Ashley Madsen (DOB: 07/13/94) and Nicole Madsen (DOB: 07/11/88) arrived at Troop and spoke with Tpr. Porczak #1238, in regards to their grandmother not being cared for. Ashley and Nicole reported their grandmother, Catherine Madsen (DOB: 11/20/33) resided at 101 Clayton Road in the town of North Canaan and was not being cared for. Nicole and Ashley visited their grandmother on 02/24/19 and saw she was non-verbal and in poor condition. it was reported the primary ca re taker for the grandmother was ?limmy,? James Madsen (DOB: 04/03/55). Jimmy is Catherine's son and the only other person residing within the residence. Ashley and Nicole reported they found their grandmother lying in her bed, soaked in urine. Ashely and Nicole reported finding bed sores and even bruising on their grandmother. 3) Upon Tpr. Porczak's arrival at 101 Clayton Road, North Canaan, he observed the residence to be a single family, two story building, with a detached garage. The outside of the residence appeared to be not well maintained with the yard and dirt driveway uncared for. Upon entering the home, it was clear the heat was not working. While at the house, Tpr. Porczak observed two electric space heaters, one utilized in the grandmother's bedroom and one in the hallway area of the house. Ashley and Nicole directed Tpr. Porczak toward their grandmother's room where she was found lying in a hospital style bed. He observed an elderly white female lying on her back with her mouth open. Tpr. Porczak observed Catherine to be breathing with a strong pulse. Nicole and Ashley showed Tpr. Porczak the bed sores they observed on their grandmother's legs and back. At that point, EMS was requested to respond to the scene. While on scene, Tpr. Porczak spoke with James Madsen and detected a strong odor of alcoholic beverage emanating from him. When asked about alcohol consumption, James refused to answer any questions. During the interaction with James, he appeared to be disoriented, guarded, and hostile. James was rambling and delusional. Porcza k's cursory search of the residence, it was noted the entire home had no heat and there was no running water. The home appeared to be unorganized and overail dirty. The home appeared to be uncared for, with items stacked along the upstairs rooms and haiiways. The bathrooms also emanated a strong odor of feces. 5} Catherine Madsen's bedroom was located on the first floor of the residence and was the first room on the right, when walking through the front door. When EMS arrived on scene, Tpr. Swift #1385 assisted with moving Catherine from her bed to the stretcher. Tpr. Swift observed Catherine covered in urine and was in dirty sheets. There were visible sores on her body. Once moved to the stretcher, Catherine was brought to the ambulance and transported to Sharon Hospital by North Canaan Ambulance. Tpr. Swift looked over the room Catherine was in and observed it was full of blankets and sheets as well as open containers of diapers and various medical suppiies. There was a smail space heater on a chair next to Catherine?s bed. 6) On 02/25/19 at approximately 1450 hours, Tpr. Porczak received notice from a North Canaan Fire Marshal that Catherine Madsen died overnight while under the care of Sharon Hospital. Tpr. Porczak spoke with Dr. Dave Wu, who worked with Catherine upon her arrival to the Emergency Department. Dr. Wu reported Catherine was in overall poor health and she was not well taken care of. Dr. Wu reported Catherine had several bed sores throughout her body and that he saw fungus on her skin. Dr. Wu reported Catherine was admitted to the hospital and moved to the upper level, where she passed away overnight. 7) On 02/25/19, Tpr. Porczak arrived at 20 East Main Street, North Canaan, to follow up with Ashley Madsen. Ashley provided the following sworn written statement: "My name is Ashley Madsen, l'm a resident of 20 East Main Street, North . Canaan and this statement pertains to the passing of my grandmother, Catherine Madsen. On 02/24/2019 at about 10:47 AM received a text message from my sister Nicole Madsen about my grandmother Catherine. I haven't seen my grandmother in about a year but i heard from family members that she was not doing great. My grandmother has been in a wheeichair for several years now and things began to get worse. About a year ago my grandmother was placed in (Beer Nursing home for congestive heart faiiure with signs of dementia. l'm not sure how long she was there for, but about a year ago she was brought back to her house located at 101 Clayton Road in North Canaan. She has been living there her whole life and as far as i know the only person living with her was her son Jimmy (James) Madsen. The text message from Nicole said that she was informed about our grandmother doing poor. Nicole decided to check on our grandmother by going to the house herself. After seeing the home, Nicoie drove to Geer Nursing home, where I work as a CNA, this was at about 11:15 AM. Nicole was crying and said i needed to go to the house to help her with our grandmother. We both drove to Nicole?s house to leave one car and carpool to our grandmother's house. We arrived at the house at about 11:25-11:30 AM and after entering her home and seeing what condition she was in i was discussed sic [disgustedi and upset. She was laying in her bed naked with just a bianket over her. She had a disposable pad underneath her thatwas soaked with her urine and looked as if it was not changed for at ieast 24 hours. i saw bed sores ail over her body, including her back, legs and stomach area. There was fungus present on her skin. We wanted to wash her at first but there was no running water at the house. We contacted my step-mother, Kimberly Madsen, for help. Kimberly lives in Torrington and brought a bucket of hot water from Torrington to help us clean her off. We washed her three times to try to get her clean. While we were there, Jimmy was at the house, both Nicole and I hate Jimmy and told him to go upstairs while we take care of our grandmother. We decided we needed to contact the police to get more help for her. Kimberly contacted Troop barracks with her cell phone whiie Nicole and i drove to the barracks to speak with a Trooper. Kimberly was not abie to go with us, because she had to go back to work. After expiaining our situation, we proceeded to the house to show the Troopers the condition my grandmother was in. Her statement reads as follows: "My name is Nicole Madsen (DOB 7/11/88) and am providing this statement in regards to a well-being check 1 requested for my grandmother, Catherine Madsen (DOB 11/20/33). On Saturday 2/23/19 1 received several Facebook Messenger messages from my aunt Cheryl Madsen. Cheryl had told me that my grandmother had stopped eating and drinking. She said that this has been going on for a few days. know that my grandmother was diagnosed with heart failure and I figured that this was the beginning of the end for her. My plan was to finish work, go home and sleep and then do a wellness check on her Sunday morning 2/24/19. On my way home from work i texted my father (Laurence Madsen) to let him know my plan and have him and my stepnmom (Kim Madsen) meet me at my grandmother's house, 101 Clayton Rd. in the town of North Canaan. My father and Kim live in Torrington. I got to my grandmothers at about 10:00 am. on Sunday 2/24/19 and my father and Kim arrived shortly after me. i went in the house to check on my grandmother. As soon as i saw her I knew she was farther along than 1 had thought. i did notice that there was a smell coming from my grandmotherrecognized the smell as a smell of death. My father, Kim and I decided to clean her up. i went home to get some supplies to help us clean my grandmother. I contacted my sister Ashley and asked her to bring some Toothettes to help clean my grandmother's mouth. Ashley met me back at my grandmother's house. She could tell that I had been crying and asked what was wrong. i told her that our grandmother was actively dying. Ashley, Kim and I cleaned her up. i had brought water from my house to give her a sponge bath because there is no running water at my grandmother's house. I was told that a pipe had burst and that was why there was no running water. I didn?t ask when the pipe had burst because i was upset. I was upset that i was not told of her condition sooner and I because i was going against her wishes of dying at home. i knew that she was in need of medical care and that she would not be able to stay at the house in these conditions. Even though she is my grandmother i felt that i needed gloves because she was not very clean. I noticed that she was moaning and clenching her fist. believed that she was in pain. Following the autopsy, a Notification to Police form was completed that stated the cause of death was certified as, "pending further studies," and the manner of death was certified as, ?pending." 11) On 03/11/19, Det. Koeppel spoke with Andrew D. Dellamarggio, a Special investigator with the Office of the Chief Medical Examiner. Dellamarggio stated he spoke with Catherine Madsen?s primary care physician's office and relayed the following information: her last office visit was on 06/29/18 where she presented as alert to person and place but not to time, she could answer questions, spoke clearly-and appropriately, and her daughter was listed and present at that time, as her caregiver. Catherine Madsen's primary care physician was Dr. Michelle Apiado, MD. out of Sharon Hospital Medical Practice located at 29 Hospital Hill Rd Ste. 1400 in Sharon, CT. Det. Koeppel confirmed this information via their medical office and also learned that Catherine Madsen?s medical records only go back to 2017 at this provider. 