JUDGMENT ENTRY - AMENDED
This matter comes to the attention of the Court upon Plaintiff’s Motion for Entry
of Default and Judgment; Plaintiff appears through counsel and Defendant appears not
nor anyone for him; the Court, having reviewed the Court file and being otherwise fully
advised in the premises, FINDS:
1.

An original notice for the commencement of this action was served on the
Defendant as provided by law and the court, therefore, has jurisdiction of
the parties and of the subject matter.

2.

A notice of intent to seek default was thereafter timely served as required
by RCP 1.972(2)(a).

3.

One of the attorneys representing Plaintiff has certified in writing that he
has examined the EDMS docket for this cause and that said docket show
no appearance, motion or answer has been filed by Defendant nor any
attorney representing said party.

4.

Defendant failed to timely serve and/or file a motion or answer as required
under the rules of civil procedure and is therefore deemed in default.

5.

The material allegations contained in the Plaintiff’s Petition at Law are
true; Plaintiff is entitled to the relief sought therein; and Defendant is
justly indebted to Plaintiff as prayed in Plaintiff’s Petition at Law,
therefore:

IT IS HEREBY ORDERED, ADJUDGED AND DECREED judgment is
hereby entered in favor of Barnum Quality Hardwood Floors, Inc. and against
Defendant Scott Griffen individually and doing business as Old Main Brew Pub
in the amount of $7,840.67 plus interest at the rate of 18% per annum from and
after 21 February 2018 as well as for the costs of this action, including reasonable
attorney fees of $1,713.38.
