Based upon our review, we ?nd no legal problems. This memorandum constitutes the written statement of approval under AS 44.62.060(b) and that authorizes your of?ce to ?le the attached regulations. The regulations were adopted by the Department of Health and Social Services after the close of the public comment period. The regulations concern levels of care, rates for residents, ?nancial veri?cation, application requirements, the community spouse allowance for individuals applying for payment assistance, and the amount of time before returning to the active waiting list. The client requests these be ?led in order to be in e?ect by September 1, 2019. The April 9, 2019, public notice, the April 16, 2019, supplemental notice, and the July 30, 2019, adoption order state that this action is not expected to require an increased appropriation. Therefore, a ?scal note under AS 44.62.195 is not required. In addition to the normal regulatory requirements, an amendment of the regulations setting the rates at the Pioneer Homes has additional requirements under AS 47.55.030. These additional requirements include that the department must provide written notice of the proposed rate change to all residents of the home and that the department must hold an oral hearing to accept comments regarding the proposed change. The notice provided to residents must be provided at least 60 days before the regulation change is adopted, the notice must give notice of the oral hearing, and the oral hearing must occur at least 30 days before the change is adopted. It appears that all of these requirements were met in this case. An Af?davit of Providing Notice to Residents, which includes a copy of the letter sent to residents on April 18, 2019, is included showing that these requirements have been met. Further, the department held a public hearing on this regulation change on May 28, 2019, at Pioneers? Homes locations across the state connected by teleconference.