12) On 03/05/19 at approximately 1142 hours, Det. Koeppel contacted Foothills Visiting Nurse and Home Care, Inc. out of Winsted, CT. Det. Koeppel spoke with the Hospice Director. Det. Koeppel inquired about services provided for Catherine Madsen and/or services provided at 101 Clayton Rd. in North Canaan. The Hospice Director stated Madsen was discharged from their services in April of 2018. She stated they provided both physical therapy and social work services. The Hospice Director, reading from notes, stated Catherine lived with her son Jimmy, who was disabled, and he lived upstairs. She stated that Catherine needed, "total care," and her daughter Cheryl took care of that aspect. 13) The pertinent information from Madsen?s Sharon Hospital medical records can be summarized as follows: 0 Catherine E. Madsen, an 85 year old female, was brought to the Sharon Hospital Emergency Department on 02/24/19 at approximately 1558 hours and was subsequently admitted. The preliminary cause of death was listed as congestive heart failure. 14) The pertinent information from Madsen's Sharon Hospital Medical Practice medical records can be summarized as follows: 0 On 12/13/17, a visiting nurse documented, subsequent to a home visit, that Madsen resided in a very cluttered home with her disabled son, daughter, and her daughter's three young children. Madsen resided in one room on the first floor. It was also documented that Madsen took sponge baths and was listed as being completely dependent 0 As of 07/02/18, Madsen's conditions and diagnoses were documented on a Home Health Certification and Plan of Care form that was communicated to Foothills VNA. On this form, Madsen was diagnosed as having Alzheimer?s disease, a urinary tract infection, morbid obesity, hypertensive heart disease, and chronic systolic congestive heart failure. All of these diagnoses were as of 11/27/17. Furthermore, it was documented under safety measures, that Madsen required 24?hour supervision. The initial RN visit notated that Madsen was referred from Geer Nursing Home and was returning home with her adult children and a granddaughter who would be helping with her care. At that time, Madsen required a Hoyer lift for transfers and was incontinent with both urine and stool. 0 06/29/18 was Madsen's last documented visit with Dr. Apiado. On 10/05/18, it was documented that the patient, Madsen, contacted Dr. Apiado?s office requesting a form be filled out for Eversource concerning them shutting off her power. On 10/17/18, Madsen's daughter, who was listed as the caregiver, contacted Dr. Apiado's office and inquired about two pressure sores, one on Madsen's heel and one on her lower back from the Hoyer lift. Her daughter stated Madsen had an appointment on 10/25/18, but wanted to know if there was something to do beforehand. 15) On 05/09/19, Det. Koeppei interviewed Cheryl Madsen, Catherine's daughter and a known caretaker of her. She provided a typed statement which reads as follows: "My brother Jimmy and have been the primary caretakers for my mother, Catherine Madsen, since she was diagnosed with heart failure in December of 2017. Jimmy lived at my mother's house, 101 Clayton Rd, North Canaan, CT, and i lived there up until August of 2018, when my mother asked me to leave because she didn't like when Jimmy and i argued. Jimmy and i did not see to eye. My mother was diagnosed with heart failure in December of 2017 while staying at Fairview Hospital. I knew she was sick but thought she had pneumonia or a long lasting cold. Once she had that diagnosis and was released from the hospital, she went to Fairview Commons, a nursing home next to Fairview Hospital. iknew she had a DNR and a BM while she was at Fairview Hospital and she signed it on her own accord. These nursing home stays were due to urinary tract infections and her eventual diagnosis of Sundowner's a form of dementia. During her stays at home, she had 24 hour, around the clock care, whether it be by me, my brother Jimmy, or a VNA. In March of 2018, my mom became completely immobile and we had to use a Hoyer lift to get her out of bed, to the commode, etc. We would use this regularly for her but her bladder was so overactive that she also wore Depends. Whoever was with her was responsible for changing her. My dad was an extreme hoarder and passed