The victim stated that while he was outside the Dublin Library at 75 North High St he got into a verbal argument with the suspect who caused damage to his cell phone. The victim stated he was petitioning against House Bill 6 when he got into a verbal argument with the suspect who is from an opposing political group. The victim stated that during the argument he started recording the suspect and the suspect slapped the phone out of his hands causing it to fall to the ground, shattering the screen. The victim stated that several items belonging to the suspect then fell to the ground and both of them attempted to pick up the items. The victim stated that while picking up the items for the suspect, the suspect blocked him from doing so with her shoulder. Officers viewed the surveillance footage from the library which recorded the altercation. The video shows the victim apparently recording the suspect with his cell phone from a distance of approximately 6-8 feet. The suspect then approaches the victim and slaps the phone out of his hand causing it to fall to the ground. Both parties attempt to pick up several items which had fallen to the ground and the suspect pushes her shoulder towards the victim in an apparent attempt to stop him from picking up her items. The suspect`s action are clearly an attempt to stop the victim from gathering her items and there is no probable cause that an assault occurred or was attempted. The suspect accidentally left behind a flyer from her political organization which had a phone number listed on it. Officers attempted to contact the organization in an attempt to identify the suspect but there was no answer at either number and a message was left. The website listed on the flyer provides no additional contact information for the organization. Officers checked with the City Hall and there is no information about the group registered with the office. On 9/11/19 Upper Arlington Police received a similar disturbance call involving petitioners at the Upper Arlington Library with a suspect matching the description of the suspect out of this report. Upper Arlington Police identified the suspect as Stinner Wimberly-Shine and I identified her as the suspect through her Ohio BMV photo. On 9/11/19 Wimberly-Shine came to Police Headquarters and spoke with officers about the incident. When asked about the incident, Wimberly-Shine stated, "From my knowledge I did not slap the phone out of his hand" and "I may have hit it with my clipboard." Wimberly-Shine also alleged that the victim came up to her and hit her in the nose with his phone which is contradictory to what the surveillance footage shows. Wimberly-Shine refused to provide police with a written statement and she received a summons for criminal damaging. A copy of this report and the surveillance was forwarded to the city prosecutor for review regarding the physical contact between the suspect and the victim. The city prosecutor stated that there is no probable cause for an assault charge.
