SHERIFF December 3, 2005 Dear Deputy Morris: On September 21, 2005, you were served with a Letter of intention, indicating your right to respond to the Sheriff's Department's pending disciplinary action against you, as reported under File Number IAB 2101944. You were also advised of your right to review the material on which the discipline was based. You did exercise your right to respond. After reviewing the response submitted to support your position, the Department executives have amended the recommended discipline. You are hereby notified that you are suspended without pay from your position of Deputy Sheriff, Item No. 2708A, with this Department for a period of thirty (30) days. However, pursuant to a settlement agreement between you and the Department, ?fteen (15) of the thirty (30) days will be held in abeyance for a period of twelve (12) months which will end on October 20, 2006. If you should become the Subject of a founded administrative investigation, with similar violations, and the event occurred within the prescribed twelve (12) month time period, the fifteen (15) days held in abeyance will be imposed. Additionally, you will be subject to further discipline for each and every founded violation of the Department's Manual of Policy and Procedures. All Departmental records will re?ect, nevertheless, that you received a thirty (30) day suspension. The effective dates for the remaining fifteen (15) day suspension are from December 6, 2005 through December 20, 2005. An investigation under File Number IAB 2101944, conducted by lnternal Affairs Bureau, coupled with your own statements, has established the following: 1. That in violation of Manual of Policy and Procedures Sections 3- 01/030.05, General Behavior; and/or Obedience to Laws, Regulations and Orders (speci?cally as it relates to Manual Sections Use of Force, Reporting and Review .97 yrao?'lz'on Deputy Daniel Morris, - 2 Procedures); and/or False Statements, on or about October 10, 2003, at the terminus of a vehicle pursuit with Pico Rivera Station units, you used force and/or witnessed the use of force upon Suspect Fernando Melendez Galaz and did not immediately report that force to the field sergeant. When advised by Sergeant Limon and Lieutenant Kimble that based on physical evidence and the suspect?s statements, they believed that force had been used, you again denied using force. You subsequently met with the other Subject deputies in the station parking lot and only then admitted to using necessary force to take the suspect into custody. By your actions, you have brought discredit upon yourself and the Sheriff?s Department. 2. That in violation of Manual of Policy and Procedures Section 3- 01/04075, Failure to Make Statements and/or Making False Statements During an internal investigation, on or about December 10, 2004, during your subject interview for the administrative investigation, you made false and/or misleading and/or self-serving statements and/or conspired with others to concoct a version of events to minimize your individual culpability in this incident regarding the use of force and/or subsequent failure to report the use of force. In taking this disciplinary action, your record with this Department has been considered, and a thorough review of this incident has been made by Department executives, including your Unit and Division Commanders. You will hereby take notice that any future acts of misconduct may result in more severe disciplinary action. The Sheriff?s Department reserves the right to amend and/or add to this letter.
