No one?s above the law includingjudges and prosecutors who have a sworn duty to uphold the law. On September 17, 2013 ProsecutorJoe Deters ?led a motion requesting special prosecutors, and on the - same day Judge Beth Myers filed an entry with the Hamilton County Clerk of Courts appointing special prosecutors, for the purpose of fully investigating and prosecuting this matter (Judge Tracie Hunter) from this point forward, in the courts of Hamilton County, and, if necessary, the Courts of the State of Ohio. Scott Croswell to act as Special Prosecutors relative to above-referenced matter and to handle all subsequent proceedings that may arise there from. By filing this motion without due diligence, Judge Myers subsequently appointed Prosecutor Joe Deters personal lawyers and friends who has represented him regarding personal litigations. In fact, one attorney, R. Scott Croswell is a partner in the law ?rm of Croswell and Adams CO., LPA the law ?rm that represented Deters in his divorce. There are numerous other examples, available upon request, that will show just how close these attorneys are to Prosecutor Deters. When publicly questioned regarding the appointments, she stated, dealt with things as they were presented to me.? will continue to do that." Prosecutor Deters has maintain all along that he didn?t recommend these appointments, that it was strictly done by the Common Pleas Court. However, according to an Enquirer newspaper report from reporter Kimbell Perry dated June 22"" 2014, he twice reference Joe Deters role in the appointments. He writes, Hamilton County prosecutors, who suggested veteran defense attorneys Merly Schiverdecker and R. Scott Croswell Ill be appointed. And he writes, Not the Judge who appointed them on Prosecutor Joe Deters recommendation. (Full article attached.) Joe Deters requested a special prosecutor because he had a conflict. As such, by law, his only participation is to make the request and provide reasoning. Judge Myers role is to decide whether to honor the request, and if so, to appoint with the assurance there are no con?icts. It appears neither Deters nor Myers followed the law to assure Judge Hunter received a fair trial, free of any biases and she appears to have played a role in unlawfully securing a public contract. By appointing Joe Deters personal lawyers, who has represented him in personal matters, any reasonable thinking person can conclude there are inherit conflicts. First, the mere personal relationship speaks for itself. Second, by honoring his recommendation to hire his personal lawyers, in essence, she played a role in using her public of?ce to secure a public contract (Approximately $700,000) for the personal lawyers of another pubiic official. if these attorneys were in fact recommendations from Prosecutor Deters, 3udge Myers had a judicial responsibility to determine there were no conflicts before honoring the recommendation. She obviously, did not do that. Her careless handiing of this matter brings into question whether Judge Hunter received a fair trial, free of any biases or con?icts. Joe Deters has maintain that he had nothing whatsoever so do with the appointment. Beth Myers will only say, dealt with things as they were presented to me. These responses are unacceptable. Public officials are employees of the people, and they are held accountable by the people. Every citizen that comes before the judicial system should expect to be treated fair and equal according to the law. It appears, Judge Hunter was not treated fair and equal nor does it appear the special prosecutors were appointed according to iaw. Someone isn?t being truthful. Therefore, on behalf of the citizens of Hamilton County, we are requesting a joint investigation by the Supreme Court and the office of the Attorney General, and a special prosecutor be appointed accordingly, to do a thorough investigation to determine if any laws were violated in the appointment of special prosecutors, Merlyn Schiverdecker and R. Scott Croswell. We?re also asking the Supreme Court to require the fuil cooperation ofJudge Myers, ProsecutorJoe Deters, and attorneys Schiverdecker and Crosweii in the investigation.