away about 3 years ago. i went to my mom?s house three times every day, in between taking care of my kids and myjobs. While I was there, i would clean her room and also the kitchen; I would do the dishes and mop the floor. About 3-4 days before she died, she stopped eating, drinking, and being medication compliant. About 1 day before she died, she stopped being verbal. My mother hasn't been talking in full sentences in about two years. She also spoke very confused and not necessarily in a lot of sense, however she did speak. it was only until the end that she stopped speaking and i think it was because of her dehydration. She had a difficult time understanding everything since she came home from the first nursing home, Fairview Commons. My mom had told me that she wanted to die at home though. - Once she stopped eating and drinking, I told my niece Nicole to stop by the house because of this. This is when she and Ashley went to the house and apparently went to the state police shortly thereafter. That day, when my mom was brought to the hospital, i stopped by the house but was not allowed in. 1 spoke to a trooper on scene. haven't cleaned the house since my mom was taken out of it. I know the heat and water systems both broke a few days before she died. The heat system broke because it was reliant on the water system. I had two space heaters in my mom?s room and a curtain that hung over the door opening to keep the heat in. I am unsure what the condition of the house was when the police were there, but I know the laundry hadn?t been done for the week because of my work schedule. I know there is a lot of stuff in that house but i only cared about the kitchen and my mom's room. 1 never went upstairs. I was in the process of getting the water system fixed but once my mom's health declined and she left the house, i didn't fix it but am working on it still.? 16) On 07/11/19, Det. Koeppel interviewed Ashley Madsen. She provided a typed statement which reads as follows: ?Less than two weeks ago, I met with Forrest Beaulieu at the Torrington court. At that time, i reread the statement I gave on 02/26/19. That statement remains accurate and truthful to the best of my knowledge. i do not have much contact with this, the Madsen, side of my family. haven?t spoken to any of them since this incident with my grandmother on 02/24/19. 1 work at Geer Nursing Home and did so in February of this yeartoo. Before my grandmother passed away, the last time i saw her was months ago, while she was still in Geer. I found out she was signed out of Geer because I didn't see her one day and thought she had died but she had been brought home. She was not of sound mind to make that decision on her own. I hadn't been inside her house, at 101 Clayton Road, in a really long time. i had been to the house a few times but remained outside when i brought my children to visit over the years. My oldest daughter refused to go in when brought her there because she said it smelled bad. On 02/24/19, when my sister Nicole showed up to myjob and told me about my grand mother?s condition, I went to the house with her. Once was there, and before I notified the police, i washed her and put a sheet on the plastic hospital bed mattress she was laying on. She was undressed and it appeared as though it had been days since she was washed/bathed. There was also a small plastic beach ball underneath her center left calf, propping her foot up, and exposing the stage 4 wound on her left heel. The plastic hospital bed was coated, some of it dry, with feces and urine. There was something like a puppy pad rolled up underneath her that appeared to have been there for awhile and that was also disgusting. Nicole and cleaned my grandmother and dressed her. The stuff we were wiping out of the wounds all over her body was absolutely gross. Before I contacted the police, I took all the dirty towels, etc. and put them in a garbage bag. lthinkl left the garbage bag in that room on the floor. Kim, my step-mother, brought over hot water to help in cleaning up my grandmother. Kim is married to my dad, Laurence.? - 18) Medical advice to prevent pressure sores, bed sores, is to change positions frequently, keep the skin clean and dry, use pillows, and to exercise. Given the condition of the residence and Catherine's body, it was obvious some knowledge went into her caretaking by James; medical supplies were present and she was not malnourished. However, Catherine's physical state also evidenced a significant lack of care, as Catherine was intentionally deprived of proper physical care as well and that deprivation of physical care resulted in a serious physical injury to Catherine?s left heel.
