attempted to deliver classified.CIA documents to Soviet officials.' Following his arrest a large number of classified CIA documents were recovered from Mr. Moore's residence. On 18 February 1977 Mr. Moore was indicted by the Federal Grand Jury. All cOunts in the indictment relate to the four most sensitive documents recovered. Agency representatives have had extensive meetings with representatives from the U. S. Attorney' 5 office and the Department of Justice with regard to the manner in which the four documents may be introduced into evidence. At . issue is the potential for public disclosure of the inforw mation within the documents through their introduction as evidence in court. This is aggravated by the requirement that documents so introduced must be accompanied by expert testimony as.to precisely why the information is damaging to the national security. The Agency is cooperating with the U. S. Attorney?s Office and the Department of Justice to determine the extent to which such expert testimony would be required to obtain Mr. Moore?s conviction. We are attempting also to prevent the public disclosure of information Of such significance to cause irreparable damage to the national security. SHE-CI): Rupee Investigations of Unauthorized Disclosures?by'FBI - 9" The Agency faces an impasse in the investigation by the FBI of unauthorized disclosure of classified or sensitive intelligence information. aThe Justice Department will not permit an FBI inquiry into a ?leak" unless the material involved can be declassified before an investigation is initiated. In effect; there is no investigation unless there is the probability of prosecution. The Agency position regarding inveStigation of "leaks" is that the unlikelihood of prosecution should not deter investigation. Determination of the source of a "leak? would permit remedial or administrative action directed against the . responsible_ individual. Further, establishing h0w or by whom information was compromised would permit .establishment of more effective protective meChanisms to prevent serious ?leaks?in the future. Inclusion of "Black Arts" Warning in Termination Debriefings It has been suggested to the President that the Agency may need .the formal Termination Secrecy Agreement ?gigxpanded to intlude a prohibition against the use of ?*black arts" outside the rigid perimeters of the Agency' 5 duly authorized activities. This precaution, in the mind of the Office of Security, would be ill- advised. "Black Arts" even in their widest connotation would not apply to the majority of our employees. Secondly, even as a suggestion it carries the in?erence that the Agency is coneerned that the individual may be considering embarking on a criminal career. Finally, the essence of the Termination Secrecy Agreement is the willingness on the part of the employee to obey the law. The inte11igence input wi11 be made in many ways at many 1eve13 and it wi11 be difficuit to prevent dup1ication and overiap. In comprehensive net assess- ment, we wi11 a1so be breaking new ground. Of our ll senior positions, one is new and not yet filled, one is vacant, and at least three more will become vacant through retirement or completion of tour by the end of the summer. I have felt that I could not recruit officers who would be the DCI's personal represen- tatives without his agreement and without being able to give them some.sort of assurance that the jobs will continue at more or less their present level of importance. Moreover, I need the DCI's active backing in order to get quality people from State and Defense. I realize that the answers I need prejudge decisions that will be made under PRM ll several months from now, but the demands of such papers as PRM l0 won't wait. 4.- 2.
