ORDER BANNING OPEN FIRES IN GREGG COUNTYJEXAS WHEREAS, in accordance with the provisions of Section 418.108 of the Texas Government Code, the undersigned County Judge of Gregg County, Texas, hereby ?nds and declares that a state of disaster exists in Gregg County based on the Keetch?Byram Drought Index and the imminent threat of disaster ?om wild?re; and WHEREAS, the declaration of said state of disaster authorizes the imposition of controls on certain activities which tend to increase the likelihood of such ?re; and WHEREAS, the normal danger of ?re in Gregg County is greatly enhanced by the drought conditions in Gregg County at this time; and BE IT THEREFORE ORDERED that the following emergency regulations are hereby established and in effect for all unincorporated areas of Gregg County, Texas: A. A person commits an offense if he/she burns any combustible material outside of an enclosure which serves to contain all ?ames and/or sparks, or orders such burning by others. B. An offense under this Order is a Misdemeanor punishable by a ?ne of up to $500.00. BE IT ALSO ORDERED that this Order may be enforced by any duly commissioned peace of?cer and that venue for prosecution of violations of this Order will be in Gregg County. BE IT FURTHER ORDERED that the purpose of this Order is the mitigation of the hazard posed by wild ?res during the current drought conditions by curtailing the practice of outdoor burning, which purpose is to be taken into account in any enforcement action based upon this Order.
