RESOLUTION AUTHORIZING SETTLEMENT OF BRITTANY HEITM
AN v.
HAMILTON COUNTY CLERK OF COURTS, AFTAB PURE VAL
AND COMPROMISING
POTENTIAL DEBTS PURSUANT R.C. 305,26
BY THE BOARD:
WHEREAS, after Aftab Pureval was elected to the Office of Hamil
ton County Clerk of
Courts certain personnel changes were made; and
WHEREAS, in order to fairly treat those employees whose employrnent
with the Office
of the Hamilton County Clerk of Courts was terminated, the Clerk of
Courts entered into
termination agreements with those employees that made mutual promi
ses and provided
compensation to those employees by leaving them on the payroll of the
Clerk of Courts after
termination of their employment as a severance payment; and
WHEREAS, one of those employees filed suit in the case of
Brittany Heitman v.
Hamilton Count); Clerk of Courts and Afiab Pureval, currently pending in
the Hamilton County
Court of Common Pleas, case number A-1804561, in a dispute over non-m
onetary terms of those
termination agreements; and
WHEREAS, during the course of that litigation it became apparent
that the Board of
County Commissioners had no role in the authorization or approval of those
agreements; and
WHEREAS, the Hamilton County Human Resources Department has calcula
ted the cost
of the severance payments for each former Hamilton County Clerk of Courts
Employee involved
and those costs are attached hereto as Exhibit A; and
WHEREAS, the Board has been advised that potential claims for recove
ry of those funds
could be made against all those involved with the termination agreements;
and
WHEREAS, in fairness to the former Hamilton County Clerk of Courts emplo
yees who
have relied upon those payments, the Board determines that any claims agains
t any individuals
involved in those termination agreements should be released.
THEREFORE, BE IT RESOLVED, that as provided in RC, 30526
that any debt owed
by any individual involved in the execution of the termination agreements
for employees listed in
Exhibit A is wholly released provided that Brittany Heitman v. Hamilton
County Clerk of Courts
and Aftab Pureva, Court of Common Pleas case number A-1804561, is dismis
sed with prejudice
with no further cost and expense to Hamilton County.
BE IT FURTHER RESOLVED, that The prosecuting attorney repres
enting Aftab
Purevai, in his official capacity, is authorized to execute any documents necess
ary to cause the
case of Brittany Heitman v. Hamilton County Clerk of Courts and Aftab
Pureval, Court of
Common Pleas case number A-1804561 to be dismissed with prejudice,
