This collision took place on Scottsdale Drive, approximately 61 feet north of East 34"'Place. CONDITIONS: Scottsdale Drive travels in a north and south direction with one lane of travel in each direction. The north and southbound lanes are separated by two painted, solid, yellow stripes. The west edge of the roadway has approximately l6 inches of cement between the asphalt and the dirt right of way. This cement is level with the asphalt. There were no visible or obvious defects with the roadway, the cement, or the junction of the asphalt and cement. At the.time of the collision it was night and.there are no street lights in this area. The weather was clear and dry when this collision occurred. VEHICLES: . Traffic Unit i- is a red, 1987, Ford (Mustang) two door passenger car bearing Arizona registration plate ACD7608. The owner of the vehicle is Mr. Jose RAMIREZ, who told the initial responding Deputy (Deputy T. PARKER, P-45) and the first civilian (Mr. .Michael ANDERSON) he was the operator of the vehicle at the time of the collision. There were two passengers in this vehicle at the time of the collision. The right front seat passenger was Rudy NATAL. The right rear passenger was Jose MARQUEZ . VEHICLE DAMAGE: Traffic Unit #1 sustained damage to the entire vehicle to include scratches to nearly every inch of it. The front end was crushed and the front bumper assembly was torn off. The hood was crushed, twisted, and torn. The left front fender was crushed, bent, and twisted. The driver's door had crush damage and was jammed. The left rear quarter panel had crush damage, was bent, . and had dents. The rear bumper cover was torn and twisted and the rear lamp assemblies were broken out. This vehicle is a hatchback and the hatchback door was twisted to the left and the rubber seal was torn free and was hanging out. The right rear quarter panel had some crush damage and induced damage. The right door' had crush. damage. The right front fender" was torn/pealed. back towards the passenger door. The right front wheel was torn from the vehicle. The center portion of the wheel was still bolted onto the vehicle, but the wheel and tire were torn off. - The crush damage to the front, left front fender, and hood was from the left front corner (driver's side) towards the right side and back. ACCIDENT DESCRIPTION (Measurements) WITNESSES: There is one known 'witness to the events, Mr. Michael ANDERSON. Mr. ANDERSON said he did not see the collision take place; however, he did hear it and rushed to the scene. Mr. ANDERSON said he was sitting at his house on East 36th Street when he heard the collision. Mr. ANDERSON said when he arrived he observed two Hispanic males at the intersection of Scottsdale Drive and East 34" Place. He said he saw what appeared to be a deceased male lying in the rubble of the brick wall. Mr. ANDERSON said he saw the male subject he believed to be deceased had head injuries. Mr. ANDERSON said the vehicle was a red Mustang with severe front end damage. Mr. ANDERSON said. the two Inale subjects at the intersection (Mr. Jose RAMIREZ and Mr. Jose MARQUEZ) were approximately 50 feet away from the vehicle when he arrived. He said both appeared to him to be shaken and confused, both told him their name was "Jose." One "Jose" was wearing a white T--shirt and the other "Jose" was wearing a black jacket. Mr. ANDERSON said the "Jose" in the white shirt said the vehicle was his and he had been driving it. INJURIE Mr. Rudy NATAL suffered fatal injuries from the. collision and was pronounced. deceased on scene at approximately 0129 hours by Yuma Regional Medical Center (YRMC) doctor, Doctor RICHMONDS. Mr. NATAL had massive trauma to his head which consisted of openings to the front and back of his skull. "Mr. Jose MARQUEZ was transported to YRMC by Rural Metro personnel, where he was treated and released the same day. Mr. MARQUEZ said he had a bad headache and was diagnosed with bruises. He did not have any broken bones. Mr. Jose RODRIGUEZ was transported to YRMC by Rural Metro personnel, where he was treated and released the same day. Mr. Jose RODRIGUEZ was diagnosed with aa concussion. Mr. RODRIGUEZ had ea small scrape cn1 his forehead, just right of center. EVIDENCE Evidence at the scene consisted of the damage to the vehicle, tire impressions in the dirt, and the damage to the private property. NARRATIVE On 10/23/09 at approximately 0130 hours I was contacted at home via telephone by Sheriff's Dispatch. I was advised of a fatal collision which had occurred on Scottsdale Drive at East 34"'Place. I arrived at the scene at approximately 0230 hours. I observed a single vehicle (Traffic Unit a red Ford Mustang, with severe damage located at the northwest corner of the intersection of Scottsdale Drive and. East 34th Place. I observed debris from a private property brick wall scattered over a large area in all directions. I walked the area around the vehicle and looked the vehicle over. I observed a tdue blanket laid out over a body. The blanket was covering the deceased, Mr. Rudy NATAL. I could tell the feet were facing to the northeast and the head was facing to the southwest and the body was face up. Mr. NATAL was approximately twelve feet to the west of the vehicle. I met with Deputy T. PARKER, P45, the initial case officer. I asked Dep. PARKER to tell me what he had seen and been told when he arrived. Dep. PARKER told me he had arrived within minutes of the