Citizen 2 0 0 3 1 7 Complaint for violation of Title 21 United States Code 846 STATEMENT OF FACTS CONSTITUTING THE OFFENSE OR VIOLATION: Beginning at a time unknown, and continuing to on or about March 25, 2012, at or near Douglas, in the District of Arizona, David Robeson, Carlos Servando-Valenzuela, Guadalupe Peralta-Diaz and Reydesel Ruiz--Ortega, named herein as defendants and co-conspirators, did knowingly and intentionally combine, conspire, confederate and agree with other persons known and unknown to possess with intent to distribute 100 kilograms or more, but less than 1,000 kilograms of marijuana, that is, approximately 118.38 kilograms of marijuana, a Schedule I controlled substance; in violation of Title 21, United States Code, Sections 841(a)(l) and 841(b)(1)(B)(vii). All in violation of Title 21, United States Code, Section 846. BASIS OF CHARGE AGAINST THE ACCUSED: On March 25, 2012, an Agent using a Recon infrared camera spotted a group of seven suspected drug smugglers south of State Route 80, near Mile Marker 385, in Douglas, Arizona. Agents responded and were guided by the camera operator to the area were the subjects were hiding. The agents observed a vehicle approach the location and turn off his lights. The agents hid in the brush and observed the subjects that were hiding run to the vehicle and load what appeared to be bundles of marijuana in the vehicle. The agents approached the vehicle and the subjects absconded. The driver David ROBESON was apprehended and placed under arrest. The camera operator maintained visual of the subjects who were loading marijuana into the vehicle and guided agents to their location. Agents apprehended Carlos SERVANO-Valenzuela, Guadalupe and Reydesel RUIZ-Ortega. Five 1 bundles of marijuana were found in the vehicle with a combined total weight of 118.38 kilograms. .
