On January 9, 2017, Defendant, Scott Griffen, individually and as principal of Defendants GSS
BB, LLC, d/b/a Hickory’s Hall Banquet & Event Center were ordered to appear at the Story County
Courthouse for a judgment debtor examination. Attorney Tyler R. Smith, representing Plaintiff,
appeared for the Plaintiff with a Certified Shorthand Reporter. Defendants did not appear nor did
anyone appear on their behalf. Plaintiff then moved to find the Defendants in contempt for failure to
abide by the terms of this Court’s December 8, 2016 Order for Examination of Debtor.
An order was entered January 9, 2017 requiring the Clerk of the Court to issue a warrant for
Defendant, Scott Griffen’s arrest with bond set in the sum of $25,000.00, cash or surety. That arrest
warrant was executed January 10, 2017.
Defendant appeared on January 23, 2017 with his attorney Jonathon L. Schroeder. Defendant
explained to the Court that he was unaware of the requirements of the order and indeed had not seen
the order to appear for judgment debtor examination. Under these circumstances, the Defendant’s
bond is hereby released and the Plaintiff’s Application for Rule to Show Cause is continued, sine die.
Defendant assured the Court that he would work with his attorney to reschedule the judgment debtor
examination. He further assured the Court that he would provide all documents requested in the order
scheduling the Judgment Debtor Examination.
IT IS, THEREFORE, ORDERED that the surety bond posted by Defendant is hereby cancelled
and released.