collision occurring. He said he arrived and found the two "Jose's" away from Mr. NATAL. He checked Mr. NATAL could tell from the injuries he was deceased, so he went to the other two and talked to them. Dep. PARKER had laid the driver's licenses belonging to the three subjects out on the rear of Traffic Unit Dep. PARKER pointed to each driver's license and described where they were seated in the vehicle as he knew lit. Dep. PARKER said Mr. Jose RAMIREZ owned the vehicle and said he had been driving when the collision occurred- He said he was told Mr. Jose MARQUEZ had been seated in the right rear passenger seat and Mr. NATAL had been seated in the right front passenger seat. Dep. PARKER said after Rural Metro personnel arrived and Mr. RAMIREZ found out Mr. NATAL was deceased the story changed. He said Mr. RAMIREZ then told him Mr. NATAL had been driving the vehicle. Dep. PARKER said Rural Metro Personnel had transported both Mr. RAMIREZ and Mr. MARQUEZ. I I asked Dep. PARKER if Ina had any indicators of the use of alcoholic beverages and he said yes, he could smell the odor indicating they had been drinking something. I asked Dep. PARKER if there had been any witnesses. He said he had a witness statement, which is attached, from Mr. Michael ANDERSON. Dep. PARKERI said told lrun he got to the scene right after it happened as he had been outside his residence and heard the collision. Dep. PARKER told me Mr. ANDERSON said he had been told by Mr. Jose RAMIREZ that he (Mr. RAMIREZ) was driving the vehicle when the collision occurred. At approximately 0245 hours I spoke with Corporal R. MENDEZ, C-88, via telephone. I asked him to have a Deputy go to YRMC and recover a sample of blood from Mr. RAMIREZ and Mr. MARQUEZ. I told him if the hospital did not draw any blood to.notify me and we would do a warrant for the blood. Deputy A. OROZCO, P-87, recovered a sample of Mr. MARQUEZ and Mr. RAMIREZ's blood, processed them for shipment to the Arizona Department of Public Safety Laboratory for testing, and turned >>the' samaleshw gate the Yuma County Sheriff's Evidence '7 At approximately 0300 hours I left the scene to pick up the CART (Critical Accident Response Team) equipment from the Foothills Substation. At approximately 0330 hours I returned to the scene with the equipment. The area which was cordoned off prior to my arrival was from; the south portion of the intersection of Scottsdale Drive and East-34fi'Street south to approximately sixty feet south of Scottsdale Drive and East 34" Place. It was cordoned off from the intersection of East place and Scottsdale Drive to approximately fifty feet west and thirty feet east on East 34*" Place. I examined Traffic Unit #1 again, more closely. I found the right front wheel Emmi been torn fronn the 'vehicle. The center of the "wheel. was still attached to the axle on the vehicle. The wheel with the tire still on it was found in the yard at 11484 East 34"'Place. It was located in the southeast portion of the yard approximately six feet northwest of Mr. NATAL and approximately twenty feet northwest of the vehicle. I found the windshield had been shattered on the lower right portion. I was able to determine the cause of the shattering was from the impact with a brick and not from impact with a person's head. What I found was the coloring and an impact mark on the windshield. from ea brick at the location. where the shattering Ibegan. This location on the windshield was too far forward and down for a person's head to have impacted with it from the inside. The dash would prevent a person's head from reaching this low and forward. I checked the seatbelt assemblies and found they were in the stowed (not used) position. I also found when I pulled on them they were not locked in place and could be pulled completely out. I did not see any defects with the buckle portion of the belt assemblies. The driver's seatbelt was hung behind the driver's seat. The female portion of the driver's seatbelt assembly did not appear to have any defects with it and was located in a position where it could have been used. The front passenger seatbelt assembly was hanging straight down along the side of the passenger's seat and the female portion was located in a position where it could have been used. The right rear passenger's seatbelt assembly was not visible and the female portion was in a location making it not possible to have been used as it was lying behind the seat. The left rear passenger seatback was missing from the vehicle and was found approximately forty--three feet southwest of Traffic Unit lying amidst debris on East 34"'Place. I photographed the scene and vehicle using my digital camera. The photographs were later downloaded to a computer and burned to a compact disc. The compact disc was turned over to the Sheriff's Evidence Custodians. I met with Mr. Orwin MEEHLHAUSE who owns the property at 11484 East 34" Place. He told me he had heard an explosion outside. He said when he got to the front door he saw the vehicle had hit his wall. He said there was a man outside who yelled at him to call "91l" which he did. Mr. MEEHLHAUSE said he never saw the collision happen and did not talk to anyone outside. I set up the AIMS (Automated Instrument Mapping System) unit in the intersection of Scottsdale Drive and East 34"' Place. PARKER instructing hinx where to place the AIMS reflector. At approximately 0430 hours Medical Examiner's Investigator (MEI) Robert VIGIL, ME-1, arrived. Dep. PARKER placed the reflector at the head and feet of Mr. NATAL and I recorded his position. MEI VIGIL and I photographed Mr. NATAL prior to moving him. At approximately 0515 hours MEI VIGIL departed the scene with Mr. NATAL. At approximately 0530 hours I was contacted by MEI VIGIL via telephone. I was told the parents of all involved were at YRMC. I told MEI VIGIL I would have a Deputy go to the hospital and make notification to the parents of Mr. NATAL. I also told MEI VIGIL I would get the parents information and forward it to him. I contacted Dispatch and requested someone go to YRMC and notify the family and gather information. I released Dep. PARKER from the scene and walked the scene with Sheriff's. Volunteer D. DILLMAN, V--35, instructing him where I needed him to locate the reflector. . At approximately 0630 hours I released Volunteer DILLMAN from the scene. I walked the scene with Deputy GROSVENOR, P-85, instructing him where I need him to locate the reflector. At approximately 0700 hours I stopped recording the scene with the AIMS and again walked the scene in daylight. I again photographed the entire scene using my digital camera. During this daylight examination of the scene I found evidence not previously found. I found a portion of brain matter was located in the crease of two bricks in the portion of the wall which was still standing. This brain matter was approximately four feet from where Mr. NATAL's head had come to final rest. I was also able to more clearly View the tire impression left by Traffic Unit #1 when it left the roadway. These tire impressions left the roadway (Scottsdale Drive) approximately fifty--three feet south (Hf East 34th Street. They traveled in a southwesterly direction from the roadway to the location in the brick wall where a walk through gate had been located. The tire impressions indicated the vehicle was in a clockwise rotation at the time it was traveling southwest from the roadway. The direction of travel indicated Traffic Unit #1 struck the wall at the area of the gate hinge post and square cement pillar it was attached to. I also was able to identify two impressions in the dirt, between the wall and Scottsdale Drive, south of the brick sidewalk. These two impressions lead from the wall in a southeasterly direction to the final rest of Traffic Unit All the tire impressions were marked and recorded using the AIMS. At approximately 0840 hours I completed recording the scene with the AIMS equipment. At approximately 0855 hours Dick's Towing arrived and collected Traffic Unit #1 and its loose parts. (Measurements) At approximately 0910 hours I followed Dick's Towing to the Yuma County Sheriff's impound yard at 2755 East 14"'Street. At approximately 0930 hours Traffic Unit #1 was placed in the Yuma County Sheriff's impound yard in the southeast section. At approximately 1320 hours I arrived at 12311 South Renee Avenue to meet with Mr. Rudy NATAL's family and return his wallet and driver's license. I was met by Ms. Alicia SICAIROS, his cousin. Ms. SICAIROS said Mr. NATAL's parents were not home. She took possession the wallet and said she would Contact me when the parents got home and were ready to talk. At approximately 1325 hours I arrived at 12426 South Renee Avenue to talk to Mr. Jose RAMIREZ. Mr. RAMIREZ's father told me his son was sleeping and" medicated due to the collision. I was told he would have his son contact me on 10/24/09. . At approximately 1335 hours I arrived at 11825 Sheryl Drive to meet with Mr. Jose MARQUEZ. Mr. MARQUEZ was resting in his bedroom when I arrived. I spoke with Mr. MARQUEZ and asked him to tell me what he could remember about _the incident. Mr. MARQUEZ said they (himself, Mr. RAMIREZ, and Mr. NATAL) had all been_drinking the afternoon/evening before. He said they were drinking .and he believed they all had drunk about the same amount. _He said when they ran out they decided "to go to Wal*Mart and get some 5 Mr. MARQUEZ said he remembered going to the Shell mini--mart (South Frontage Road and Fortune Road) and picking up some possibly a twelve pack. Mr. MARQUEZ said he only remembered going from the Shell station and then sitting cni a wall. These statements were made as jjfihe was thinking about what he remembered. I asked him if he remembered who was driving and he instantly said "Rudy." Unlike the previous statements he made this took no thought before making the statement. On 10/24/09 at approximately 0850 hours Mr. Jose RAMIREZ and his parents arrived at the Foothills Substation. I talked with Mr. RAMIREZ in the training room of the Substation. 5 .I asked Mr. RAMIREZ to tell me the events of the afternoon and evening of 10/23/09. Mr. RAMIREZ said he, Mr. MARQUEZ, and Mr. NATAL had been working on "Rudy's" car and his (Mr. RAMIREZ's) girlfriend brought them some pizza. They_ had a thing of which they drank with the pizza. They drank the until it ran out. I asked if he had ever drunk iijlfibefore and he said Mr. RAMIREZ said Mr. NATAL wanted to test out his Mustang because it has the same engine they were putting in Mr. NATAL's truck. He said he let Mr. NATAL- drive to the Shell station. Mr. RAMIREZ said he does not remember the drive over to the Shell station. He said on the way back he remembered going around the Urgent Care facility (South Frontage Road and Scottsdale Drive) and they were going straight, but don't remember any of that."
